It centered around throwing out votes in seven states, falsely alleging that they had relied on invalid electors.<\/p>\n<p>Once those states, and the tens of millions of votes from them, were discarded, Pence could declare Trump the winner, Eastman reportedly said.<\/p>\n<p>Noting the all but certain objections from Democrats, Eastman then recorded how the House of Representatives would decide the election. Though Democrats had a House majority, each state delegation would get one vote, which Eastman said would result in a Trump win given Republicans\u2019 26-24 edge.<\/p>\n<p>\u201cThe main thing here is that Pence should do this without asking for permission \u2013 either from a vote of the joint session or from the Court,\u201d Eastman wrote in the memo. \u201cThe fact is that the Constitution assigns this power to the Vice President as the ultimate arbiter.\u201d&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2021\/01\/07\/mike-pence-senate-trump-biden-objection\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Here\u2019s The Moment Congress Certified Biden\u2019s Victory)<\/a><\/strong><\/p>\n<div id=\"attachment_7093793\" class=\"wp-caption alignnone\" readability=\"34\">\n<p id=\"caption-attachment-7093793\" class=\"wp-caption-text\">Then-Vice President Mike Pence and Speaker Nancy Pelosi early on Jan. 7. (Erin Schaff\/AFP via Getty Images)<\/p>\n<\/div>\n<p>CNN also noted that Eastman presented the plan to Sens. <a href=\"https:\/\/dailycaller.com\/2021\/01\/07\/could-have-killed-us-graham-slams-security-capitol-rioters-gained-entry-trump-supporters\/\" target=\"_blank\" rel=\"noopener noreferrer\">Lindsey Graham<\/a> and Mike Lee, both of whom argued that it had no merit.<\/p>\n<p>\u201cYou might as well make your case to Queen Elizabeth II. Congress can\u2019t do this. You\u2019re wasting your time,\u201d Lee reportedly told&nbsp;Trump\u2019s lawyers.<\/p>\n<p>The meeting reportedly occurred two days before Trump supporters stormed the Capitol in a bid to stop Congress from certifying President Joe Biden\u2019s victory, CNN reported.
