Wade, <\/i>a ruling on which could alter the trajectory of future abortion laws across the country.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The Mississippi <a href=\"https:\/\/www.npr.org\/2021\/09\/20\/1038972266\/supreme-court-date-roe-wade-dobbs-jackson-womens\">case<\/a>, <i>Dobbs v. Jackson Women\u2019s Health Organization<\/i>, has to do with a law banning most abortions after 15 weeks of pregnancy. Based on previous rulings from the court, states are required to allow pre-viability abortions, which occur before a fetus can survive on its own outside the womb \u2013 typically around 20 weeks of pregnancy.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">When it agreed to hear the case in May, the high court <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/qp\/19-01392qp.pdf\"><span class=\"s1\">granted<\/span><\/a> review of the question, \u201cWhether all pre-viability prohibitions on elective abortions are unconstitutional,\u201d meaning that if the court sides with Mississippi, states would potentially be allowed to decide their own abortion laws. States could once again place their own restrictions on abortions \u2013 possibly even up to the point of conception.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The Mississippi law is a direct confrontation to the pre-viability requirement. On agreeing to hear the case, the court implied it would make a decision on all pre-viability abortion laws.<\/p>\n<p class=\"p1\">The most recent announcement from the high court comes as Texas continues to be the center of the abortion debate in the United States after it passed a pro-life law outlawing most abortions after six weeks of pregnancy, when fetal cardiac activity can be detected.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The Biden administration has taken steps to challenge the Texas law. As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/doj-files-for-emergency-order-halting-texas-heartbeat-abortion-law\"><span class=\"s1\">reported<\/span><\/a>, \u201cAttorney General Merrick Garland&nbsp;<a href=\"https:\/\/www.justice.gov\/opa\/pr\/statement-attorney-general-merrick-b-garland-regarding-texas-sb8-0\"><span class=\"s1\">responded to the Supreme Court\u2019s decision<\/span><\/a>&nbsp;not to act by demanding that the United States government get involved, and vowing to \u2018protect those seeking to obtain or provide reproductive health services.\u2019\u201d<\/p>\n<p class=\"p1\">Then, the Justice Department filed a lawsuit against the state of Texas.<\/p>\n<p class=\"p1\">As The Daily Wire reported:<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<blockquote readability=\"20\">\n<p class=\"p1\"><i>The first filing argued for a preliminary injunction against the state of Texas, \u201cincluding its officers, employees, and agents,\u201d and \u201cincluding private parties who would bring suit under the law, from implementing or enforcing S.B. 8.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/i><\/p>\n<p class=\"p1\"><i>The emergency injunction, filed Tuesday, claimed that \u201ca State may not prohibit any woman from making the ultimate decision to terminate her pregnancy before viability,\u201d and again claimed that Texas implemented&nbsp;\u201can unprecedented scheme that seeks to deny women and providers the ability to challenge S.B. 8 in federal court. This attempt to shield a plainly unconstitutional law from review cannot stand.\u201d<\/i><\/p>\n<\/blockquote>\n<p class=\"p1\">Pro-life advocates and politicians have not been shy about their desire for the Supreme Court\u2019s ruling on the Mississippi case to overturn <i>Roe v. Wade.<\/i><\/p>\n<p class=\"p1\">As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/breaking-mississippi-pushes-u-s-supreme-court-to-overturn-roe-v-wade\"><span class=\"s1\">reported<\/span><\/a> in July, \u201cMississippi Attorney General Lynn Fitch asked the U.S. Supreme Court\u2026to defend \u2018the right of the people to pass laws that protect life and women\u2019s health,\u2019 urging the court to overturn&nbsp;<i>Roe v. Wade.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/i><\/p>\n<p class=\"p1\">\u201cThis Court\u2019s abortion precedents depart from a sound understanding of the Constitution. In&nbsp;<i>Roe v. Wade<\/i>, 410 U.S. 113 (1973), and&nbsp;<i>Planned Parenthood of Southeastern Pennsylvania v. Casey<\/i>, 505 U.S. 833 (1992), this Court held that abortion is a right specially protected by the Fourteenth Amendment, and so laws restricting it must withstand heightened scrutiny,\u201d Fitch wrote in a brief. \u201cThis Court should overrule&nbsp;<i>Roe<\/i>&nbsp;and&nbsp;<i>Casey<\/i>.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cRoe and Casey are egregiously wrong,\u201d the brief stated. \u201cThe conclusion that abortion is a constitutional right has no basis in text, structure, history, or tradition.\u201d<\/p>\n<p class=\"p2\"><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
