Two Wake County Superior Court judges <a href=\"https:\/\/www.documentcloud.org\/documents\/21064388-holmes-v-moore-final-judgment-18-cvs-15292-210917\" target=\"_blank\" rel=\"noopener noreferrer\">ruled<\/a>\u00a0the law violates the state\u2019s constitution \u201cbecause it was adopted with a discriminatory purpose.\u201d<\/p>\n<p>\u201cNorth Carolina\u2019s Voter ID law, was enacted with the unconstitutional intent to discriminate against African American voters,\u201d the majority wrote.<\/p>\n<p>The majority cited a 2015 study by Sen. Van Duyn that found at least 5.9% of registered voters lacked identification and that 9.6% of black voters \u201clacked acceptable ID\u201d compared to just 4.5% of registered white voters under a previous election bill. (SB 589).<\/p>\n<p>The majority also said the law was discriminatory because \u201csince a greater percentage of Black voters live in poverty, Black voters face greater hurdles to acquiring photo ID.\u201d<strong> <a href=\"https:\/\/dailycaller.com\/2021\/07\/08\/voting-integrity-laws-voter-suppression-racism-georgia-arizona-ballot-harvesting\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Democrats Are Desperate To Brand Voting Integrity Measures As \u2018Racist\u2019 Suppression)<\/a><\/strong><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">North Carolina court permanently blocks state\u2019s voter ID law, saying it was \u201cwas motivated at least in part by an unconstitutional intent to target African American voters.\u201d (clarifying earlier tweet). Full opinion: <a href=\"https:\/\/t.co\/qvcRZZKyfI\">https:\/\/t.co\/qvcRZZKyfI<\/a> <a href=\"https:\/\/t.co\/7MBpCn6V9V\">pic.twitter.com\/7MBpCn6V9V<\/a><\/p>\n<p>\u2014 Sam Levine (@srl) <a href=\"https:\/\/twitter.com\/srl\/status\/1438919241542086656?ref_src=twsrc%5Etfw\">September 17, 2021<\/a><\/p><\/blockquote>\n<p>Under the law, voters are required to present photo ID, including driver\u2019s licenses, military ID\u2019s and other forms of identification, according to <a href=\"https:\/\/abc11.com\/voter-id-law-nc-photo-unconstitutional-superior-court\/11027545\/\" target=\"_blank\" rel=\"noopener noreferrer\">ABC 11<\/a>.<\/p>\n<p>The legislation was passed just weeks after voters <a href=\"https:\/\/www.citizen-times.com\/story\/news\/local\/2018\/11\/06\/nc-election-results-constitutional-amendments\/1902238002\/\" target=\"_blank\" rel=\"noopener noreferrer\">voted in favor<\/a> of a constitutional amendment that would require voters present identification to vote. Democratic Gov. Roy Cooper <a href=\"https:\/\/abc11.com\/voter-id-bill-law-north-carolina-nc-house\/4899675\/\" target=\"_blank\" rel=\"noopener noreferrer\">vetoed<\/a> the bill but the General Assembly overrode it.<\/p>\n<p>Judge Nathaniel Poovey dissented, claiming \u201cnot one scintilla of evidence was introduced during this trial that any legislator acted with racially discriminatory intent.\u201d<\/p>\n<p>Poovey said plaintiffs relied on \u201cpast history of other lawmakers and used an extremely broad brush to paint the 2018 General Assembly with the same toxic paint. The majority opinion in this case attempts to weave together the speculations and conjectures that Plaintiffs put forward as circumstantial evidence of discriminatory intent behind Session Law 2018-144.\u201d<\/p>\n<p>Poovey noted that plaintiffs \u201cfailed to meet their initial burden\u201d to prove the legislature \u201cacted with a racially discriminatory intent.\u201d<\/p>\n<p>The majority appeared to concur, noting in their opinion that \u201cwe do not find that any member of the General Assembly who voted in favor of S.B. 824 harbors any racial animus or hatred towards African American voters, but rather \u2026 that the Republican majority \u00a0\u2018targeted voters who, based on race, were unlikely to vote for the majority party\u2019,\u201d the majority wrote. \u201cEven if done for partisan ends, that constitutes racial discrimination.\u201d<\/p>\n<p>Sam Hayes, general counsel for North Carolina House Speaker Tim Moore criticized the ruling in a <a href=\"http:\/\/speakermoore.com\/superior-court-blocks-voter-id-law-new-ruling\/\" target=\"_blank\" rel=\"noopener noreferrer\">statement<\/a>.<\/p>\n<p>\u201cOnce again, liberal judges have defied the will of North Carolinians on election integrity. Voters of this state have repeatedly supported a voter ID requirement \u2013 going so far as to enshrine it in our state constitution.
