The Job Creators Network (JCN) argued the mandate would make hiring more difficult, harming small businesses that are already <a href=\"https:\/\/dailycaller.com\/2021\/09\/14\/small-business-confidence-united-states-economy-recovery-inflation-chamber-of-commerce\/\">struggling to find workers<\/a> amid a <a href=\"https:\/\/dailycaller.com\/2021\/09\/15\/democrats-republicans-tax-increases-budget-reconciliation-inflation-unemployment-rate-economy\/\">slowing<\/a> <a href=\"https:\/\/dailycaller.com\/2021\/09\/03\/united-states-economy-joe-biden-economic-growth-pandemic\/\">economic recovery<\/a>.<\/p>\n<p>\u201cPresident Biden\u2019s vaccine mandate on small businesses is unconstitutional and a dramatic overreach of federal authority,\u201d JCN President Alfredo Ortiz said in a statement. \u201cTo hold the Biden Administration accountable and stand up for small businesses, Job Creators Network plans to file a lawsuit to block the implementation of this order.\u201d<\/p>\n<p>\u201cSmall businesses are already contending with a historic labor shortage and this order will add expensive new barriers to finding and keeping employees, causing significant harm at the worst possible time,\u201d he continued. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/14\/joe-biden-coronavirus-vaccine-mandate-arizona-mark-brnovich\/\">(RELATED: Arizona Becomes First State To Sue Biden Over Vaccine Mandates)<\/a><\/strong><\/p>\n<p>On Sept. 9, President Joe Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/09\/09\/remarks-by-president-biden-on-fighting-the-covid-19-pandemic-3\/\">ordered<\/a> the Occupational Safety and Health Administration to craft a rule requiring employers to mandate COVID-19 vaccinations for workers. However, it remains unclear whether tests would be paid for by employers or workers.<\/p>\n<p>Roughly 20 million Americans work for a small business with more than 100 employees, <a href=\"https:\/\/cdn.advocacy.sba.gov\/wp-content\/uploads\/2020\/06\/04144224\/2020-Small-Business-Economic-Profile-US.pdf\">according<\/a> to the latest estimate from the Small Business Administration. The federal government\u2019s <a href=\"https:\/\/www.ecfr.gov\/current\/title-13\/chapter-I\/part-121#:~:text=size%20standards%20used%20to%20define%20small%20business%20concerns\">definition<\/a> of a small business varies based on industry, but may include companies employing as many as 1,500 workers.<\/p>\n<p>\u201cThe federal government doesn\u2019t have the power to require small businesses to carry out its de facto national vaccine mandate,\u201d Ortiz said. \u201cJCN\u2019s lawsuit intends to block this federal power grab.\u201d<\/p>\n<p>Arizona <a href=\"https:\/\/dailycaller.com\/2021\/09\/14\/joe-biden-coronavirus-vaccine-mandate-arizona-mark-brnovich\/\">became the first state<\/a>&nbsp;to sue the Biden administration over the mandate Tuesday.
