In an effort to avoid that result, Texas devised an unprecedented scheme that seeks to deny women and providers the ability to challenge S.B. 8 in federal court,\u201d the filing said. \u201cThis attempt to shield a plainly unconstitutional law from review cannot stand.\u201d<\/p>\n<p><a title=\"View DOJ Asks Federal Judge To Block Texas Abortion Law on Scribd\" href=\"https:\/\/www.scribd.com\/document\/525475477\/DOJ-Asks-Federal-Judge-To-Block-Texas-Abortion-Law#from_embed\">DOJ Asks Federal Judge To B\u2026<\/a> by <a title=\"View Mary Margaret Olohan&#039;s profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/506904746\/Mary-Margaret-Olohan#from_embed\">Mary Margaret Olohan<\/a><\/p>\n<p>\u201cThe United States has the authority and responsibility to ensure that Texas cannot insulate itself from judicial review for its constitutional violations and to protect the important federal interests that S.B. 8 impairs,\u201d the DOJ filing said.<\/p>\n<p>Abortion advocates scrambled, without success, to block the law before it went into effect Sept. 1.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/21a24_8759.pdf#page=7\">denied<\/a> the abortion providers\u2019 request to block the Texas Heartbeat Act in a 5-4 ruling that President Joe Biden <a href=\"https:\/\/dailycaller.com\/2021\/09\/02\/joe-biden-supreme-court-abortion-ruling-rule-of-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">called<\/a> an \u201cunprecedented assault on a woman\u2019s constitutional rights under Roe v. Wade.\u201d<\/p>\n<p>Attorney General Merrick Garland <a href=\"https:\/\/dailycaller.com\/2021\/09\/09\/biden-sue-texas-abortion-report\/\">announced<\/a> Sept. 9 that the Biden administration was suing Texas. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/14\/glenn-youngkin-pro-life-virginia-mcauliffe-washington-post-pinocchios\/\">(RELATED: Washington Post: Glenn Youngkin Isn\u2019t As Pro-Life As McAuliffe Claims)<\/a><\/strong><\/p>\n<p>\u201cThe Department of Justice has a duty to defend the constitution of the United States and to uphold the rule of law,\u201d Garland said Thursday. \u201cToday we fulfill that duty by filing the lawsuit I have just described.\u201d<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n<p>The new&nbsp;<a href=\"https:\/\/dailycaller.com\/2021\/08\/23\/attorney-lawsuit-texas-abortion-law\/\">The Heartbeat Act<\/a> has particularly upset abortion advocates as it allows \u201cany person\u201d to sue doctors, abortion clinics, or anyone who \u201cknowingly engages in conduct that aids or abets the performance or inducement of an abortion.\u201d<\/p>\n<p>Those who sue over an abortion may be awarded $10,000 \u201cfor each abortion\u201d the defendant performed, induced, aided, or abetted in violation of the law.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
