While the order is facing numerous challenges in court, OSHA may struggle to enforce it regardless thanks to the agency <a href=\"https:\/\/theintercept.com\/2020\/10\/20\/trump-osha-workplace-safety-covid\/\" target=\"_blank\" rel=\"noopener noreferrer\">hemorrhaging staff and funding<\/a> under the Trump administration.<\/p>\n<p>Former President Barack Obama\u2019s administration worked to beef up OSHA\u2019s regulatory authority, but the Trump administration rolled back those reforms and then pushed the agency even further back under its more general policy of \u201cheavy deregulation.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/13\/scott-gottlieb-joe-biden-vaccine-mandate-osha-overtly-political\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Former FDA Chief Says Biden Went Too Far With Vaccine Mandate And Made Jabs \u2018Overtly Political\u2019)<\/a><\/strong><\/p>\n<div class=\"featured-image relative\" data-fullscreen-image readability=\"10\">\n<div id=\"attachment_7280159\" class=\"wp-caption alignnone\" readability=\"40\"><img decoding=\"async\" aria-describedby=\"caption-attachment-7280159\" loading=\"lazy\" class=\"size-full wp-image-7280159\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/09\/GettyImages-1339349140-scaled-e1631288207304.jpg\" alt=\"WASHINGTON, DC - SEPTEMBER 09: U.S. President Joe Biden speaks about combatting the coronavirus pandemic in the State Dining Room of the White House on September 9, 2021 in Washington, DC. (Kevin Dietsch\/Getty Images)<\/em><\/p>\n<\/div><\/div>\n<p>\u201cIt\u2019s always been true with OSHA that, especially relative to other government agencies, it\u2019s just woefully understaffed,\u201d professor Matthew Johnson, a labor economist at Duke University, <a href=\"https:\/\/www.businessinsider.com\/how-underfunded-understaffed-osha-will-enforce-vaccine-mandate-2021-9\" target=\"_blank\" rel=\"noopener noreferrer\">told<\/a> Business Insider. \u201cFrom the outset, they\u2019ve been kind of under-resourced both in terms of their manpower, in terms of the inspectors, and they\u2019ve also always been very limited in the size of penalties that the agency can levy on employers they catch violating the law.\u201d<\/p>\n<p>Trump also drastically cut back on the number of OSHA inspectors before leaving office, and Biden is <a href=\"https:\/\/news.bloomberglaw.com\/safety\/recruiting-a-hurdle-to-bidens-goal-of-doubling-osha-inspectors\" target=\"_blank\" rel=\"noopener noreferrer\">now pushing to double their number<\/a>. The current president faces an uphill battle to do so amid the pandemic, however, as few qualified candidates are interested in the role. Even if he is successful, OSHA would still have just over 3,000 inspectors tasked with enforcing a vaccine mandate that affects 80 million U.S. workers. As it stands, agency employs 1,798 inspectors.<\/p>\n<p>\u201cOver the four years of that administration, they just let OSHA shrink and shrink and shrink by attrition, never filling any of the slots that were open for hiring,\u201d Judy Conti, a Trump critic and government-affairs director at the National Employment Law Project, told Insider. \u201cAnd the enforcement that they did was fairly pitiful. So this Department of Labor had a lot to catch up on and a lot of making up to do.\u201d<\/p>\n<p>Aside from the worker shortage, OSHA will also likely struggle to effectively penalize companies that are flouting Biden\u2019s mandate.
