Biden announced executive changes last week, which would reportedly affect 100 million Americans.<\/p>\n<p>In particular, the new rules were set to require all federal and federally contracted employees to be vaccinated as well as business with over 100 employees. The pushback was immediate.<\/p>\n<p>The Republican National Committee said they planned to sue the Biden Administration as soon as the new rule became official. In addition, Oklahoma Attorney General John O\u2019Connor said his office was already preparing litigation to defend the rule of law against the overreach of federal government.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">For nearly a year, they promised: NO VACCINE MANDATE.<\/p>\n<p>They lied. <a href=\"https:\/\/t.co\/ph5ZghjDxH\">pic.twitter.com\/ph5ZghjDxH<\/a><\/p>\n<p>\u2014 RNC Research (@RNCResearch) <a href=\"https:\/\/twitter.com\/RNCResearch\/status\/1437520273771835398?ref_src=twsrc%5Etfw\">September 13, 2021<\/a><\/p>\n<\/blockquote>\n<p>The governors and attorney generals for numerous states across the country have followed suit, such as Kansas Sen. Roger Marshall (R) who argued the mandate violated the Constitution and should be left up to individual states to decide.<\/p>\n<p>He went on to explain, \u201cthis should be a 10th Amendment issue where the state\u2019s power supersedes the government.\u201d<\/p>\n<p>However, constitutional lawyer Alan Dershowitz said in a recent interview he believed the courts could say the federal government had jurisdiction in this case because COVID-19 was contagious, therefore making it a national issue that crossed state lines.<\/p>\n<p>The problem would be enforcing the penalties because unlike states, the federal government did not have police power. Rather, its power came from the Constitution alone.<\/p>\n<p>The Harvard Law School professor emeritus said a person\u2019s right to punch ends at the tip of another person\u2019s nose. One person\u2019s freedoms cannot infringe on another\u2019s rights.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Joe Biden\u2019s vaccine mandate is an unconstitutional, unlawful, and authoritarian power grab.<\/p>\n<p>\u2014 Rep. Elise Stefanik (@RepStefanik) <a href=\"https:\/\/twitter.com\/RepStefanik\/status\/1437435903572647944?ref_src=twsrc%5Etfw\">September 13, 2021<\/a><\/p>\n<\/blockquote>\n<p>For Dershowitz, the key question for the new mandates\u2019 constitutionality was if a U.S. president had the authority alone, by declaring an emergency, to make law and impose punishments.<\/p>\n<p>\u201cAlready we\u2019ve had companies and states indicate they are going to file suit. This is going to be a big payday for lawyers unfortunately, but it will get the case to court right away,\u201d he stated. \u201cI suspect that within a month, the Supreme Court will issue a preliminary decision on whether or not a president, as distinguished in Congress, can impose a near universal mandate.\u201d<\/p>\n<p>Since creating laws was a duty of the legislative arm of government, he believed the courts would say the president did not have the authority to mandate vaccines without the approval of Congress. Simply put, in exercising executive power to enact a universal mandate, Biden has clearly violated the Constitution.<\/p>\n<p>\u201cCarefully done, constitutionally done,\u201d Dershowitz stated. \u201cI care deeply about the Constitution and the end should not justify the means.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Anthony Fauci, July 2020:<\/p>\n<p>Vaccine mandates would encroach \u201cupon a person\u2019s freedom to make their own choice on their own health.\u201d<\/p>\n<p>Joe Biden, December 2020:<\/p>\n<p>\u201cNo, I don\u2019t think [vaccines] should be mandatory. I wouldn\u2019t demand it be mandatory.\u201d<\/p>\n<p>\u2014 Rep. Jim Jordan (@Jim_Jordan) <a href=\"https:\/\/twitter.com\/Jim_Jordan\/status\/1437526000150188036?ref_src=twsrc%5Etfw\">September 13, 2021<\/a><\/p>\n<\/blockquote>\n<p>The mandate relies on a rarely used workplace rule that reportedly has a history of being blocked in court. The Occupational Safety and Health Administration could implement an emergency standard when workers were exposed to a \u201cgrave danger,\u201d which would allow the agency to sidestep the usual process for developing a standard.<\/p>\n<p>However, opponents could argue a grave danger, which was not defined in the law and didn\u2019t exist on a national level as the current spike in COVID-19 cases was regional.
