Kathy Hochul sent a letter Monday to Facebook CEO Mark Zuckerberg requesting that the social media giant increase efforts to censor pro-life \u201cmisinformation\u201d in light of Texas\u2019 new law banning abortions after babies\u2019 heartbeats can be detected.<\/p>\n<p>Hochul, who took office in late August after former Gov. Andrew Cuomo resigned over numerous #METOO allegations, expressed concern that viral Facebook posts about the Texas Heartbeat Act will make women who seek abortions feel \u201cunsafe\u201d and \u201calone.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/10\/hochul-new-york-abortion-governor\/\">(RELATED: \u2018Let\u2019s Take This Battle All Across The Nation\u2019: New York Governor Kathy Hochul Vows To Protect Abortion, Fight \u2018Oppression\u2019 Of Pro-Life Laws)<\/a><\/strong><\/p>\n<p>\u201cThe truth is that abortion is a safe, common medical procedure,\u201d Hochul wrote. \u201cOne in four women will undergo an abortion in her lifetime. I am proud that New York is leading the fight to ensure that every woman and birthing person has access to abortion care.\u201d<\/p>\n<p>The \u201cone in four\u201d statistic that Hochul referenced is <a href=\"https:\/\/www.washingtonpost.com\/news\/fact-checker\/wp\/2015\/09\/30\/the-stale-claim-that-one-in-three-women-will-have-an-abortion-by-age-45\/\">outdated<\/a> and inaccurate, <a href=\"https:\/\/www.cdc.gov\/reproductivehealth\/data_stats\/abortion.htm\">based on available data<\/a>.<\/p>\n<p>Hochul did not immediately respond to a request for comment from the Daily Caller News Foundation specifying what type of misinformation she wishes Facebook to censor, but her Monday letter references Facebook posts about&nbsp;the Reproductive Health Act, which Cuomo signed into law in January 2019.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2019\/01\/23\/world-trade-center-lit-pink-abortion\/\">(RELATED: World Trade Center Lit Up In Pink To Celebrate Abortion Bill)<\/a><\/strong><\/p>\n<p><a title=\"View New York Governor Asks Facebook To Censor Pro-Life &#039;Misinformation&#039; About Abortion on Scribd\" href=\"https:\/\/www.scribd.com\/document\/525040131\/New-York-Governor-Asks-Facebook-To-Censor-Pro-Life-Misinformation-About-Abortion#from_embed\">New York Governor Asks Face\u2026<\/a> by <a title=\"View Mary Margaret Olohan&#039;s profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/506904746\/Mary-Margaret-Olohan#from_embed\">Mary Margaret Olohan<\/a><\/p>\n<p class=\"css-axufdj evys1bk0\">The Reproductive Health Act\u2019s passage removed abortion from New York\u2019s criminal code,&nbsp;<a href=\"https:\/\/dailycaller.com\/2019\/01\/23\/abortion-roe-v-wade-new-york\/\" target=\"_blank\" rel=\"noopener noreferrer\">allows<\/a>&nbsp;non-doctors to perform abortions and allows women to obtain&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/us-policy\/2019\/02\/06\/tough-questions-answers-late-term-abortions-law-women-who-get-them\/?utm_term=.a0c603f12632\" target=\"_blank\" rel=\"noopener noreferrer\">late-term<\/a>&nbsp;abortions if their health is in danger or if their unborn baby is not viable.<\/p>\n<p>Fact-checkers like Politifact <a href=\"https:\/\/www.politifact.com\/factchecks\/2020\/jan\/14\/viral-image\/facebook-post-about-new-yorks-abortion-law-still-w\/\">have rated Facebook posts<\/a> \u201cFalse\u201d for saying that the New York law allows abortions up until birth, though the legislation does not specify at what point an abortion is no longer permissible.<\/p>\n<p>The Reproductive Health Act&nbsp;<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/S240\">states<\/a> that an abortion may be performed when \u201caccording to the practitioner\u2019s reasonable and good faith professional judgment based on the facts of the patient\u2019s case: the patient is within twenty-four weeks from the commencement of pregnancy, or there is an absence of fetal viability, or the abortion is necessary to protect the patient\u2019s life or health.\u201d<\/p>\n<p>The Reproductive Health Act does not define \u201chealth\u201d or \u201cfetal viability,\u201d as a <a href=\"https:\/\/www.usatoday.com\/story\/news\/factcheck\/2020\/04\/30\/fact-check-andrew-cuomo-new-york-law-does-not-allow-abortion-up-until-birth\/3014473001\/\">USA Today fact check noted<\/a>.<\/p>\n<p>The USA Today fact check rated the claim that the law legalizes abortion up until birth as \u201cpartly false,\u201d saying, \u201cwhile it is true that New York\u2019s abortion law allows procedures after 24 weeks, there are rules guiding that procedure: if the fetus is not viable or if the health or life of the mother is at risk.\u201d<\/p>\n<p>\u201cIf medical practitioners determine that either of these factors are present, the mother can choose to have an abortion,\u201d the fact check concluded.<\/p>\n<p>Pro-life activists like Live Action Founder and President Lila Rose have said that they are inappropriately targeted by biased Facebook fact-checkers. In September 2019, two abortionists <a href=\"https:\/\/dailycaller.com\/2019\/09\/07\/live-action-facebook-censored\/\">were cited<\/a>&nbsp;in a fact check dinging Live Action, and one of these abortionists had openly criticized Live Action and Rose.<\/p>\n<p>The Aug. 30&nbsp;<a href=\"https:\/\/healthfeedback.org\/claimreview\/lila-rose-claim-that-abortion-is-never-medically-necessary-is-inaccurate-it-is-necessary-in-certain-cases-to-preserve-mothers-life-young-america-foundation\/\">fact check<\/a>, published in Health Feedback, targeted an Aug. 9&nbsp;<a href=\"https:\/\/www.facebook.com\/lilagracerose\/videos\/508941603187665\/\">video<\/a> that included the statement \u201cabortion is never medically necessary.\u201d The fact check also dinged a separate video shared by Live Action, featuring <span id=\"m_-554559895663473800gmail-m_-250638779922510439m_5010901395820754176gmail-m_-233812074142443272gmail-docs-internal-guid-f9d49cf8-7fff-4685-9934-9c337a89103f\">Dr. Kendra Kolb also saying that \u201cabortion is never medically necessary<\/span>.\u201d<\/p>\n<p>Facebook works with third-party fact-checkers certified through a \u201cnon-partisan International Fact-Checking Network\u201d in attempts to identify and rate false news. President Joe&nbsp;Biden <a href=\"https:\/\/dailycaller.com\/2021\/09\/02\/joe-biden-supreme-court-abortion-ruling-rule-of-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">called<\/a>&nbsp;the&nbsp;ruling an \u201cunprecedented assault on a woman\u2019s constitutional rights under&nbsp;Roe v. Wade\u201d on Sept. 2, and Attorney General Merrick Garland announced Sept. 9 that the Biden administration is suing Texas over the state\u2019s new law.<\/p>\n<p>The new&nbsp;<a href=\"https:\/\/dailycaller.com\/2021\/08\/23\/attorney-lawsuit-texas-abortion-law\/\">law<\/a>&nbsp;has particularly upset abortion advocates, as it allows \u201cany person\u201d to sue doctors, abortion clinics, or anyone who \u201cknowingly engages in conduct that aids or abets the performance or inducement of an abortion.\u201d<\/p>\n<p>Those who sue over an abortion may be awarded $10,000 \u201cfor each abortion\u201d the defendant performed, induced, aided, or abetted in violation of the law.<\/p>\n<p>Hochul and Democratic New York Sen. Kirsten Gillibrand also <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-announces-agenda-affirm-abortion-rights-new-york-stands-senator-gillibrand\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> an agenda to \u201c<span class=\"m_-7179609074755415492DefaultParagraphFont\">affirm abortion rights and cement New York\u2019s status as a place to welcome women seeking abortion care,\u201d according to a press release from the governor\u2019s office.<\/span><\/p>\n<p>The governor directed state agencies to \u201c<span class=\"m_-7179609074755415492DefaultParagraphFont\">coordinate a statewide public information campaign\u201d that will make women aware of their legal protections and develop a patient bill of rights. Hochul also ordered the New York <\/span><span class=\"m_-7179609074755415492DefaultParagraphFont\">Department of Health to help ease patient\u2019s ability to access abortion drugs in health visits that take place over the phone or the internet, the press release said.<\/span><\/p>\n<p><span class=\"m_-7179609074755415492DefaultParagraphFont\">\u201cThe recent law in Texas \u2013 and the Supreme Court\u2019s refusal to block it \u2013 is dangerous and disturbing,\u201d Gillibrand said in a statement. \u201cThis law is not just unconscionable, it\u2019s unconstitutional. At the federal level, we must pass the <\/span><span class=\"m_-7179609074755415492Emphasis m_-7179609074755415492DefaultParagraphFont\">Women\u2019s Health Protection Act<\/span><span class=\"m_-7179609074755415492DefaultParagraphFont\">, which would create federal protections against state restrictions that fail to protect women\u2019s health and intrude upon personal decision-making.\u201d<\/span><\/p>\n<p><span class=\"m_-7179609074755415492DefaultParagraphFont\">\u201cHere in New York,\u201d she continued, \u201cwe luckily have a governor who understands and champions fundamental reproductive rights.
