Wade<\/em>&nbsp;continuing life.\u201d<\/p>\n<p>On Friday\u2019s episode of \u201cMorning Joe,\u201d guest host Willie Geist asked former Obama administration U.S. attorney Barbara McQuade about a Texas law that bars abortionists from performing an abortion if they can detect a fetal heartbeat.<\/p>\n<p>In a 5-4 <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/21a24_8759.pdf\">decision<\/a> offered Thursday, the Supreme Court <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-abortion-providers-request-to-stay-texas-heartbeat-law\">allowed<\/a> the law to remain in effect while the case wends its way through the court system \u2014 an action McQuade claimed violates the \u201cright\u201d to an abortion, which she considers as sacrosanct as the freedom of religion.<\/p>\n<p>\u201cWhat is so upsetting and diabolical about this decision is that the Supreme Court is really hiding behind what they referred to as \u2018procedural complexities\u2019 that they want to see play out in the lower courts before they get involved,\u201d she said.<\/p>\n<p>\u201cThat might make sense, except for the fact that for every minute that goes by while they decline to hear the merits of the case, the rights of women seeking abortions in Texas is being violated,\u201d continued McQuade, who is now a <a href=\"https:\/\/michigan.law.umich.edu\/faculty-and-scholarship\/our-faculty\/barbara-l-mcquade\">professor<\/a> at the University of Michigan Law School.<\/p>\n<p>She added that the justices\u2019 decision against issuing a stay of the Texas heartbeat law \u201cflies in the face of something they did early this summer, when they did intervene in a case in California involving religious liberty \u2026 even though that case and not yet played out.\u201d<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20a87_4g15.pdf\">stopped<\/a> California Governor Gavin Newsom (D) from enacting strict capacity limits on churches and other houses of worship in the name of fighting COVID-19. Ultimately, justices ruled against the state regulations, which they found unduly burdened religious liberty, on <a href=\"https:\/\/www.dailywire.com\/news\/a-huge-win-california-lifts-capacity-limits-on-churches-following-5-rebukes-from-scotus\">five separate occasions<\/a>. Los Angeles County officials decided this week to pay <a href=\"https:\/\/www.dailywire.com\/news\/l-a-county-to-pay-400000-to-john-macarthurs-grace-community-church\">$400,000<\/a> to Pastor John MacArthur\u2019s <a href=\"https:\/\/www.gracechurch.org\/\">Grace Community Church<\/a> based on those rulings.<\/p>\n<p>While the First Amendment enjoins the government from making any law \u201cprohibiting the free exercise\u201d of religion, justices <a href=\"https:\/\/www.dailywire.com\/news\/pro-life-americans-are-like-suicide-bombers-msnbc-guest\">couched<\/a> the constitutional \u201cright\u201d to an abortion in a newfound \u201csexual privacy\u201d guaranteed by \u201cpenumbras, formed by emanations\u201d of the Constitution\u2019s text.<\/p>\n<p>The fact that the Supreme Court\u2019s newly conservative majority did not treat the two issues equally suggests they may overturn the landmark 1973 <em>Roe v. Wade<\/em> decision, McQuade told MSNBC viewers.<\/p>\n<p>She explained that \u201cone of the standards\u201d for denying a stay request of the Texas bill \u201cis the likelihood of success on the merits. And the majority didn\u2019t address that\u201d on Thursday.<\/p>\n<p>\u201cThere are five justices that concern me,\u201d she said. \u201cTheir silence there I think does not bode well long term for&nbsp;<em>Roe v. Wade<\/em>.\u201d<\/p>\n<p>Allowing the Texas law, which permits \u201cany person\u201d in the state of Texas to sue anyone who facilities an abortion after approximately six weeks\u2019 gestation, may indicate how the justices will rule on another abortion case facing the high court, McQuade offered.<\/p>\n<p>\u201cI think, Willie, that there\u2019s some tea leaves here\u201d about&nbsp;<em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>.<\/p>\n<p>The state of Mississippi passed a law limiting abortions to the <a href=\"https:\/\/www.dailywire.com\/news\/mississippis-15-week-limit-on-abortion-is-mainstream-in-european-law-study\">first 15 weeks of pregnancy<\/a>, well below the threshold established by <em>Roe <\/em>and its 1992 successor case, <em>Casey v. Planned Parenthood<\/em>.&nbsp;Lawmakers say the state has more interests in protecting unborn life besides the one they establish, fetal viability.<\/p>\n<p>\u201cIt is a possibility that when the Supreme Court hears this case, <em>Dobbs<\/em>, in the next tern, that that may be the opportunity to overrule <em>Roe v. Wade<\/em>,\u201d McQuade said.<\/p>\n<p>Treating the decision as though it were a living being facing termination, McQuade said, \u201cI think that suggests to me that the handwriting may be on the wall that they don\u2019t intend to give&nbsp;<em>Roe v.
