Cooper, a Leon County Circuit Judge. Cooper previously said that DeSantis had overstepped his state authority in his July executive order on masking in schools.&nbsp;<\/span><\/p>\n<p><span>Looking at the legislation and orders in question, Cooper said that masking mandates do not need to \u201cinclude a parent-opt out at all,\u201d <a href=\"https:\/\/apnews.com\/article\/lifestyle-health-education-florida-coronavirus-pandemic-680a3dccc72e125a51c7f97cfd0f0735?utm_campaign=SocialFlow&amp;utm_source=Twitter&amp;utm_medium=AP\">according<\/a> to the Associated Press.&nbsp;<\/span><\/p>\n<p><span>The ruling enabled Florida county school boards to put mask mandates in place if they choose. Yet, as the AP <\/span><span>reports<\/span><span>, DeSantis\u2019s appeal now stays the ruling, meaning that it\u2019s at least temporarily suspended.&nbsp;<\/span><\/p>\n<p><span>When Cooper issued his decision last week, a spokesman for DeSantis released a statement saying that Cooper\u2019s decision went against parents rights and ignored \u201cscience and facts.\u201d<\/span><\/p>\n<p><span>\u201c<\/span><span>It\u2019s not surprising that Judge Cooper would rule against parent\u2019s rights and their ability to make the best educational and medical decisions for their family, but instead rule in favor of elected politicians. This ruling was made with incoherent justifications, not based in science and facts \u2013 frankly not even remotely focused on the merits of the case presented,\u201d the statement <\/span><a href=\"https:\/\/www.mysuncoast.com\/2021\/08\/27\/gov-desantis-office-releases-statement-judges-block-mask-mandate-ban\/\"><span>said<\/span><\/a><span>.&nbsp;<\/span><\/p>\n<p><span>Earlier this week, DeSantis also said that he believed that his appeal would ultimately prove successful. <\/span><span>\u201cIt\u2019ll be appealed. We\u2019ll end up getting it back,\u201d he <\/span><a href=\"https:\/\/floridapolitics.com\/archives\/453973-ron-desantis-judge-gave-state-grounds-to-appeal-mask-mandate-ruling\/\"><span>told<\/span><\/a><span> reporters on Monday. \u201cAt the end of the day, ultimately, we\u2019re just trying to stand with the parents.\u201d<\/span><\/p>\n<p><span>A large part of the debate revolves around Florida\u2019s Parents Bill of Rights law. <\/span><\/p>\n<p><span>Cooper believes that the law doesn\u2019t extend to the issue of masking, while DeSantis argues that it does. DeSantis said that a similar case could be made if schools had banned anyone from wearing a mask instead of mandating that everyone wear one.&nbsp;<\/span><\/p>\n<p><span>\u201cI\u2019ll bet you you\u2019d have parents sue under the Parents\u2019 Bill of Rights, say, \u2018Hey, wait a minute, I think this is in the best interest of my child to go to school to wear \u2014 you know what, I think that they would win on that,\u201d he said <\/span><a href=\"https:\/\/floridapolitics.com\/archives\/453973-ron-desantis-judge-gave-state-grounds-to-appeal-mask-mandate-ruling\/\"><span>according<\/span><\/a><span> to Florida Politics.&nbsp;<\/span><\/p>\n<p><span>DeSantis\u2019s initial <\/span><a href=\"https:\/\/www.flgov.com\/wp-content\/uploads\/2021\/07\/Executive-Order-21-175.pdf\"><span>order<\/span><\/a><span> said that COVID-19 protocols in schools should \u201cnot violate Floridians constitutional freedoms\u201d or \u201cviolate parents\u2019 rights under Florida law to make healthcare decisions for their minor children.\u201d&nbsp;<\/span><\/p>\n<p><span>His appeal comes as it was recently announced that two Florida school boards had been withheld pay for mandating masking in their school districts.&nbsp;<\/span><\/p>\n<p><span>\u201cWe\u2019re going to fight to protect parent\u2019s rights to make health care decisions for their children. They know what is best for their children,\u201d <a href=\"https:\/\/www.fldoe.org\/newsroom\/latest-news\/commissioner-richard-corcoran-announces-the-withholding-of-funds-in-alachua-and-broward-counties-for-their-continued-violation-of-state-law.stml\">said<\/a> Richard Corcoran, Florida\u2019s Education Commissioner.&nbsp;\u201c<\/span><span>What\u2019s unacceptable is the politicians who have raised their right hands and pledged, under oath, to uphold the Constitution but are not doing so.
