(Drew Angerer\/Getty Images)<\/p>\n<\/div>\n<p>The ruling is an example of a shadow docket ruling, or a \u201cshort-circuit\u201d approach that the Supreme Court has taken for deciding an increasing number of time-sensitive and high-profile cases, <a href=\"https:\/\/www.reuters.com\/article\/legal-us-usa-court-shadow-video\/the-shadow-docket-how-the-u-s-supreme-court-quietly-dispatches-key-rulings-idUSKBN2BF16Q\">according<\/a> to Reuters. Legal experts have harshly criticized the use of the shadow docket, arguing it allows the court to quietly rule on major cases.<\/p>\n<p>\u201cIt\u2019s hard for the public to know what is going on, and it\u2019s hard for the public to trust that the court is doing its best work,\u201d conservative University of Chicago Law School professor William Baude told Reuters.<\/p>\n<p>The court recently blocked both the Biden administration\u2019s <a href=\"https:\/\/dailycaller.com\/2021\/08\/26\/supreme-court-brett-kavanaugh-joe-biden-cdc-eviction-moratorium\/\">eviction moratorium<\/a> and <a href=\"https:\/\/dailycaller.com\/2021\/08\/24\/supreme-court-rules-against-biden-administration-reinstates-remain-in-mexico-policy\/\">attempt to repeal<\/a> former President Donald Trump\u2019s \u201cremain in Mexico\u201d program via shadow docket rulings.<\/p>\n<p>While liberal media outlets reported that the Supreme Court <a href=\"https:\/\/slate.com\/news-and-politics\/2021\/09\/supreme-court-overturn-roe-wade-texas.html\">\u201ceffectively overturned\u201d<\/a> and <a href=\"https:\/\/twitter.com\/chrislhayes\/status\/1433278836364521477\">\u201cgutted\u201d<\/a> Roe v. Wade, the court merely allowed the law to be enforced pending further legal challenges.
