But the Supreme Court is not alone in refusing to rule on the stay; a lower federal court also refused to block the law because, unlike other \u201cheartbeat\u201d laws, the Texas measure authorizes civil \u2014 not criminal penalties.<\/p>\n<p data-paragraph-id=\"paragraph_01E38EE0-170E-20B2-D778-9FAF8C3A9878\" data-act-id=\"paragraph_0\">\u201cIn the novel legal strategy, the state Legislature designed the law to prevent government officials from directly enforcing it. The move was meant to make it much more difficult to bring a pre-enforcement challenge because there are not the usual government officials to hold accountable in court,\u201d CNN added. \u201cInstead, the law allows private citizens \u2014 anywhere in the country \u2014 to bring civil suits against anyone who assists a pregnant person seeking an abortion in violation of the ban.\u201d<\/p>\n<p data-paragraph-id=\"paragraph_01E38EE0-170E-20B2-D778-9FAF8C3A9878\" data-act-id=\"paragraph_0\">\u201cThe patient may not be sued, but doctors, staff members at clinics, counselors, people who help pay for the procedure, even an Uber driver taking a patient to an abortion clinic are all potential defendants,\u201d <a href=\"https:\/\/www.nytimes.com\/2021\/09\/01\/us\/supreme-court-texas-abortion.html\">the New York Times reported<\/a>. \u201cPlaintiffs, who need not have any connection to the matter or show any injury from it, are entitled to $10,000 and their legal fees recovered if they win. Prevailing defendants are not entitled to legal fees.\u201d<\/p>\n<p data-paragraph-id=\"paragraph_01E38EE0-170E-20B2-D778-9FAF8C3A9878\" data-act-id=\"paragraph_0\">Texas abortion providers tried a last-minute appeal to the Supreme Court when the federal court refused their application for an emergency stay, claiming that the law \u201cwould immediately and catastrophically reduce abortion access in Texas, barring care for at least 85 percent of Texas abortion patients (those who are six weeks pregnant or greater) and likely forcing many abortion clinics ultimately to close.\u201d<\/p>\n<p data-paragraph-id=\"paragraph_01E38EE0-170E-20B2-D778-9FAF8C3A9878\" data-act-id=\"paragraph_0\">But abortion providers, it appears, could not prove that they would immediately be the subject of lawsuits related to the law, thus the courts\u2019 refusal to rule on a stay.<\/p>\n<p data-paragraph-id=\"paragraph_01E38EE0-170E-20B2-D778-9FAF8C3A9878\" data-act-id=\"paragraph_0\">The Supreme Court will face its most significant abortion case in more than a decade in its next term: a challenge to a Mississippi law that bans abortions after 15 weeks. That law challenges the \u201cundue burden\u201d standard outlined in&nbsp;<em>Planned Parenthood v.
