Her claims were proven false and Holmes as well as former Theranos president Ramesh Balwani were charged with fraud.<\/p>\n<p>Trial documents released on Saturday and <a href=\"https:\/\/www.npr.org\/2021\/08\/28\/1031961327\/elizabeth-holmes-theranos-trial-boyfriend-balwani-emotional-sexual-abuse\">obtained<\/a> by NPR show that Holmes\u2019 defense team plans to claim that Balwani, who is also her ex-boyfriend, emotionally and sexually abused her, which she and her attorneys claim impaired her thinking at the time that she was defrauding patients and investors with Theranos.<\/p>\n<p>\u201cThis pattern of abuse and coercive control continued over the approximately decade-long duration of Ms. Holmes and Mr. Balwani\u2019s relationship, including during the period of the charged conspiracies,\u201d Holmes\u2019 attorneys wrote in one court filing.<\/p>\n<p>To bolster their claims, NPR reported, Holmes\u2019 attorneys plan to call Mindy Mechanic, a psychologist and expert in intimate partner abuse. Mechanic reportedly evaluated Holmes for 14 hours, but NPR noted that the psychologists report refers to research about abuse but has redacted specific information about her evaluation of Holmes.<\/p>\n<p>Holmes in court documents claims Balwani controlled how she ate, dressed, what she spent money on, and who she could speak to, and also monitored her phone calls, text messages, and emails. Holmes also claims he threw \u201chard, sharp objects at her\u201d and was physically abusive. Holmes now claims that Balwani restricted her sleep, monitored her movements, and allegedly claimed her success was thanks to him.<\/p>\n<p>In his own court filing, Balwani\u2019s attorneys call Holmes\u2019 allegations \u201csalacious and inflammatory,\u201d questioning the prosecution\u2019s claims that their cross-examination of Holmes\u2019 witnesses would \u201ccure any prejudice\u201d to the former Theranos president raised by Holmes\u2019 allegations.<\/p>\n<p>\u201cThe government cites no authority for the bizarre contention that a defendant benefits from being accused of sexual abuse in the middle of an unrelated fraud trial, and that he should rest assured that the government will have his back during cross-examination,\u201d Balwani\u2019s lawyers wrote.<\/p>\n<p>Holmes\u2019 allegations came up after discussions of whether she and Balwani should be tried separately or together for their alleged crimes. Holmes, according to court documents, intends to argue that because of Balwani\u2019s alleged abuse, she suffers from intimate partner abuse syndrome, post-traumatic stress disorder, and depression. She apparently intends to claim that Balwani\u2019s alleged abuse&nbsp; were the equivalent to \u201cdominating her and erasing her capacity to make decisions.\u201d This included her decisions that \u201cdeceive[d] her victims.\u201d<\/p>\n<p>Balwani\u2019s filing argues that he should be tried separately from Holmes, saying that Holme\u2019s abuse allegations \u201cwould <em>never<\/em> be admissible against\u201d him if he were tried alone. Balwani also says in his filing that the government is \u201cbaselessly\u201d accusing him of \u201corchestrating\u201d the abuse claims with Holmes in order to get the trials separated.<\/p>\n<p>Jury selection in the case begins Tuesday.
