Lauren Boebert and Florida Rep. Matt Gaetz were two of the eleven House Republicans <a href=\"https:\/\/dailycaller.com\/2021\/08\/30\/january-6-committee-capitol-riot-subpoenas-house-republicans\/\">named<\/a> by a CNN <a href=\"https:\/\/www.cnn.com\/2021\/08\/30\/politics\/january-6-phone-records-members-of-congress\/index.html\">report<\/a> as targets of records preservation requests sent by the Select Committee investigating the Jan. 6 Capitol riot. Records preservation requests are often sent to record-holders before the targeted information is subpoenaed.<\/p>\n<p>Federal law requires that telecommunications companies alert account holders if their accounts are subpoenaed. Under a legal provision known as the third-party <a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2013\/12\/what-you-need-to-know-about-the-third-party-doctrine\/282721\/\">doctrine<\/a>, telecommunications companies, not account holders, own account records. Therefore, the companies, not the account holders, receive the subpoenas. However, the account holders still must be notified before their communications records are subpoenaed. The absence of notifications suggests that the phone records of Boebert and Gaetz have not yet been subpoenaed.<\/p>\n<p>The other nine House Republicans named in the report are Georgia Reps. Marjorie Taylor Greene and Jody Hice, Ohio Rep. Jim Jordan, Arizona Reps. Andy Biggs and Paul Gosar, Alabama Rep. Mo Brooks, North Carolina Rep. Madison Cawthorn, Texas Rep. Louie Gohmert and Pennsylvania Rep. Scott Perry.<\/p>\n<p>All eleven Republicans objected to at least one state\u2019s Electoral College All eleven <a href=\"https:\/\/www.nytimes.com\/interactive\/2021\/01\/07\/us\/elections\/electoral-college-biden-objectors.html\">objected<\/a> to at least one state\u2019s Electoral College count and reportedly played a role in the \u201cStop the Steal\u201d rally. Brooks and Cawthorn <a href=\"https:\/\/www.politico.com\/news\/2021\/02\/10\/trump-impeachement-stop-the-steal-speakers-467554\">spoke<\/a> at the \u201cStop the Steal\u201d rally, which immediately preceded the riot.<\/p>\n<p>Jordan spoke with Trump on Jan. 6 \u201cmore than once,\u201d although he doesn\u2019t \u201crecall the times,\u201d he <a href=\"https:\/\/www.politico.com\/newsletters\/playbook\/2021\/08\/29\/about-jim-jordans-other-jan-6-call-with-trump-494169\">told<\/a> Politico on Sunday.<\/p>\n<p>Jordan did not immediately respond to the Daily Caller\u2019s request for comment.<\/p>\n<p>The Select Committee has already requested that the Archivist of the United States produce all Jan. 6 communications involving the White House and members of Congress and congressional staff. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/25\/jan-6-committee-donald-trump-doj-phone-records\/\">(RELATED: Jan. 6 Committee Requests Trump White House Communications With DOJ Officials, All Members Of Congress)<\/a><\/strong><\/p>\n<p>Republican Indiana Rep. This right includes the ability of the individuals to challenge the collection and release of their private telecommunications records <em>before <\/em>Congress obtains and publishes the subpoenaed documents,\u201d he wrote in a letter to Committee Chairman Bennie Thompson.<\/p>\n<p>Banks added in the letter that he was \u201csending a copy \u2026 to the Federal Communications Commission and to the General Counsels of AT&amp;T, T-Mobile, and Verizon, Twitter, and Facebook, to remind each of these companies of their legal obligation <em>not <\/em>to hand over individuals\u2019 private records unless the subject of the subpoena consents to the information being shared or the company has a court order to turn over the records.\u201d<\/p>\n<p>Banks also noted Democratic California Rep. Adam Schiff\u2019s <a href=\"https:\/\/dailycaller.com\/2019\/12\/04\/jim-banks-subpoena-adam-schiff-phone\/\">leak<\/a> of Republican California Rep. Devin Nunes\u2019 phone records during congressional Democrats\u2019 2019 impeachment inquiry into then-President Donald Trump. Schiff subpoenaed AT&amp;T for Nunes\u2019 records, and neither Schiff nor AT&amp;T <a href=\"https:\/\/www.wsj.com\/articles\/adam-schiff-is-watching-11575591692\">alerted<\/a> Nunes of the subpoena.<\/p>\n<p>\u201cThis is unprecedented. Never in the history of the House has the majority party abused its power to spy on the minority.
