They\u2019re seeking a court order blocking the requirement, which went into effect Monday and applies to indoor restaurants, gyms and entertainment venues.\u201d<\/p>\n<p class=\"p1\">In the <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=c0ffYA1x7v3t4aHEpac\/gA==\"><span class=\"s1\">lawsuit<\/span><\/a>, the business owners argue that the \u201cvaccine mandate is arbitrary and capricious due to the fact that it targets certain establishments but not others with no rationale whatsoever.\u201d<\/p>\n<p class=\"p1\">The Associated Press <a href=\"https:\/\/apnews.com\/article\/lifestyle-business-health-coronavirus-pandemic-restaurants-63344bc0fdf9b842cfd8a391a35fa087\"><span class=\"s1\">reported<\/span><\/a>, \u201cThe group of restauranteurs that filed the lawsuit in Richmond County, which encompasses Staten Island, said restaurants and other establishments included in the city\u2019s vaccine mandate were unfairly targeted because many other places such as grocery stores, hair salons, churches, schools and office buildings were excluded from the mandate.\u201d<\/p>\n<p class=\"p1\">\u201cAll Plaintiff-Petitioners are small business owners and entities who will be directly, severely, and irreparably harmed by [the executive order],\u201d the lawsuit stated.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The lawsuit also went on to say that it is an \u201cuncontested fact that unvaccinated and vaccinated individuals can both contract COVID-19 and the so-called \u2018Delta\u2019 variant, further illustrating the arbitrariness of this Executive Order.\u201d<\/p>\n<p class=\"p1\">It added, \u201cDespite this massive disparity and the minimal number of infections being caused, Mayor De Blasio is still mandating people be vaccinated and show proof of such to participate in everyday society.\u201d<\/p>\n<p class=\"p1\">The plaintiffs conceded that the \u201cgovernment is fully empowered to take emergency action against life-threatening dangers,\u201d however, they note, \u201cit is bedrock law in this country that constitutional rights and prohibitions do not change in an emergency.\u201d<\/p>\n<p class=\"p1\">They also argue that the mandate violates the ability of people to freely practice their religion. \u201cIt is against certain religious beliefs to inject a relatively unknown foreign substance into ones body. By mandating such a thing, the Mayor is essentially violating people\u2019s freedom of religion,\u201d the lawsuit stated.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">According to <a href=\"https:\/\/www.nytimes.com\/2021\/08\/18\/nyregion\/nyc-small-business-vaccine-mandate.html\"><span class=\"s1\">The New York Times<\/span><\/a>, de Blasio said on Wednesday that he was sure his order would be successful against the lawsuit.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cI\u2019ve had the conversation with the Law Department \u2014 tremendous confidence that we\u2019re in a very strong legal position,\u201d de Blasio <a href=\"https:\/\/www.nytimes.com\/2021\/08\/18\/nyregion\/nyc-small-business-vaccine-mandate.html\"><span class=\"s1\">said<\/span><\/a>. \u201cWe\u2019re in a global pandemic still. The decisions that have been taken with the leadership of our health officials who have been fighting this battle from the beginning.\u201d<\/p>\n<p class=\"p1\">When de Blasio announced the mandate, he said, \u201cIf you want to participate in our society fully, you\u2019ve got to get vaccinated,\u201d adding, \u201cIt\u2019s time.\u201d<\/p>\n<p class=\"p1\">As <a href=\"https:\/\/www.dailywire.com\/news\/nyc-restaurants-scrambling-to-prepare-to-keep-unvaccinated-out\">reported<\/a> by The Daily Wire, \u201cThe vaccination requirement, called the \u2018Key to NYC Pass\u2019 program, will be enforced for both customers and workers starting on September 13.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cThis is going to be a requirement,\u201d the mayor said. \u201cThe only way to patronize these establishments is if you are vaccinated, at least one dose.\u201d<\/p>\n<p class=\"p2\"><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
