CLARY\/AFP via Getty Images)<\/p>\n<\/div>\n<p>\u201cThis vaccine mandate is arbitrary and capricious due to the fact that it targets certain establishments but not others with no rational [sic] what so ever,\u201d the suit reads. \u201cVaccinations are now required for indoor dining, indoor fitness facilities, and indoor entertainment facilities. Both staff and public must show proof of at least one (1) dose of vaccination to be allowed to work in or enter such establishments.\u201d<\/p>\n<p>\u201cWhat makes these particular establishments so dangerous? Nothing.\u201d<\/p>\n<p>De Blasio <a href=\"https:\/\/dailycaller.com\/2021\/08\/03\/new-york-city-bill-de-blasio-vaccine-passport\/\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> in early August the city would require proof of vaccination at certain indoor businesses. The mandate, which took effect Tuesday, was the first of its kind in the U.S.<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2020\/09\/21\/new-york-city-survey-restaurants-bars-rent-coronavirus\/\" target=\"_blank\" rel=\"noopener noreferrer\">Restaurants<\/a> can only seat patrons indoors if they have proof of vaccination. But <a href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/ny-state-of-politics\/2020\/12\/11\/what-new-york-s-contact-tracing-data-show\" target=\"_blank\" rel=\"noopener noreferrer\">data<\/a> from December showed <a href=\"https:\/\/dailycaller.com\/2021\/01\/04\/restaurateurs-angry-indoor-dining-bans\/\" target=\"_blank\" rel=\"noopener noreferrer\">restaurants<\/a> and bars barely accounted for any transmission, with 1.43% of transmission stemming from exposure at either establishment.<\/p>\n<p>The new vaccine passport system will <a href=\"https:\/\/dailycaller.com\/2021\/08\/03\/bill-de-blasio-vaccine-mandate-new-york-passport\/\" target=\"_blank\" rel=\"noopener noreferrer\">disproportionately affect communities of color<\/a>, according to city data.
