Greg Abbott and Attorney General Ken Paxton.<\/p>\n<p>The <a href=\"https:\/\/www.txcourts.gov\/supreme\/orders-opinions\/2021\/august\/august-15-2021\/\" target=\"_blank\" rel=\"noopener noreferrer\">stay order<\/a> temporarily blocks the <a href=\"https:\/\/dailycaller.com\/2021\/08\/13\/texas-harris-county-lina-hidalgo-greg-abbott-mask-mandate-schools\/\" target=\"_blank\" rel=\"noopener noreferrer\">mask mandates<\/a> issued in Dallas and Bexar counties until the cases are set to be heard. However, Judge Clay Jenkins, who is fighting against Abbott\u2019s <a href=\"https:\/\/dailycaller.com\/2021\/07\/30\/texas-greg-abbott-centers-for-disease-control-and-prevention-mask-mandates\/\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a> banning mask mandates, said that the ruling \u201cdid not strike down my face mask order.\u201d<\/p>\n<p>\u201cI will amend my order to remove the possibility of fines on non-compliant businesses but otherwise leave the order in effect,\u201d Jenkins wrote Monday on Twitter.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.490740740741\">\n<p dir=\"ltr\" lang=\"en\">The Tex Supreme Court did not strike down my face mask order. Rather they removed the stay on the GA 38. Unless I receive a ruling requiring otherwise, I will amend my order to remove the possibility of fines on non-compliant businesses but otherwise leave the order in effect.<\/p>\n<p>\u2014 Clay Jenkins (@JudgeClayJ) <a href=\"https:\/\/twitter.com\/JudgeClayJ\/status\/1427100983369273349?ref_src=twsrc%5Etfw\">August 16, 2021<\/a><\/p>\n<\/blockquote>\n<p>Jenkins was granted a temporary restraining order (TRO) on Aug. 9 to protect the mask mandate in Dallas County, arguing that Abbott overstepped his authority when he banned mask mandates, according to <a href=\"https:\/\/www.nbcdfw.com\/news\/coronavirus\/judge-grants-temporary-restraining-order-against-abbotts-ban-on-mask-mandates\/2715560\/\" target=\"_blank\" rel=\"noopener noreferrer\">5NBC<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"9.5138888888889\">\n<p dir=\"ltr\" lang=\"en\">Earlier this evening I filed a Temporary Restraining Order and declaratory judgment in my official capacity as your Dallas County Judge against Governor Greg Abbott seeking to hold portions of GA 38 regarding mask mandates unenforceable\u2026 1\/<\/p>\n<p>\u2014 Clay Jenkins (@JudgeClayJ) <a href=\"https:\/\/twitter.com\/JudgeClayJ\/status\/1424880182477869056?ref_src=twsrc%5Etfw\">August 9, 2021<\/a><\/p>\n<\/blockquote>\n<p>A judge in Bexar County also granted a TRO, permitting both San Antonio and Bexar county authorities to institute mask mandates at public schools and government-owned facilities, according to 5NBC. The districts <a href=\"https:\/\/dailycaller.com\/2021\/08\/10\/dallas-austin-texas-school-masks-abbot-order\/\" target=\"_blank\" rel=\"noopener noreferrer\">implemented the mandates<\/a> citing concerns about rising COVID-19 cases and unvaccinated students. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/10\/biden-texas-florida-coronavirus-mask-mandate\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden Is \u2018Checking\u2019 If He Has Power To Override Republican Governors On COVID)<\/a><\/strong><\/p>\n<p>Paxton <a href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1426377191437312001?s=20\" target=\"_blank\" rel=\"noopener noreferrer\">vowed<\/a> to challenge the county orders but was struck down by the 5th Circuit Court of Appeals Friday, according to <a href=\"https:\/\/www.wfaa.com\/article\/news\/health\/coronavirus\/court-of-appeals-denies-gov-greg-abbotts-appeal-upholds-dallas-county-judge-clay-jenkins-mask-mandate-schools-businesses\/287-d56f48cf-d066-4f45-8475-acbc06604f73\" target=\"_blank\" rel=\"noopener noreferrer\">WFAA<\/a>.
