Sometimes those mistakes are egregious, sometimes they show the outlet\u2019s political bias, and sometimes they are just minor mistakes.<\/p>\n<p>Former attorney and liberal media darling Michael Avenatti tried to sue Fox News over one of the latter errors, a minor misstep when the outlet reported in 2018 that Avenatti had been arrested for alleged domestic violence.<\/p>\n<p>In his lawsuit against the news outlet, Avenatti said Fox reported he had been charged with a crime when he wasn\u2019t. For this, Avenatti sued for defamation. On Friday, the Delaware Third Circuit Court dismissed the complaint, The Daily Caller <a href=\"https:\/\/dailycaller.com\/2021\/08\/13\/michael-avenatti-libel-fox-news-judge-dismisses-suit\/\">reported<\/a>.<\/p>\n<p>\u201cNews outlets are not liable for minor mistakes, especially when reporting on public figures and matters of public concern,\u201d Judge Stphanos Bibas <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/egvbkknqbpq\/Avenatti%20v%20Fox%20News%208-13%20opinion.pdf\">wrote<\/a> in his dismissal of th case.. \u201cMichael Avenatti, a famous lawyer, was arrested on suspicion of domestic violence. Fox News covered his arrest.\u201d<\/p>\n<p>Bibas continued by saying \u201cmost\u201d of Fox\u2019s reporting on the incident was \u201csubstantially true\u201d and that \u201cAvenatti does not plausibly plead that Fox or its employees knew that the statements were false or recklessly disregarded that possibility.\u201d<\/p>\n<p>Further, Bibas wrote, Avenatti \u201cfails to allege any recoverable damages.\u201d<\/p>\n<p>Avenatti\u2019s big mistake in his libel suit, Bibas explained, was that he didn\u2019t simply request a correction before filing his lawsuit.<\/p>\n<p>\u201cAvenatti makes one final error. California law requires that a plaintiff who seeks \u2018damages for the publication of a libel in a daily or weekly news publications, or of a slander by radio broadcast\u2019 ask for a correction withint twenty days of his knowledge of the publication,\u201d Bibas wrote. \u201cAvenatti did not ask for a retraction.\u201d<\/p>\n<p>In that event, Avenatti would be limited to \u201cspecial damages,\u201d but he had to allege and prove those damages. Bibas wrote that Avenatti \u201chas not done this either\u201d and denied he even needed to do this.<\/p>\n<p>Bibas dismissed Avenatti\u2019s lawsuit \u201cwithout prejudice,\u201d meaning the disgraced attorney can amend his complaint and try to seek damages again, but it is unlikely to succeed based on the issues Bibas pointed out.<\/p>\n<p>Further, Avenatti is currently in prison after being sentenced to 30 months for attempting to extort Nike out of tens of millions of dollars. As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/breaking-michael-avenatti-sentenced-to-30-months-in-prison-after-reportedly-crying-in-court\">reported<\/a> last month, Avenatti cried in court before his sentencing as Judge Paul Gardephe of the Southern District of New York lectured the celebrity attorney about his conduct.<\/p>\n<p>\u201cMr. Avenatti\u2019s conduct was outrageous. He hijacked his client\u2019s claims, and he used those claims to further his own agenda \u2014 which was to extort millions of dollars from Nike to enrich himself,\u201d Gardephe reportedly said. \u201cMr. Avenatti had become drunk on the power of his platform, or what he perceived the power of his platform to be. He had become someone who operated as if the laws and rules that apply to everyone else didn\u2019t apply to him.\u201d<\/p>\n<p>The Nike case was not the only legal issue Avenatti is facing.
