Several members subsequently tested positive for COVID-19.<\/p>\n<p>Cruz said the issue had come before him during his tenure as the state\u2019s Solicitor General (2003 to 2008).<\/p>\n<p>PolitiFact agrees that the Texas state <a href=\"https:\/\/tlc.texas.gov\/docs\/legref\/TxConst.pdf\">constitution<\/a> declares, \u201cTwo-thirds of each House shall constitute a quorum to do business, but a smaller number may \u2026 compel the attendance of absent members, in such manner and under such penalties as each House may provide.\u201d (Article III, Sec. 10).<\/p>\n<p>The website also concedes that the rules of the state House of Representatives <a href=\"https:\/\/capitol.texas.gov\/tlodocs\/871\/billtext\/html\/HR00005I.htm\">say<\/a>, \u201cAll absentees for whom no sufficient excuse is made may, by order of a majority of those present, be sent for and arrested, wherever they may be found.\u201d (Rule 5, Sec. 8.)<\/p>\n<p>But PolitiFact <a href=\"https:\/\/www.politifact.com\/factchecks\/2021\/jul\/16\/ted-cruz\/laws-surrounding-arrests-texas-democrats-are-far-c\/\">rated<\/a> Cruz\u2019s statement \u201cFalse,\u201d because Cruz said the arrest power was \u201cclear,\u201d when his \u201cinterpretation of the constitution doesn\u2019t appear to be shared by all.\u201d<\/p>\n<p>PolitiFact did not explain when it began demanding absolute unanimity to take sides on political issues.<\/p>\n<p>\u201cThe reason why this&nbsp;question lacks&nbsp;clarity is because this hypothetical set of circumstances&nbsp;has no&nbsp;judicial&nbsp;precedent&nbsp;in Texas,\u201d PolitiFact added. \u201cThere has been no judicial interpretation of enforcement of&nbsp;Rule 5, Sec. 8&nbsp;of the&nbsp;House rulebook, and thus no existing authority on the&nbsp;matter&nbsp;in Texas.\u201d<\/p>\n<p>But the highest legal authority in the state has since settled the matter in favor of Cruz and against the website\u2019s tendentious review. On Tuesday, the Texas Supreme Court <a href=\"https:\/\/www.dailywire.com\/news\/texas-supreme-court-gov-abbott-can-order-arrest-of-runaway-democrats-if-they-fail-to-show-for-vote\">overturned<\/a> a lower court ruling temporarily preventing the state\u2019s Republican lawmakers from arresting the runaway Democrats and compelling them to fulfill their duties as elected officials. As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/breaking-texas-house-speaker-signs-52-arrest-warrants-for-absent-democrat-lawmakers\">reported<\/a>, on the same day, \u201cTexas House Speaker Dade Phelan (R) officially signed civil arrest warrants for 52 House Democrats who refused to show up for another special legislative session, thereby keeping the session from proceeding.\u201d<\/p>\n<p>On Thursday, the state\u2019s law enforcement officers were <a href=\"https:\/\/www.dailywire.com\/news\/texas-law-enforcement-deputized-ordered-to-arrest-rogue-democratic-lawmakers-immediately\">deputized<\/a> to execute those arrest warrants.<\/p>\n<p>Legal scholar Jonathan Turley <a href=\"https:\/\/twitter.com\/JonathanTurley\/status\/1425480270749253638\">said<\/a> the decision \u201chas not only exposed the Democrats to arrest but it has exposed another claim of bias against the PolitiFact.\u201d<\/p>\n<p>Senator Cruz agreed, <a href=\"https:\/\/twitter.com\/tedcruz\/status\/1425305149635977217\">tweeting<\/a>, \u201cYep. The Texas Supreme Court just agreed with me \u2014 unanimously. But, of course, PolitiFact still rules the claim \u2018false.\u2019 They have yet to issue a correction.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"11.625\">\n<p lang=\"en\" dir=\"ltr\">Yep. The Texas Supreme Court just agreed with me\u2014unanimously. <\/p>\n<p>But, of course, PolitiFact still rules the claim \u201cfalse.\u201d<\/p>\n<p>They have yet to issue a correction. <a href=\"https:\/\/t.co\/TavqAguOwl\">https:\/\/t.co\/TavqAguOwl<\/a><\/p>\n<p>\u2014 Ted Cruz (@tedcruz) <a href=\"https:\/\/twitter.com\/tedcruz\/status\/1425305149635977217?ref_src=twsrc%5Etfw\">August 11, 2021<\/a><\/p>\n<\/blockquote>\n<p>As of this writing, the PolitiFact article still calls Senator Cruz\u2019s since-vindicated analysis \u201cfalse.\u201d<\/p>\n<p>PolitiFact, which is now part of The Poynter Institute, has faced allegations of politically motivated fact-checking and special pleading on behalf of Democratic causes in the past. So many allegations piled up that in 2018, PolitiFact ran a&nbsp;<a href=\"https:\/\/www.politifact.com\/article\/2018\/nov\/06\/politifact-not-biased-heres-why\/\">story<\/a>&nbsp;titled \u201cPolitiFact is not biased \u2014 here\u2019s why.\u201d<\/p>\n<p>But Senator Cruz\u2019s office trusts the state supreme court \u2014 and his own exhaustive study of state and federal law \u2014 more than the website\u2019s verdict.<\/p>\n<p>\u201cPolitiFact exists to carry water for the Democrat Party, so they\u2019re not interested in the search for truth,\u201d Cruz\u2019s office <a href=\"https:\/\/www.foxnews.com\/media\/ted-cruz-still-waiting-for-politifact-correction-after-texas-supreme-court-agrees-with-him-on-fleeing-dems\">told<\/a> Fox News. \u201cThis is yet another example of Politifact getting it wrong in their shameless attempt to make excuses for Democrat lies, under the false pretense of confirming facts.\u201d<\/p>\n<p><em>The views expressed in this piece are the author\u2019s own and do not necessarily represent those of The Daily Wire<\/em>.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
