A Supreme Court majority had written that a previous version of the moratorium was legal, but that Congress would need to approve future moratoria.<\/p>\n<p>\u201cThe Court\u2019s hands are tied,\u201d Friedrich wrote in her decision. \u201cThe Supreme Court did not issue a controlling opinion in this case, and circuit precedent provides that the votes of dissenting Justices may not be combined with that of a concurring Justice to create binding law.\u201d<\/p>\n<p>Justice Brett Kavanaugh, writing for a 5-4 majority, <a href=\"https:\/\/dailycaller.com\/2021\/06\/29\/justice-kavanaugh-supreme-court-realtors-eviction-moratorium-cdc\/\">said<\/a> in June that the eviction moratorium could stay in place. While he hinted the federal government couldn\u2019t extend it by dictate, Friedrich said it was unclear which justices on the court agreed with his view and therefore she was unable to strike the moratorium down.<\/p>\n<p>Friedrich\u2019s ruling protects more than 12 million Americans who said they had little to no confidence in being able to make their next rent payment, <a href=\"https:\/\/www.census.gov\/data\/tables\/2021\/demo\/hhp\/hhp33.html\">according<\/a> to a recent Census Bureau survey.<\/p>\n<p>Last week, under the direction of President Joe Biden, the Centers for Disease Control and Prevention (CDC) <a href=\"https:\/\/www.cdc.gov\/media\/releases\/2021\/s0803-cdc-eviction-order.html\">extended<\/a> the moratorium until Oct. 3 after it had expired on July 31. The new directive was tailored to apply only to regions with \u201csubstantial and high levels\u201d of coronavirus transmission, or <a href=\"https:\/\/covid.cdc.gov\/covid-data-tracker\/#county-view\">roughly<\/a> 90% of all U.S. counties. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/05\/joe-biden-eviction-moratorium-cdc-washington-post\/\">(RELATED: \u2018Almost Certainly Illegal\u2019: Washington Post Editorial Board Slams Biden Eviction Moratorium)<\/a><\/strong><\/p>\n<p>The White House had originally <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/29\/statement-by-white-house-press-secretary-jen-psaki-on-biden-harris-administration-eviction-prevention-efforts\/\">asked<\/a> Congress to renew the moratorium via legislation citing Kavanaugh\u2019s brief. But the president ultimately succumbed to pressure from progressives who <a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/squad-cori-bush-camping-steps-capitol-hill-eviction-moratorium-nancy-pelosi\/\">argued<\/a> the suggested bill would never get Senate approval.<\/p>\n<p>The Alabama and Georgia chapters of the National Association of Realtors (NAR), which had previously <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.224305\/gov.uscourts.dcd.224305.1.0.pdf\">sued<\/a> the CDC over the moratorium, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.224305\/gov.uscourts.dcd.224305.67.0_1.pdf\">asked<\/a> Friedrich to immediately halt the extension last week and pointed to Kavanaugh\u2019s brief. Biden <a href=\"https:\/\/twitter.com\/PhilipWegmann\/status\/1423375358431223809\">told reporters<\/a> that while he couldn\u2019t guarantee the new moratorium would be upheld in court, he was confident the slow legal process would give Americans additional time to avoid eviction.<\/p>\n<p>\u201cIt is startling that the government is openly acknowledging its manipulation of the judicial process for the purpose of delay,\u201d the groups wrote in their Aug. 6 brief. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/05\/landlords-joe-biden-cdc-eviction-moratorium-lawsuit\/\">(RELATED: \u2018Not The Answer\u2019: Landlords Slam Biden\u2019s Eviction Moratorium Extension, Ask Federal Court To Intervene)<\/a><\/strong><\/p>\n<p>Landlords who rent property as a part-time, small operation have lost tens of thousands of dollars, <a href=\"https:\/\/www.washingtonpost.com\/business\/2021\/08\/10\/eviction-moratorium-landlords\/\">according<\/a> to <a href=\"https:\/\/www.wusa9.com\/article\/news\/local\/dc\/dc-landlords-eviction-moratorium-violent-tenants\/65-b79d5ec9-eb4d-403a-aca3-9bb7511a2a9f\">multiple<\/a> <a href=\"https:\/\/spectrumlocalnews.com\/nc\/charlotte\/news\/2021\/07\/29\/landlords-awaiting-eviction-moratorium-end\">media<\/a> <a href=\"https:\/\/www.foxnews.com\/media\/landlord-connecticut-34000-crazy-evictions-moratorium\">reports<\/a>. A New York City landlord, who rents rooms in her home, said tenants spit on and cursed at her and are delinquent on more than $23,000 in rental payments, The New York Times <a href=\"https:\/\/www.nytimes.com\/2021\/07\/09\/nyregion\/rent-landlord-eviction-moratorium.html\">reported<\/a>.<\/p>\n<p>\u201cAround half of all housing providers are mom-and-pop operations, and they also struggle,\u201d NAR spokesperson Patrick Newton <a href=\"https:\/\/dailycaller.com\/2021\/08\/05\/landlords-joe-biden-cdc-eviction-moratorium-lawsuit\/\">told<\/a> the Daily Caller News Foundation. \u201cWithout rental income, they cannot pay their own bills or maintain their properties.\u201d<\/p>\n<p>The National Apartment Association <a href=\"https:\/\/www.naahq.org\/news-publications\/naa-sues-federal-government-recover-industry%E2%80%99s-losses-under-nationwide-eviction\">filed a lawsuit<\/a> to recover damages caused by the eviction moratorium over the course of the pandemic. The organization alleged that U.S. landlords are owed roughly $57 billion in unpaid rent due to the moratorium.<\/p>\n<p>The eviction moratorium was first implemented by the Coronavirus Aid, Relief, and Economic Security Act in March 2020 , providing relief for about 25% of the 43.8 million rental units in the U.S. The CDC <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/communication\/Signed-CDC-Eviction-Order.pdf\">extended<\/a> the moratorium <a href=\"https:\/\/www.cdc.gov\/media\/releases\/2021\/s0624-eviction-moratorium.html\">multiple times<\/a> since September 2020 after the original expired.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
