class=\"ff-og-image-inserted\" \/><\/div>\n<p class=\"p1\">On Tuesday, a federal judge in Indiana ruled against several laws restricting abortion in the state, while upholding others as constitutional, continuing a legal battle over how far states can go to limit abortion.<\/p>\n<p class=\"p1\">The judge <a href=\"https:\/\/ecf.insd.uscourts.gov\/cgi-bin\/show_public_doc?12018cv1904-425\"><span class=\"s1\">ruled<\/span><\/a> that several abortion restrictions are unconstitutional, including a ban on telemedicine with regard to medication abortion, the requirement that a patient be examined in person before receiving medication abortion, and the requirement that provision of second-trimester abortions be restricted to hospitals or ambulatory surgical centers.&nbsp;The judge also found that certain facility requirements for clinics looking to perform abortions were unconstitutional.<\/p>\n<p class=\"p1\">In addition, several laws were found to be constitutional, including the ultrasound requirement, \u201cwhich requires an abortion provider to perform an ultrasound prior to an abortion and to show the ultrasound image to the patient.\u201d Some mandatory disclosures, certain requirements, and the Parental Consent Law, which typically requires that minors get parental consent or a judicial waiver in order to go through with an abortion, were also found to be constitutional.<\/p>\n<p class=\"p1\">As <a href=\"https:\/\/apnews.com\/article\/business-health-indiana-abortion-8da076d0877fbfa5b6385e0e7873859c\">reported<\/a> by the Associated Press, the judge also ruled against \u201cIndiana\u2019s mandated disclosure related to the beginning of life provides that, \u2018human physical life begins when a human ovum is fertilized by a human sperm.\u2019\u201d<\/p>\n<p class=\"p1\">The plaintiffs also objected to the requirement that patients must be told by abortion providers that \u201cobjective scientific information shows that a fetus can feel pain at or before twenty (20) weeks of postfertilization age.\u201d The judge held that this disclosure, as well as \u201cthe mental health risks of abortion contained in the [state\u2019s] Perinatal Hospice Brochure\u201d were unconstitutional.<\/p>\n<p class=\"p1\">The judge wrote, \u201cWe further hold that the Mandatory Disclosures regarding fetal pain, the beginning of life, and the mental health risks of abortion contained in the Perinatal Hospice Brochure violate <i>Casey\u2019s<\/i> truthful and non-misleading standard and thus are unconstitutional\u2026\u201d<\/p>\n<p class=\"p1\">Other disclosures were found to be constitutional, however, including the physical health risks of abortion contained in the Perinatal Hospice Brochure, as well as \u201cthe disclosures regarding the disposal of fetal tissue.\u201d<\/p>\n<p class=\"p1\">As National Review <a href=\"https:\/\/www.nationalreview.com\/corner\/judge-blocks-pro-life-laws-in-indiana-relying-on-testimony-from-abortion-activists\/\"><span class=\"s1\">pointed<\/span><\/a> out, most of the judge\u2019s decisions were made based on the testimony of several medical personnel or people who had personal experiences with abortion.<\/p>\n<p class=\"p1\">According to the <a href=\"https:\/\/www.indystar.com\/story\/news\/2021\/08\/12\/indiana-abortion-laws-whats-next-after-federal-judge-decision\/8097293002\/\">Indy Star<\/a>, Indiana Attorney General Todd Rokita appealed the judge\u2019s decision on Wednesday, sending it up to the U.S. Court of Appeals for the Seventh Circuit.<\/p>\n<p class=\"p1\">\u201cWe will continue to fight to defend Indiana\u2019s commonsense abortion laws and to build a culture of life in Indiana,\u201d Rokita <a href=\"https:\/\/apnews.com\/article\/business-health-indiana-abortion-8da076d0877fbfa5b6385e0e7873859c\"><span class=\"s1\">said<\/span><\/a> in a statement.<\/p>\n<p class=\"p1\">Pro-life organization Indiana Right to Life spoke out against the ruling as \u201cjudicial activism at its absolute worst.\u201d<\/p>\n<p class=\"p1\">\u201cThis is a horrific ruling that will directly lead to a massive expansion of chemical and late term abortions in Indiana,\u201d organization President Mike Fichter <a href=\"https:\/\/apnews.com\/article\/business-health-indiana-abortion-8da076d0877fbfa5b6385e0e7873859c\"><span class=\"s1\">said<\/span><\/a> in a statement. \u201cThe sweeping blockage of these common sense laws jeopardizes the health and safety of women, leaves women in the dark on issues of fetal pain and the development of human life.\u201d<\/p>\n<p class=\"p1\">Amy Hagstrom Miller, President and CEO of Whole Woman\u2019s Health Alliance, one of the plaintiffs in the case, said \u201cproviding abortion care in Indiana has not been easy\u201d and that the organization was \u201cgrateful to the courts for upholding the right to evidence-based abortion care by overturning these unjust and burdensome regulations.\u201d<\/p>\n<p class=\"p2\"><i>The Daily Wire is one of
