Scott Weiner said during a town hall. \u201cIn California we are moving the opposite direction, embracing our trans siblings, making it clear that trans people are fully part of this community, and that we love and honor them, and that we are gonna lift them up.\u201d<\/strong><\/li>\n<li><strong>As of July 26, 295 inmates who were formerly housed in a male institution have requested to be housed in a female institution, the CDCR told the Daily Caller News Foundation.<\/strong><\/li>\n<\/ul>\n<p>The state senator behind California\u2019s law allowing biological males in women\u2019s prisons defended the law Wednesday and criticized feminists who oppose it, saying, \u201cI\u2019m really proud of that law.\u201d<\/p>\n<p>\u201cIt\u2019s a really positive step forward,\u201d Democratic California state Sen. Scott Weiner said of SB 132 during a Wednesday town hall where he criticized <a href=\"https:\/\/dailycaller.com\/2021\/06\/09\/florida-ron-desantis-lgbtq\/\">legislation banning transgender surgeries<\/a> for children. \u201cIn California we are moving the opposite direction, embracing our trans siblings, making it clear that trans people are fully part of this community, and that we love and honor them, and that we are gonna lift them up.\u201d<\/p>\n<p>\u201cI\u2019m really proud of this law,\u201d he said, describing it as a \u201creally well-designed law.\u201d He did not immediately respond to a request for comment. <strong><a href=\"https:\/\/dailycaller.com\/2020\/09\/01\/california-legislature-sex-offender-registry\/\">(RELATED: California Legislature Softens Sex Offender Registry Requirements For Sodomy With Minors)<\/a><\/strong><\/p>\n<p><strong>WATCH:&nbsp;<\/strong><\/p>\n<p>\n<iframe loading=\"lazy\" title=\"Weiner Townhall Speaking  on SB132\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/jF_-9V563DQ?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/p>\n<p>Weiner, a gay politician who represents San Francisco, first introduced <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200SB132\">SB 132<\/a> in January 2019.<\/p>\n<p>\u201cIncarcerated transgender people deserve to be housed in facilities consistent with their gender identity,\u201d Weiner <a href=\"https:\/\/www.eqca.org\/release-senate-passes-sb-132\/\">said at the time<\/a>.&nbsp;\u201cWhen we house trans people based on their birth-assigned gender, we place them at high risk of sexual assault and violence. SB 132 will help ensure transgender individuals are treated with dignity and have their gender identity respected.\u201d<\/p>\n<p>The law, which was <a href=\"https:\/\/www.cdcr.ca.gov\/insidecdcr\/2020\/09\/29\/governor-newsom-signs-senate-bill-132-to-respect-gender-identity-during-incarceration\/\">signed<\/a> by Democratic California Gov. Gavin Newsom in September 2020 and went into effect on Jan. 1, requires the California Department of Corrections and Rehabilitation to ask prison inmates entering the department\u2019s custody to specify their pronouns, their gender identity, and whether they identify as transgender, nonbinary or intersex.<\/p>\n<p>SB 132 prevents CDCR from disciplining an individual who refuses to give gender information, allows for the information to be updated later on, and requires staff to use the gender pronouns that the individual requested.<\/p>\n<p>The law also requires that CDCR house the individual in a \u201ccorrectional facility designated for men or women based on the individual\u2019s preference.\u201d Similar legislation has been passed in <a href=\"https:\/\/www.prisonlegalnews.org\/news\/2019\/jan\/8\/connecticut-passes-law-protect-women-transgender-prisoners\/\">Connecticut<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.wbur.org\/news\/2019\/01\/26\/transgender-inmate-transferred-womens-prison\">Massachusetts<\/a>. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/12\/california-transgender-lgbtq-condoms-prison-gavin-newsom\/\">(RELATED: California Women\u2019s Prison Housing Trans Prisoners Halts Condom Distribution Without Explanation, Memo Shows)<\/a><\/strong><\/p>\n<p>As of July 26, 295 inmates who were formerly housed in a male institution had requested to be housed in a female institution, the CDCR told the Daily Caller News Foundation.<\/p>\n<p>The California state senator referenced the term \u201cTERF\u201d to describe feminists who oppose his law \u2014 a <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2020\/06\/09\/what-terf-definition-trans-activists-includes-j-k-rowling\/5326071002\/\" target=\"_blank\" rel=\"noopener noreferrer\">term<\/a> used to describe feminists such as \u201cHarry Potter\u201d author J.K. Rowling.<\/p>\n<p>\u201cUnfortunately there\u2019s been a right-wing backlash against this law and we have right-wing publications that are publishing a lot of just inaccurate information, frankly fake news, about this law and trying to demonize and scapegoat trans people,\u201d Weiner said, \u201cincluding, unfortunately, there\u2019s a term called \u2018TERF,\u2019 trans-exclusive radical feminist people who believe that trans women are not actually women and advocate in that way.\u201d<\/p>\n<p>Weiner called feminist criticisms of his bill \u201canti-transgender attacks\u201d and \u201cvery unfortunate.\u201d<\/p>\n<p>\u201cThese are the same arguments we heard in North Carolina restroom law, that trans women are just trying to scam their way into a women\u2019s restroom to victimize cisgender women,\u201d he said.<\/p>\n<p>Feminist organizations opposed to the law pushed back at Weiner\u2019s comments Thursday, accusing him of forgetting about the biological females incarcerated in California\u2019s prisons.<\/p>\n<p>\u201cThe terror, abuse, and cruelty incarcerated women are experiencing because of Scott Wiener\u2019s bill is not \u2018fake news,&#8217;\u201d said Woman II Woman founder Amie Ichikawa, who was formerly incarcerated in Central California Women\u2019s Facility (CCWF) in Chowchilla, California.<\/p>\n<p>\u201cI speak to these women every single day,\u201d she continued. \u201cThey are devastated. They don\u2019t understand how their elected officials, especially those who claim to care about justice reform and protecting women of color, could turn a blind eye to what is happening here.\u201d\u201d<\/p>\n<div readability=\"34\">\n<p dir=\"ltr\">Women\u2019s Liberation Front legal director Lauren Adams said that Weiner\u2019s \u201ccomplete disregard for the most vulnerable women in society\u201d is \u201cappalling,\u201d particularly&nbsp; \u201cfrom a so-called \u2018progressive\u2019 politician.\u201d<\/p>\n<p dir=\"ltr\">\u201cThere is a scared pregnant woman locked in a cage right now because Scott Wiener championed a men\u2019s rights bill that allows rapists to self-identify into women\u2019s prisons,\u201d Adams said. \u201cWhere is the concern for her rights or safety?\u201d<\/p>\n<p dir=\"ltr\">The DCNF has not independently confirmed cases of pregnancy due to transgender prisoners housed in female prisons, and CDCR Deputy Press Secretary Terry Thornton outright denied such reports, calling them \u201cinaccurate.\u201d The deputy press secretary said that there are pregnant inmates in CIW, but those inmates were reportedly pregnant before they arrived at the prison.<\/p>\n<p>Since SB 132 went into effect in January, seven biological males have been housed in CIW and 14 biological males have been housed in Central California Women\u2019s Facility (CCWF) in Chowchilla, California, CDCR data shows.<\/p>\n<p>CDCR data also shows that there have been zero incidents of inmate assault on another prisoner since January 2021 and six incidents of inmate battery on a prisoner.
