Gavin Newsom signed a law requiring that the CDCR house individuals in correctional facilities \u201cbased on the individual\u2019s preference.\u201d&nbsp;<\/strong><\/li>\n<\/ul>\n<p>A Southern California women\u2019s correctional facility housing transgender prisoners has stopped distributing condoms without explanation, documents obtained by the Daily Caller News Foundation show.<\/p>\n<p>Minutes from a July 9 Inmate Advisory Council of the California Institution for Women (CWI) reveal discussions between prison officials and inmates regarding body cameras worn by officers during strip searches of prisoners, housing arrangements, inmate pregnancies, wider shower curtains and condom distribution.<\/p>\n<p>According to documents obtained by the DCNF, Associate Warden Rob Kettle said during the meeting that the distribution of condoms within the prison had sparked \u201cgreat concern.\u201d The warden references \u201cthe current makeup\u201d of the population as a reason for formerly distributing condoms to the prisoners, but said that the prison had decided to halt condom distribution. <strong><a href=\"https:\/\/dailycaller.com\/2021\/04\/08\/california-transgender-prison-inmate-jessica-hann\/\">(RELATED: Two-Time Baby Killer Among Trans Prison Inmates Housed At CA Women\u2019s Facility)<\/a><\/strong><\/p>\n<p>The California Department of Corrections and Rehabilitation (CDCR) <a href=\"https:\/\/www.cdcr.ca.gov\/prea\/sb-132-faqs\/\">prohibits<\/a> and disciplines inmate sexual activity, but state correctional facilities are still obligated to offer condoms under <a href=\"https:\/\/gcc02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fcodes.findlaw.com%2Fca%2Fpenal-code%2Fpen-sect-6500.html&amp;data=04%7C01%7CVicky.Waters%40cdcr.ca.gov%7C617face8896642f9b72608d95ce3fcd5%7C0662477dfa0c4556a8f5c3bc62aa0d9c%7C0%7C0%7C637642956542312852%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=5Q33TIqkthrJdOKEvPaUVecvV68AdZrWaYHsOKlH5Qo%3D&amp;reserved=0\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/gcc02.safelinks.protection.outlook.com\/?url%3Dhttps%253A%252F%252Fcodes.findlaw.com%252Fca%252Fpenal-code%252Fpen-sect-6500.html%26data%3D04%257C01%257CVicky.Waters%2540cdcr.ca.gov%257C617face8896642f9b72608d95ce3fcd5%257C0662477dfa0c4556a8f5c3bc62aa0d9c%257C0%257C0%257C637642956542312852%257CUnknown%257CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%253D%257C1000%26sdata%3D5Q33TIqkthrJdOKEvPaUVecvV68AdZrWaYHsOKlH5Qo%253D%26reserved%3D0&amp;source=gmail&amp;ust=1628794028065000&amp;usg=AFQjCNEI_IoY1fB-be4M-1HqxGcP3kgLcw\">Penal Code 6500<\/a>, CDCR deputy press secretary Terry Thornton told the DCNF, noting that in female prisons, the condoms are intended for overnight family visits and are not necessarily available to the entire general population.<\/p>\n<p>\u201cAW Kettle stated that there has been great concern regarding the decision to provide condoms,\u201d the minutes obtained by the DCNF said. \u201cCondom dispensers were installed because the administration believed it was the right thing to do given the current makeup of the population. Gavin Newsom in January. \u201cThis move is particularly concerning in light of the reports of pregnancy and sexual assault already coming out of the prisons, and given the fact that several of the men reportedly have HIV.\u201d<\/p>\n<p>Multiple female prisoners have told WoLF that they have been assaulted by their transgender cellmates, Adams told the DCNF. The organization, which said it communicates with prisoners in CIW, <a href=\"https:\/\/twitter.com\/WomensLibFront\/status\/1419723052762468352?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1419723052762468352%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.lawofficer.com%2Ffemale-prison-inmate-pregnant-after-california-law-allows-biological-males-to-be-housed-with-women%2F\" target=\"_blank\" rel=\"noopener noreferrer\">has also said that<\/a> at least one woman has become pregnant after being housed with a biologically male cellmate.<\/p>\n<p>The DCNF has not independently confirmed cases of pregnancy due to transgender prisoners housed in female prisons.<\/p>\n<p>Thornton outright denied the reports, calling them \u201cinaccurate.\u201d The deputy press secretary said that there are pregnant inmates in CIW, but those inmates were reportedly pregnant before they arrived at the prison.<\/p>\n<p>Since Newsom signed SB 132 in January, seven biological males have been housed in CIW and 14 biological males have been housed in Central California Women\u2019s Facility (CCWF) in Chowchilla, California, CDCR data shows.<\/p>\n<p>CDCR data also shows that there have been zero incidents of inmate assaults on another prisoner since January 2021 and six incidents of inmate battery on a prisoner. Thornton told the DCNF that CDCR does not report whether individuals involved in the assaults were transgender.<\/p>\n<h3>California Putting Biological Males In Women\u2019s Prisons<\/h3>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200SB132\">SB 132<\/a>&nbsp;requires the CDCR to ask every individual entering the department\u2019s custody to specify their pronouns, their gender identity, and whether they identify as transgender, nonbinary or intersex.<\/p>\n<p>The law prevents CDCR from disciplining the individual if that individual refuses to give this information, allows for the information to be updated later on, and requires staff to use the gender pronouns that the individual requested.<\/p>\n<p>It also requires that CDCR house the individual in a \u201ccorrectional facility designated for men or women based on the individual\u2019s preference.\u201d Similar legislation has been passed in&nbsp;<a href=\"https:\/\/www.prisonlegalnews.org\/news\/2019\/jan\/8\/connecticut-passes-law-protect-women-transgender-prisoners\/\">Connecticut<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.wbur.org\/news\/2019\/01\/26\/transgender-inmate-transferred-womens-prison\">Massachusetts<\/a>.<\/p>\n<p>As of July 26, 295 inmates who were formerly housed in a male institution have requested to be housed in a female institution, the CDCR told the DCNF.<\/p>\n<p>The DCNF previously <a href=\"https:\/\/dailycaller.com\/2021\/04\/08\/california-transgender-prison-inmate-jessica-hann\/\">reported in April<\/a> that a biologically male twice-convicted baby killer was housed in a women\u2019s facility \u2014 with the mother of the prisoner\u2019s murdered children \u2014 as a result of California\u2019s policies.<\/p>\n<p>Forty-six-year-old&nbsp;<a href=\"https:\/\/inmatelocator.cdcr.ca.gov\/Details.aspx?ID=WB1125\">Jessica M. The couple was indicted by a grand jury in 2009, and attorneys <a href=\"https:\/\/www.desertsun.com\/story\/news\/crime_courts\/2014\/06\/27\/krissy-lynn-werntz-infant-killing-desert-hot-springs-arkansas\/11523145\/\">said<\/a> that Hann killed the children and Werntz hid the remains and brought them on travels throughout the country.<\/p>\n<h3>Biologically Female Prisoners Face Possible Pregnancy<\/h3>\n<p>During the July 9 meeting, prison officials said that biologically male prisoners (transgender females) will be \u201cclustered for their orientation period\u201d and then will be allowed to house with \u201csomeone they are compatible with.\u201d<\/p>\n<p>Associate Warden Kettle said during the July 9 meeting that \u201cno one will be forced to live with a transgender female\u201d and that there are many housing options as \u201cthe population is very low.\u201d<\/p>\n<p>Prison officials also discussed whether individuals would be disciplined for becoming pregnant.
