Abbott asked the DFPS to look into the topic last week.<\/p>\n<p>\u201cGenital mutilation of a child through reassignment surgery is child abuse, subject to all rules and procedures pertaining to child abuse. Such mutilation may cause a \u2018genuine threat of substantial harm from physical injury to the child\u2019 [according to Texas law],\u201d a Wednesday letter from DFPS Commissioner Jaime Masters says. \u201cThis surgical procedure physically alters a child\u2019s genitalia for non-medical purposes potentially inflicting irreversible harm to children\u2019s bodies. Generally, children in the care and custody of a parent lack the legal capacity to consent to surgical treatments, making them more vulnerable.\u201d<\/p>\n<p>Masters laid out narrow cases in which surgery on a child\u2019s genitalia may be medically necessary and not constitute abuse.<\/p>\n<p>\u201cIt may be warranted for the following conditions including, but not limited to, a child whose body parts have been affected by illness or trauma; who is born with a medically verifiable genetic disorder of sex development, such as the presence of both ovarian and testicular tissue; or who does not have the normal sex chromosome structure for male or female as determined through genetic testing,\u201d the letter says.<\/p>\n<p>Masters also notes that, under Texas law, professionals such as teachers, doctors, and daycare workers are required to report suspected cases of child abuse to the state \u201cwithin 48-hours after the professional first suspects the abuse.\u201d<\/p>\n<p>\u201cFailure to report is a Class A misdemeanor punishable by up to one year in jail, a fine of up to $4,000, or both,\u201d Masters writes. \u201cIf it is shown that the professional intentionally concealed the abuse, then the offense is a state jail felony.\u201d<\/p>\n<p>Abbott announced Masters\u2019 findings Wednesday, saying in a statement that \u201cthe determination and subsequent enforcement of Commissioner Masters\u2019 conclusions are effective immediately.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"10.058103975535\">\n<p lang=\"en\" dir=\"ltr\">&#8220;Genital mutilation of a child through reassignment surgery is child abuse\u2026&#8221; \u2013 Commissioner Jaime Masters, <a href=\"https:\/\/twitter.com\/TexasDFPS?ref_src=twsrc%5Etfw\">@TexasDFPS<\/a><\/p>\n<p>The determination and subsequent enforcement of Commissioner Masters&#8217; conclusions are effective immediately.<a href=\"https:\/\/t.co\/EVLp44zi41\">https:\/\/t.co\/EVLp44zi41<\/a> <a href=\"https:\/\/t.co\/HSTc9T9hQA\">pic.twitter.com\/HSTc9T9hQA<\/a><\/p>\n<p>\u2014 Greg Abbott (@GregAbbott_TX) <a href=\"https:\/\/twitter.com\/GregAbbott_TX\/status\/1425554618482892807?ref_src=twsrc%5Etfw\">August 11, 2021<\/a><\/p>\n<\/blockquote>\n<p>On Friday, Abbott requested the DFPS look into whether transgender surgery amounted to child abuse after a push to ban transgender surgery on children failed in the state legislature.<\/p>\n<p>\u201cSubjecting a child to genital mutilation through reassignment surgery creates a \u2018genuine threat of substantial harm from physical injury to the child,\u2019\u201d Abbott <a href=\"https:\/\/gov.texas.gov\/news\/post\/governor-abbott-directs-dfps-to-determine-if-genital-mutilation-through-reassignment-surgery-constitutes-child-abuse\">said<\/a> in the letter. \u201cThis broad definition of \u2018abuse\u2019 should cover a surgical procedure that will sterilize the child, such as orchiectomy or hysterectomy, or remove otherwise healthy body parts, such as penectomy or mastectomy. Indeed, Texas already outlaws female genital mutilation of a child, and presumably that also constitutes child abuse.\u201d<\/p>\n<p>Abbott\u2019s push to ban transgender surgery on children comes as similar efforts are underway across the U.S. In South Carolina, Democratic state Rep. Cezar McKnight <a href=\"https:\/\/www.dailywire.com\/news\/democrat-introduces-bill-to-ban-minors-from-getting-transgender-reassignment-surgery-treatments\">introduced<\/a> a bill in March to ban children from receiving transgender surgery or medication for transitioning.
