The principal, Sharyn Briscoe, told Posey that her child would be \u201cisolated\u201d in the desired classroom because it wasn\u2019t a \u201cblack class.\u201d&nbsp;<\/span><\/p>\n<p><span>\u201c[The principal] said, \u2018that\u2019s not one of the black classes.\u2019 And I immediately said, \u2018what does that mean?\u2019 I was confused,\u201d Posey told the local news outlet. \u201cI asked for more clarification. I was like, \u2018we have those in this school?\u2019 And she proceeded to say that yes, \u2018I have decided that I\u2019m going to place all of the black students in two classes.\u2019\u201d&nbsp;<\/span><\/p>\n<p><span>Posey claims that the elementary school created eight classes, two for black students, and six for white students.&nbsp;&nbsp;<\/span><\/p>\n<p><span>\u201cWe\u2019ve lost sleep trying to figure out, like, why would a person do this? First, it was just disbelief that I was having this conversation in 2020 with a person that looks just like me, a black woman,\u201d Posey said. \u201cIt\u2019s segregating classrooms. You cannot segregate classrooms. Her complaint argues that the school violated Title VI of the Civil Rights Act of 1964, which claims that \u201cno person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits, or be subjected to discrimination under any program or activity receiving Federal financial assistance.\u201d&nbsp;<\/span><\/p>\n<p><span>The fate of a discrimination complaint of this nature remains unclear, given that it was turned in to President Joe Biden\u2019s Department of Education.&nbsp;<\/span><\/p>\n<p><span>The Senate education committee has held hearings with Biden\u2019s nominee to lead the Office of Civil Rights, Catherine Lhamon. During her hearing, Lhamon <\/span><a href=\"https:\/\/www.dailywire.com\/news\/gop-urges-education-department-to-investigate-crt-complaints-biden-introduces-civil-rights-nominee-who-may-approve-of-crt\"><span>refused to answer<\/span><\/a><span> whether it would be \u201ca violation of Title VI to ascribe character traits, values, moral and ethical codes, privileges, status or beliefs to a race or to an individual solely because of his or her race.\u201d<\/span><\/p>\n<p><span>The Biden Education Department has similarly reversed course on a Trump-era ruling that found racially segregated \u201caffinity groups\u201d to be a form of segregation.
