The COVID-19 testing patent was filed in May 2020.<\/p>\n<p><strong><span>Fact Check:<\/span><\/strong><\/p>\n<p>The post includes a photo of what appears to be a patent application for \u201cSystem and Method for Testing for COVID-19.\u201d The patent\u2019s abstract reads, \u201cA method is provided for acquiring and transmitting biometric data (e.g., vital signs) of a user, where the data is analyzed to determine whether the user is suffering from a viral infection, such as COVID-19.\u201d Text accompanying the image reads, \u201chere is a patent from 2015\u2026\u2026\u2026.yes it was all planned.\u201d<\/p>\n<p>While the priority date of the patent is Oct. 13, 2015, the actual patent shown in the Facebook image is not from then. The priority date is the earliest date of a filing in a family of patent applications, not the date a specific patent was published, patent attorney Vic Lin wrote in the <a href=\"https:\/\/www.patenttrademarkblog.com\/priority-date\/\" target=\"_blank\" rel=\"noopener noreferrer\">Patent Trademark Blog<\/a>.<\/p>\n<p>\u201cIf an applicant has filed a number of related patent applications, the priority date would be the filing date of the earliest patent filing that first disclosed the invention,\u201d Lin wrote. <a href=\"https:\/\/checkyourfact.com\/2020\/07\/24\/fact-check-bill-gates-patent-face-mask-coronavirus\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Did Bill Gates Patent A \u2018CV19-N95\u2019 Face Mask Design Years Before The COVID-19 Pandemic)<\/a><\/p>\n<p>The <a href=\"https:\/\/patents.google.com\/patent\/US20200279585A1\/en\">patent<\/a> for \u201cSystem and Method for Testing COVID-19\u201d was filed May 17, 2020, and published on Sept. 3, 2020, according to the patent summary published in the <a href=\"https:\/\/pubchem.ncbi.nlm.nih.gov\/patent\/US-2020279585-A1\">National Library of Medicine<\/a>. The patent application on the U.S. Patent and Trademark Office\u2019s (USPTO) <a href=\"https:\/\/appft.uspto.gov\/netacgi\/nph-Parser?Sect1=PTO1&amp;Sect2=HITOFF&amp;p=1&amp;u=\/netahtml\/PTO\/srchnum.html&amp;r=1&amp;f=G&amp;l=50&amp;d=PG01&amp;s1=20200279585.PGNR.\" target=\"_blank\" rel=\"noopener noreferrer\">website<\/a> shows other related patent documents, with the earliest one being filed Oct. 13, 2015.<\/p>\n<p><a href=\"https:\/\/patentimages.storage.googleapis.com\/61\/a3\/0d\/3d91325d909386\/US20200279585A1.pdf\">The Related U.S. Application Data<\/a>&nbsp;section of the 2020 patent application suggests it is a&nbsp;<a href=\"https:\/\/www.uspto.gov\/web\/offices\/pac\/mpep\/s201.html\" target=\"_blank\" rel=\"noopener noreferrer\">continuation-in-part application<\/a>. This is a type of patent application that adds on to claims or inventions described in previous applications, according to <a href=\"https:\/\/www.uspto.gov\/web\/offices\/pac\/mpep\/s201.html\">USPTO<\/a>.<\/p>\n<p>Check Your Fact found that the related patent documents in the family that includes the \u201cSystem and Method for Testing COVID-19\u201d patent do not mention COVID-19. For example, one application was filed on <a href=\"https:\/\/patentimages.storage.googleapis.com\/e6\/08\/8c\/78c09472a64816\/US20170229149A1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">April 24, 2017<\/a>, and published in August 2017, and again in <a href=\"https:\/\/patentimages.storage.googleapis.com\/e0\/1d\/2c\/6c1946803dec29\/US10242713.pdf\">March 2019<\/a>.
