Gavin Newsom has allowed the release of a killer who served four decades in prison for the murder of a developmentally disabled California man who was buried alive, officials said Monday.\u201d According to the outlet, \u201cNewsom took no action last Friday on the state parole board\u2019s latest decision granting parole to David Weidert, his office said Monday, meaning that Weidert, 58, is now eligible for release.\u201d<\/p>\n<p>Weidert, an inmate at Soledad State Prison, was convicted of murdering 20-year-old Fresno-area resident Michael Morganti in 1980 to cover up a burglary. He was 17-year-old at the time. Former Democratic Gov. Jerry Brown twice denied his parole, and Newsom had previously blocked his release in 2020, saying last year that Weidert \u201ccurrently poses an unreasonable danger to society if released from prison at this time.\u201d<\/p>\n<p>However, as The Fresno Bee <a href=\"https:\/\/www.fresnobee.com\/news\/local\/article253379473.html\">reported<\/a>, \u201cNewsom this year accepted the finding of the Board of Parole Hearings, \u2018which determined that he does not pose a current unreasonable risk to public safety,\u2019 his office said Monday without elaborating.\u201d<\/p>\n<p>Vikki Van Duyne, Morganti\u2019s sister, said she had attended 11 parole hearings since the killing to oppose Weidert\u2019s release and was troubled by Newsom\u2019s decision.<\/p>\n<p>\u201cI didn\u2019t think the governor would think that things had changed in 13 months from the time when he said no last time, because I didn\u2019t see anything change,\u201d she told the AP.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"6.6122448979592\">\n<p lang=\"en\" dir=\"ltr\">Not the kind of headline <a href=\"https:\/\/twitter.com\/GavinNewsom?ref_src=twsrc%5Etfw\">@GavinNewsom<\/a> needs right now.. via <a href=\"https:\/\/twitter.com\/AP?ref_src=twsrc%5Etfw\">@AP<\/a>: &#8220;Parole allowed for man who buried California victim alive&#8221; <a href=\"https:\/\/t.co\/BuaDLuT6gM\">https:\/\/t.co\/BuaDLuT6gM<\/a><\/p>\n<p>\u2014 Carla Marinucci (@cmarinucci) <a href=\"https:\/\/twitter.com\/cmarinucci\/status\/1424871964691243026?ref_src=twsrc%5Etfw\">August 9, 2021<\/a><\/p>\n<\/blockquote>\n<p>More details from The Bee:<\/p>\n<blockquote readability=\"15\">\n<p><em>Weidert used Morganti to serve as a lookout to commit a $500 burglary, according to prosecutors.<\/em><\/p>\n<p><em>Morganti later spoke with law enforcement, and Weidert silenced him by luring him into a car and taking him to an isolated location to kill him. Morganti was beaten with a baseball bat and a shovel, stabbed with a knife, and forced to dig his own grave before being buried alive, prosecutors have said.<\/em><\/p>\n<\/blockquote>\n<p>After Morganti was buried, he eventually suffocated.<\/p>\n<p>Weidert\u2019s attorney, Charles Carbone, said his client \u201cunderstands the gravity of his crime\u201d and \u201chas always emphasized his remorse and his acceptance of responsibility.\u201d<\/p>\n<p>The AP reviewed a transcript from the parole hearing. It reported, \u201cParole commissioners balanced Weidert\u2019s youthful immaturity and lack of criminal record at the time and decades of good behavior in prison against what they called \u2018an incredibly gruesome, violent, horrific murder\u2019 in deciding he is no longer a risk.\u201d<\/p>\n<p>Some of Newsom\u2019s Republican opponents in the upcoming recall election blasted the governor for failing to intervene.<\/p>\n<p>GOP businessman John Cox, who lost big to Newsom in the 2018 gubernatorial election, condemned the governor on social media, saying Weidert \u201cshould never see the light of day again.\u201d<\/p>\n<p>\u201cWhat Gavin Newsom has done sickens me,\u201d Cox said in a <a href=\"https:\/\/twitter.com\/BeastJohnCox\/status\/1424872343076171781\">statement<\/a> posted to Twitter on Monday afternoon. \u201cGavin Newsom has no respect for public safety. His actions allowing this killer to go free are disgusting. We must recall Newsom from office.\u201d<\/p>\n<p>Another Republican contender to oust Newsom, former San Diego mayor Kevin Faulconer, <a href=\"https:\/\/twitter.com\/Kevin_Faulconer\/status\/1424883807262416896\">tweeted<\/a>, \u201cConvicted killers belong in prison, no on our streets.\u201d<\/p>\n<p>\u201cNo one who beat, stabbed and then buried a person alive should be allowed to go free,\u201d Faulconer continued. \u201c@GavinNewsom let this happen.
