This is now the second federal court to block the mandate. The Biden Admin appealed the other decision (also a <a href=\"https:\/\/twitter.com\/BECKETlaw?ref_src=twsrc%5Etfw\">@BECKETlaw<\/a> case) to the 8th Circuit: <a href=\"https:\/\/t.co\/CffRjRFZO4\">https:\/\/t.co\/CffRjRFZO4<\/a> 5\/<\/p>\n<p>\u2014 Luke Goodrich (@LukeWGoodrich) <a href=\"https:\/\/twitter.com\/LukeWGoodrich\/status\/1424835731827068929?ref_src=twsrc%5Etfw\">August 9, 2021<\/a> <\/p>\n<\/blockquote>\n<p>Former President Barack Obama\u2019s administration&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2016-05-18\/pdf\/2016-11458.pdf\">issued a mandate in 2016<\/a>&nbsp;requiring doctors and hospitals to provide transgender surgeries upon a mental health professional\u2019s referral. The transgender mandate, an interpretation of an Affordable Care Act\u2019s nondiscrimination clause, did not include conscience or religion exemptions.<\/p>\n<p>An association of over 19,000 healthcare professionals, several religious organizations and nine states challenged the mandate in two different courts, <a href=\"http:\/\/www.transgendermandate.org\/#home\">according to a website on the mandate<\/a> run by Becket.<\/p>\n<p><a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/Final-Judgment-Sisters-of-Mercy.pdf\">A North Dakota Eastern Division<\/a> court struck down the mandate in 2021 and <a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/Franciscan-Summary-Judgment-Order.pdf\">Judge O\u2019Connor of the Wichita, Texas court<\/a>&nbsp;struck down the mandate in 2019, ruling that the government \u201ccannot force religious doctors and hospitals to perform gender transition procedures in violation of their conscience and professional medical judgment,\u201d according to Becket.<\/p>\n<p>The Biden administration <a href=\"https:\/\/dailycaller.com\/2021\/04\/21\/biden-appeals-trans-mandate-religious-objections\/\">appealed<\/a> the more recent North Dakota ruling in April, court filings showed, pitting Becerra against the religious Sisters of Mercy and the Catholic Benefits Association, and marking the second time Becerra has been involved in legal action against nuns.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
