CDC Director Rochelle Walensky said <a href=\"https:\/\/www.cdc.gov\/media\/releases\/2021\/s0803-cdc-eviction-order.html\">in a statement<\/a> the decision was the \u201cright thing to do to keep people in their homes.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"13.251908396947\">\n<p dir=\"ltr\" lang=\"en\">The new extension will be targeted (as first reported by NYT and WaPo)<\/p>\n<p>The moratorium will focus on counties with surging coronavirus cases, I\u2019m told.<\/p>\n<p>This impacts 80 percent of counties, 90% of the population.<\/p>\n<p>\u2014 Heather Caygle (@heatherscope) <a href=\"https:\/\/twitter.com\/heatherscope\/status\/1422654561962057738?ref_src=twsrc%5Etfw\">August 3, 2021<\/a><\/p>\n<\/blockquote>\n<p>The Supreme Court <a href=\"http:\/\/cdn.cnn.com\/cnn\/2021\/images\/06\/29\/cdc.pdf\">declined to weigh in<\/a> on the constitutionality of the moratorium or immediately strike down the CDC order in a ruling on the matter in late June, giving the federal government <a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/treasury-department-emergency-rent-assistance-patrick-mchenry\/\">more time to hand out<\/a> emergency rental assistance funds.<\/p>\n<p>Justice Brett Kavanaugh, however, wrote a <a href=\"https:\/\/dailycaller.com\/2021\/06\/29\/justice-kavanaugh-supreme-court-realtors-eviction-moratorium-cdc\/\">concurring opinion<\/a> stating that a further extension of the moratorium would need congressional approval. President Joe Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/29\/statement-by-white-house-press-secretary-jen-psaki-on-biden-harris-administration-eviction-prevention-efforts\/\">urged<\/a> Congress days before the restrictions were set to expire to pass legislation extending the moratorium.<\/p>\n<p>The president ultimately went forward with an extension following <a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/nancy-pelosi-house-democrats-eviction-moratorium-supreme-court-joe-biden-white-house\/\">repeated demands<\/a> from House Speaker Nancy Pelosi and left-wing Democratic lawmakers, who <a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/squad-cori-bush-camping-steps-capitol-hill-eviction-moratorium-nancy-pelosi\/\">staged a protest<\/a> outside the U.S. Capitol for several days. Democrats argued they didn\u2019t have enough votes in the Senate to pass legislation to extend the moratorium. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/05\/joe-biden-eviction-moratorium-cdc-washington-post\/\">(RELATED: \u2018Almost Certainly Illegal\u2019: Washington Post Editorial Board Slams Biden Eviction Moratorium)<\/a><\/strong><\/p>\n<p>Some legal experts told the Daily Caller the CDC order extending the moratorium may not be constitutional and would be challenged in court.<\/p>\n<p>\u201cThe new moratorium is likely unlawful. We don\u2019t need to reach any of the potential constitutional issues because it lacks statutory authorization,\u201d Case Western Reserve University law professor Jonathan Adler told the Caller. \u201cThis will almost certainly be challenged in court, and I expect any such challenge to be successful.\u201d<\/p>\n<p>University of Richmond law professor Carl Tobias concurred that \u201cthe recent action is likely to be challenged in court, and the courts will need some time to resolve the challenge.\u201d But he also told the Caller the CDC\u2019s targeted approach to only barring evictions in places with \u201csubstantial and high\u201d COVID-19 transmission \u201cmay be constitutional.\u201d<\/p>\n<p>Some legal experts more strongly believe the extension is constitutional. University of California, Los Angeles law professor Adam Winkler wrote Thursday in a <a href=\"https:\/\/www.nytimes.com\/2021\/08\/05\/opinion\/supreme-court-biden-eviction.html\">New York Times op-ed<\/a> that the Biden administration had \u201cvalid reasons\u201d to extend the moratorium, adding that Congress has given the CDC authority to make and enforce regulations \u201cnecessary to prevent the spread of diseases.\u201d<\/p>\n<p>\u201cBy law, the CDC has a broad mandate designed for situations like a pandemic, in which public health authorities need to respond quickly to protect human health,\u201d he wrote. \u201cThat is exactly what the eviction moratoriums have done.\u201d<\/p>\n<p>Brianne Gorod, chief counsel at the left-leaning Constitutional Accountability Center, also urged against giving too much consideration to Kavanugh\u2019s opinion in the Supreme Court case that indicated only Congress can extend the moratorium.<\/p>\n<p>Courts will \u201cconsider how the spread of the delta variant and its significant transmissibility make clear the need for this more targeted moratorium,\u201d Gorod said, <a href=\"https:\/\/apnews.com\/article\/joe-biden-health-coronavirus-pandemic-us-supreme-court-547f37b554555709ae9f3edc518f10a6\">according<\/a> to The Associated Press.<\/p>\n<p>Biden had <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/08\/03\/remarks-by-president-biden-on-fighting-the-covid-19-pandemic\/\">acknowledged in remarks<\/a> earlier Tuesday that the move was likely constitutional given the Supreme Court\u2019s decision. He <a href=\"https:\/\/latimesblogs.latimes.com\/washington\/2010\/10\/transcript-of-president-barack-obama-with-univision.html\">said<\/a> in 2010, \u201cI am not king. I can\u2019t do these things just by myself.\u201d He <a href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2011\/05\/10\/remarks-president-comprehensive-immigration-reform-el-paso-texas\">admitted the following year<\/a> he doesn\u2019t have the power to \u201cjust bypass Congress and change the law myself,\u201d adding \u201cthat\u2019s not how a democracy works.\u201d<\/p>\n<p>Obama\u2019s Homeland Security Department still enacted the DACA program through an <a href=\"https:\/\/www.dhs.gov\/xlibrary\/assets\/s1-exercising-prosecutorial-discretion-individuals-who-came-to-us-as-children.pdf\">executive memorandum<\/a> in June 2012, providing amnesty to around 800,000 illegal immigrants who came to the U.S. as minors. But when the administration tried to <a href=\"https:\/\/www.dhs.gov\/taxonomy\/term\/3612\/all\/feed\">expand the program<\/a> to include millions of additional illegal immigrants in November 2014, a coalition of states sued.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.oyez.org\/cases\/2015\/15-674\">upheld<\/a> a lower court\u2019s injunction blocking the expansion in June 2016, but later <a href=\"https:\/\/dailycaller.com\/2020\/06\/18\/supreme-court-trump-admin-roberts-daca\/\">ruled against<\/a> former President Donald Trump\u2019s attempt at repealing DACA in a June 2020 decision.<\/p>\n<p>Both Obama and Biden used executive action despite admitting it may not be unconstitutional.
