there has already been a lawsuit filed against the CDC\u2019s extension on the eviction moratorium and the complainants are seeking a preliminary injunction on the order, given that there is the significant possibility of damages for landlords under the more targeted, but harsher, measure.<\/p>\n<p>Speaking to the press Friday, however, Biden indicated that he was unsure of the Constitutionality of the move, despite consulting with left-leaning Constitutional law professor, Laurence Tribe, particularly in light of comments made by the Supreme Court when the moratorium was first challenged, noting that the legislature \u2014 not the CDC \u2014 should issue the rule.<\/p>\n<p>\u201cAsked by reporters at the White House if he believes the moratorium is constitutional, Biden replied, \u2018I think it is,\u2019 though he added that he \u2018can\u2019t guarantee\u201d the Supreme Court won\u2019t strike it down,&#8217;\u201d Forbes reported Friday.<\/p>\n<p>The consensus of scholars, Biden said, was, \u201c\u2018We think you have the authority\u2026 but, in this court, who knows?\u2019\u201d<\/p>\n<p>Biden was, apparently, referring to the current \u201csplit\u201d in the Court, with conservatives making a majority of the Court\u2019s nine votes.<\/p>\n<p>\u201cWhen announcing the new moratorium on Tuesday, Biden said the \u2018bulk\u2019 of scholars believe it is \u2018not likely to pass constitutional muster,\u2019 but that several \u2018key scholars\u2019 think it might, and is \u2018worth the effort,&#8217;\u201d Forbes noted.<\/p>\n<p>The White House reportedly consulted Laurence Tribe, <a href=\"https:\/\/www.washingtonpost.com\/us-policy\/2021\/08\/05\/white-house-eviction-moratorium\/\">according to the Washington Post<\/a>, but Tribe is an outspoken left-leaning Constitutional scholar, and his view is unlikely to represent that of the majority of Supreme Court Justices.<\/p>\n<p>Biden also told reporters that, even if the moratorium ends up being unconstitutional, a lengthy appeals process could \u201ckeep this going for a while,\u201d even though courts hearing cases on the moratorium would likely stay its imposition until any potential damages resulting from the moratorium could be examined, lest a landlord or someone else run afoul of the law and end up owing money on a measure that might eventually be found lacking.<\/p>\n<p>\u201cI can\u2019t guarantee you the court won\u2019t rule that we don\u2019t have that authority but at least we\u2019ll have the ability to if we have to appeal, to keep this going for a month at least. I hope longer,\u201d Biden said.<\/p>\n<p>Attorneys on Twitter also pointed out that Biden\u2019s comments Friday could give complainants evidence that the White House is actually \u201cabus[ing] the process\u201d with appeals, trying to extend the moratorium in an extrajudicial way.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"7.0059880239521\">\n<p lang=\"en\" dir=\"ltr\">Someone very badly needs to tell Biden that abuse of process is a thing the courts do not like. <a href=\"https:\/\/t.co\/FAzrxNzL1A\">https:\/\/t.co\/FAzrxNzL1A<\/a><\/p>\n<p>\u2014 Gabriel Malor (@gabrielmalor) <a href=\"https:\/\/twitter.com\/gabrielmalor\/status\/1423382768189378562?ref_src=twsrc%5Etfw\">August 5, 2021<\/a><\/p>\n<\/blockquote>\n<p>The DOJ has argued, in response to a motion seeking to stay the moratorium, that the Supreme Court has not spoken definitively on the issue.<\/p>\n<p>Democratic strategist Brian Fallon, speaking to Politico, suggested that it\u2019s possible Biden and allies are simply trying to deflect blame for when the moratorium eventually falls, similar to the way that the White House demanded Congress move quickly to address the issue before working with the CDC.<\/p>\n<p>\u201cI hope that progressives will put as much attention on the inevitable Supreme Court ruling swatting this down as they did on Biden the last few days,\u201d Fallon said. \u201cI hope that all the energy and compassion for people who stand to suffer if the moratorium was not continued will remain when the Supreme Court becomes the villain instead of Joe Biden.\u201d<\/p>\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
