The <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/communication\/Signed-CDC-Eviction-Order.pdf\">moratorium<\/a>, which was first implemented last year, prohibits landlords from evicting low-income tenants who cannot afford rent payments.<\/p>\n<p>\u201cThe administration also may succeed in giving many Americans a short reprieve from eviction,\u201d the Post said. \u201cBut perhaps not as long as advertised \u2014 because courts may strike it down before October \u2014 and at the expense of the rule of law.\u201d<strong> <a href=\"https:\/\/dailycaller.com\/2021\/08\/04\/biden-eviction-moratorium-cdc-legal-psaki\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden \u2018Confident\u2019 Eviction Moratorium Is Legal, Days After Saying It Wasn\u2019t)<\/a><\/strong><\/p>\n<p>In June, the Supreme Court said that further extensions of the <a href=\"https:\/\/dailycaller.com\/2021\/08\/03\/biden-yellen-housing-restrictions-moratorium-eviction-pelosi\/\">eviction moratorium<\/a> would need congressional approval. The high court declined to immediately strike down the CDC order, giving the federal government time to give out <a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/treasury-department-emergency-rent-assistance-patrick-mchenry\/\" target=\"_blank\" rel=\"noopener noreferrer\">emergency rental assistance<\/a> funds.<\/p>\n<p>Prior to the moratorium\u2019s scheduled July 31 expiration, the White House <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/29\/statement-by-white-house-press-secretary-jen-psaki-on-biden-harris-administration-eviction-prevention-efforts\/\">signaled<\/a> Congress should extend the moratorium in accordance with the Supreme Court ruling. (Stefani Reynolds\/Pool\/Getty Images)<\/p>\n<\/div>\n<p>Justice Brett Kavanaugh <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20a169_4f15.pdf\">wrote<\/a> that \u201cclear and specific congressional authorization (via new legislation) would be necessary for the CDC to extend the moratorium\u201d in a brief explaining his vote regarding the <a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/squad-cori-bush-camping-steps-capitol-hill-eviction-moratorium-nancy-pelosi\/\">moratorium<\/a>.
