Instead of prohibiting evictions, the organizations all argued in favor of giving <a href=\"https:\/\/home.treasury.gov\/policy-issues\/coronavirus\/assistance-for-state-local-and-tribal-governments\/emergency-rental-assistance-program\" target=\"_blank\" rel=\"noopener noreferrer\">rental assistance<\/a> directly to landlords with delinquent tenants.<\/p>\n<p>\u201cAround half of all housing providers are mom-and-pop operations, and they also struggle,\u201d NAR spokesperson Patrick Newton told the Daily Caller News Foundation. \u201cWithout rental income, they cannot pay their own bills or maintain their properties.\u201d<\/p>\n<p>\u201cNAR has always advocated the best solution for all parties was rental assistance paid directly to housing providers to cover the rent and utilities of any vulnerable tenants during the pandemic,\u201d he added. \u201cNo housing provider wants to evict a tenant and considers it only as a last resort.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/07\/29\/evicition-moratorium-joe-biden-administration-patrick-mchenry\/\">(RELATED: \u2018A Full-Scale Failure\u2019: Rep. Patrick McHenry Rips Biden For Requesting Eviction Moratorium Extension)<\/a><\/strong><\/p>\n<p>On Tuesday, the Centers for Disease Control and Prevention (CDC) <a href=\"https:\/\/www.cdc.gov\/media\/releases\/2021\/s0803-cdc-eviction-order.html\">extended<\/a> the eviction moratorium, which had expired Saturday, for regions with \u201csubstantial and high\u201d coronavirus transmission until early October. (Greg Nash\/Pool\/AFP via Getty Images)<\/p>\n<\/div>\n<p>The GAR, which has already <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20A169\/180893\/20210603170556355_SCOTUS%20Application%20to%20Vacate%20Stay%20-%20Appendix%20-%20Lower%20Court%20Orders%20and%20Opinions.pdf\">sued<\/a> the federal government over the original moratorium, told the DCNF that like the NAR it was assessing all legal avenues regarding the new CDC order. Late Wednesday, the GAR and Alabama Association of Realtors <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.224305\/gov.uscourts.dcd.224305.67.0_1.pdf\">asked<\/a> a federal district court to immediately block the new moratorium.<\/p>\n<p>\u201cBy and large, housing providers do not want to evict tenants,\u201d GAR President Dorrie Love said. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/squad-cori-bush-camping-steps-capitol-hill-eviction-moratorium-nancy-pelosi\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Here\u2019s Why \u2018The Squad\u2019 Is Camping Out On The Steps Of Capitol Hill)<\/a><\/strong><\/p>\n<p>In June, Supreme Court Justice Brett Kavanaugh <a href=\"https:\/\/dailycaller.com\/2021\/06\/29\/justice-kavanaugh-supreme-court-realtors-eviction-moratorium-cdc\/\">wrote<\/a> a brief opinion in favor of the GAR and other plaintiffs, saying that further extensions would need to be congressionally approved. Days before the moratorium was set to expire last week, President Joe Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/29\/statement-by-white-house-press-secretary-jen-psaki-on-biden-harris-administration-eviction-prevention-efforts\/\">urged<\/a> Congress to pass legislation extending the moratorium.<\/p>\n<p>The president ultimately pushed for an extension after <a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/nancy-pelosi-house-democrats-eviction-moratorium-supreme-court-joe-biden-white-house\/\">repeated<\/a> <a href=\"https:\/\/www.speaker.gov\/newsroom\/8321-1\">demands<\/a> from House Speaker Nancy Pelosi and progressive Democratic lawmakers who <a href=\"https:\/\/bush.house.gov\/media\/press-releases\/congresswoman-cori-bushs-statement-eviction-emergency\">staged<\/a> a <a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/squad-cori-bush-camping-steps-capitol-hill-eviction-moratorium-nancy-pelosi\/\">multi-day protest<\/a> outside the Capitol. The Democrats argued they wouldn\u2019t be able to garner enough votes in the Senate to pass such legislation.<\/p>\n<p>Before his administration\u2019s CDC officially extended the moratorium, Biden acknowledged the move was likely unconstitutional given the Supreme Court\u2019s decision.<\/p>\n<p>\u201cThe bulk of the constitutional scholarship says that it\u2019s not likely to pass constitutional muster,\u201d Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/08\/03\/remarks-by-president-biden-on-fighting-the-covid-19-pandemic\/\">told<\/a> reporters. \u201cBut there are several key scholars who think that it may and it\u2019s worth the effort.\u201d<\/p>\n<p>White House Press Secretary Jen Psaki said the president wouldn\u2019t have moved forward with the renewed moratorium if he \u201cdidn\u2019t feel comfortable and confident in the legal justification\u201d <a href=\"https:\/\/youtu.be\/v7uH3Cf0Wqs\">during<\/a> a press briefing Wednesday.<\/p>\n<p>Harvard Law professor Laurence Tribe was among the few experts who recommended an extension, <a href=\"https:\/\/email.punchbowl.news\/t\/ViewEmail\/t\/BE17D14FA3FF76962540EF23F30FEDED\/D74CD757A938F41F16B21F2806CB3AEB\">according<\/a> to a Capitol Hill insider newsletter. (Kevin Dietsch\/Getty Images)<\/p>\n<\/div>\n<p>\u201cEviction moratoriums are not the answer,\u201d NAA spokesperson Nicole Ryan told the DCNF. \u201cThey are not a sustainable long term solution and what we\u2019re seeing now is the Biden administration and Congress essentially kicking the can down the road and leaving not only renters but rental housing providers with this huge unfunded amount of debt.\u201d<\/p>\n<p>Mom-and-pop operations that rent a small number of properties and have slim margins are the landlords most affected by the moratorium, Ryan said. The NAA, which was among the first groups to <a href=\"https:\/\/nclalegal.org\/rick-brown-v-secretary-alex-azar-et-al-ncla-challenges-unlawful-cdc-order-that-leaves-landlords-powerless-to-evict-delinquent-tenants\/\">sue over the original moratorium<\/a>, is examining all legal options moving forward, she added.<\/p>\n<p>\u201cWe\u2019re really starting to approach a breaking point,\u201d Ryan continued. \u201cAnd we\u2019re worried that we\u2019re going to start hemorrhaging.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/02\/joe-biden-administration-expand-eviction-moratorium\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden Admin Announces New Efforts To Expand Eviction Moratorium Amid Fight Between Congress, White House)<\/a><\/strong><\/p>\n<p>The NAA, along with other landlord groups, <a href=\"https:\/\/www.naahq.org\/sites\/default\/files\/7-27-21_filed_complaint.pdf\">filed<\/a> a separate lawsuit against the Biden administration late last month arguing the federal government owed property owners back-rent that has accumulated since the eviction moratorium was first put in place. Even President Biden admitted this fact,\u201d House Financial Services Committee Ranking Member Patrick McHenry said in a <a href=\"https:\/\/mchenry.house.gov\/news\/documentsingle.aspx?DocumentID=402973\">statement<\/a>. \u201cNow the Administration is attempting to skirt the judicial branch with this half-baked idea that does nothing to actually help renters.\u201d<\/p>\n<p>McHenry had previously <a href=\"https:\/\/dailycaller.com\/2021\/07\/13\/janet-yellen-maxine-waters-patrick-mchenry\/\">criticized<\/a> the administration for its mishandling of Emergency Rental Assistance (ERA) funds Congress appropriated in an effort to support tenants after the moratorium expires. The Treasury Department recently <a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/treasury-department-emergency-rent-assistance-patrick-mchenry\/\" target=\"_blank\" rel=\"noopener noreferrer\">admitted<\/a> it had only distributed $3 billion of the nearly $47 billion allocated for the ERA program.<\/p>\n<p>George Washington University law professor Jonathan Turley was among the experts who <a href=\"https:\/\/twitter.com\/JonathanTurley\/status\/1422663837438853121\">slammed<\/a> the president for continuing the moratorium even after admitting most scholars believed it was unconstitutional. He accused the president of willfully ordering an illegal policy to buy time before a court struck it down.<\/p>\n<p>\u201cIt was just six months ago that President Biden swore (to) uphold the Constitution,\u201d Turley <a href=\"https:\/\/twitter.com\/JonathanTurley\/status\/1422934957819842568\">tweeted<\/a>. \u201cChief Justice Roberts did not include (an) option for unconstitutional acts in the name of a good cause or when convenient.\u201d<\/p>\n<p>Heritage Foundation research fellow Joel Griffith <a href=\"https:\/\/www.heritage.org\/press\/heritage-expert-eviction-moratorium-presidential-fiat-blatantly-violates-constitution-defies\">concurred<\/a> with Turley and said the extension \u201cblatantly violates\u201d the Constitution.<\/p>\n<p>\u201cWe must be vigilant against attempts to use this crisis as an excuse to further erode private property rights, enlarge federal power beyond constitutional limits, rewrite legislation by executive order, or deny fellow citizens their fundamental right to access the courts, enter into enforceable contracts, and to possess private property,\u201d Griffith said. \u201cThis moratorium is unlawful and unconstitutional.\u201d<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
