Kendi. The legislation directs the Education Department\u2019s Office of Civil Rights (OCR) to investigate parent and student complaints against the use of curriculum, teaching, or counseling that promotes \u201cdivisive concepts\u201d and fosters \u201cracially-hostile school environments.\u201d<\/span><\/p>\n<p><span>The legislation would require that the OCR investigate when a parent or student submits a complaint alleging discrimination or the promotion of Critical Race Theory.&nbsp;<\/span><\/p>\n<p><span>Examples of discrimination include:&nbsp;&nbsp;<\/span><\/p>\n<ul>\n<li><span>One race is inherently superior to another race<\/span><\/li>\n<li><span>The United States is fundamentally racist&nbsp;<\/span><\/li>\n<li><span>An individual, by virtue of the individual\u2019s race, is inherently racist or oppressive, whether consciously or unconsciously<\/span><\/li>\n<li><span>An individual should be discriminated against or receive adverse treatment solely or partly because of the individual\u2019s race&nbsp;<\/span><\/li>\n<li><span>Members of one race cannot and should not attempt to treat others without respect to race&nbsp;<\/span><\/li>\n<li><span>An individual\u2019s moral character is necessarily determined by the individual\u2019s race&nbsp;<\/span><\/li>\n<li><span>An individual, by virtue of the individual\u2019s race, bears responsibility committed in the past by other members of the same race<\/span><\/li>\n<li><span>Any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of the individual\u2019s race<\/span><\/li>\n<li><span>Meritocracy or traits such as a hard work ethic are racist, or were created by a particular race to oppress another race<\/span><\/li>\n<\/ul>\n<p><span>The legislation also mandates that state Attorneys General allow Governors to hold schools in their states accountable if the OCR fails to investigate and enforce existing protections.&nbsp;<\/span><\/p>\n<p><span>Rubio told The Daily Wire that Critical Race Theory is teaching younger generations to \u201chate their country.\u201d&nbsp;&nbsp;<\/span><\/p>\n<p><span>\u201cThe Democrat Party, led by an activist wing of radical Marxists, is trying to remake our nation by teaching younger generations of Americans to hate their country and that certain groups of Americans are inherently racist solely because of the color of their skin,\u201d Rubio said. \u201cThat movement, called Critical Race Theory, begins in our children\u2019s schools.\u201d&nbsp;<\/span><\/p>\n<p><span>The introduction of the legislation came after the Senate education committee held hearings on Biden\u2019s Education Department OCR lead, Catherine Lhamon. Republican Senator Richard Burr asked Lhamon how she defined \u201cracism.\u201d&nbsp;<\/span><\/p>\n<p><span>Lhamond said:&nbsp;<\/span><\/p>\n<blockquote readability=\"9\">\n<p><i><span>The Merriam-Webster dictionary defines \u201cracism\u201d as a \u201cbelief that race is a fundamental determinant of human traits and capacities and that racial differences produce an inherent superiority of a particular race.\u201d If confirmed, my concern would be \u2014 and the concern of the Office for Civil Rights is \u2014 ensuring that all students are protected from discrimination on the basis of race.<\/span><\/i><\/p>\n<\/blockquote>\n<p><span>Burr continued by asking whether it would be \u201ca violation of Title VI to ascribe character traits, values, moral and ethical codes, privileges, status or beliefs to a race or to an individual solely because of his or her race.\u201d&nbsp;<\/span><\/p>\n<p><span>Lhamond refused to answer.&nbsp;<\/span><\/p>\n<p><span>Max Eden, a research fellow at the American Enterprise Institute, concluded that Lhamond needed no further context to answer Burr\u2019s question because violating Title VI would be counterintuitive to her own definition of racism.&nbsp;<\/span><\/p>\n<p><span>\u201cUltimately, then, Lhamon\u2019s refusal to admit that any of these obviously racist illegal practices violates federal civil rights law comes quite close to an admission that she will, at best, not enforce equal protection equally,\u201d Eden <\/span><a href=\"http:\/\/v\/\"><span>said<\/span><\/a><span>.&nbsp;<\/span><\/p>\n<p><span>Biden\u2019s Education Department OCR has been in stark contrast from the Trump administration\u2019s which found that racial affinity groups are \u201cdiscriminatory.\u201d In Evanston, Illinois, Trump\u2019s Education Department OCR found that a school district engaged in \u201cintentional race discrimination\u201d when they segregated staff by race for professional development and forced students to partake in a \u201cprivilege walk.\u201d&nbsp;<\/span><\/p>\n<p><span>The Biden administration suspended that decision and approved the use of so-called \u201caffinity groups\u201d in public schools.&nbsp;<\/span><\/p>\n<p><b>Related: <\/b><a href=\"https:\/\/www.dailywire.com\/news\/biden-education-department-decides-racially-segregated-groups-are-not-discriminatory\"><b>Biden Education Department Decides Racially Segregated Groups Are Not Discriminatory<\/b><\/a><\/p>\n<p><i><span>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
