However, following unrest largely because of the races of Scurlock, who is black, and Gardner, who is white, the DA appointed special prosecutor Fred Franklin and a grand jury, hoping \u201cit would restore public faith in the justice system,\u201d NPR <a href=\"https:\/\/www.npr.org\/sections\/live-updates-protests-for-racial-justice\/2020\/09\/16\/913812914\/omaha-grand-jury-indicts-bar-owner-over-fatal-shooting-of-black-protester-in-may\">reported<\/a>.<\/p>\n<p>Franklin, who said he initially thought Gardner acted in <a href=\"https:\/\/www.npr.org\/sections\/live-updates-protests-for-racial-justice\/2020\/09\/16\/913812914\/omaha-grand-jury-indicts-bar-owner-over-fatal-shooting-of-black-protester-in-may\">self-defense<\/a>, agreed with the grand jury and announced in September that Gardner was indicted on charges of manslaughter, attempted first-degree assault, terroristic threats, and use of a firearm in connection with a felony.<\/p>\n<p>One week later, Gardner committed suicide.<\/p>\n<p>The suit, filed Monday by&nbsp;Gardner\u2019s parents, David and Glenda Sue Gardner, claims Franklin and Douglas County Attorney Don Kleine violated their son\u2019s Sixth and 14th Amendment rights. The Omaha World-Herald <a href=\"https:\/\/omaha.com\/news\/local\/crime-and-courts\/lawsuit-contends-special-prosecutors-comments-caused-jake-gardner-to-kill-himself\/article_33d2b06a-eed5-11eb-9fcb-b36674f65e6a.html#tracking-source=home-top-story-1\">reported<\/a> on the allegations outlined in the lawsuit:<\/p>\n<blockquote readability=\"20\">\n<p><em>The suit alleges Franklin conspired with Kleine and two retired Omaha police detectives who were on Franklin\u2019s team to make false and misleading statements to the news media. Franklin\u2019s statements, the suit says, \u201cincluded implications that Mr. Gardner was a racist\u201d and \u201calso falsely stated that it was Mr. Gardner\u2019s own words that showed his intent to kill.\u201d<\/em><\/p>\n<p><em>The statements, which the lawsuit contends impacted Gardner\u2019s right to a fair trial, \u201ccaused Mr. Gardner to lose all faith in the justice system and become paranoid and afraid for his life,\u201d the lawsuit states. \u201cAs a result of this extreme emotional distress, Mr. Gardner committed suicide on Sept. 20, 2020.\u201d<\/em><\/p>\n<\/blockquote>\n<p>As noted by <a href=\"https:\/\/www.dailywire.com\/news\/veteran-bar-owner-commits-suicide-week-after-special-prosecutor-indicts-him-for-fatally-shooting-rioter\">The Daily Wire<\/a>&nbsp;back in September, Gardner\u2019s attorneys at the time, Stu Dornan and Tom Monaghan, <a href=\"https:\/\/omaha.com\/news\/local\/crime-and-courts\/jake-gardner-has-killed-himself-in-oregon-authorities-say\/article_67d6cd0c-049a-5e15-9bf7-d812e212b5cb.html\">according<\/a> to the Omaha World-Herald, said their client\u2019s suicide stemmed from \u201ca cocktail of behavioral health problems stemming from head trauma he experienced during military service, the belief that people were out to kill him, and an \u2018incessant rush to judgment\u2019 by social media jockeys.\u201d<\/p>\n<div readability=\"7\">\n<p>They also disclosed that Gardner was receiving \u201cdeath threats.\u201d<\/p>\n<\/div>\n<div readability=\"18\">\n<p>\u201cBottom line, Dornan and Monaghan said, Gardner had lost his bars (a landlord ended his lease after the shooting), his home, his livelihood,\u201d the report said. \u201cAnd he was about to lose his freedom. Add in behavioral health concerns, Dornan said, and suicide was not a surprise, even though his attorneys fully expected him to turn himself in Sunday night.\u201d<\/p>\n<\/div>\n<div readability=\"13\">\n<p>\u201cI had the opportunity to talk with Mr. Gardner before his return, and he was really shook up,\u201d Dornan said. \u201cThe grand jury indictment was a shock to him, it was a shock to us, it was a shock to many people.\u201d<\/p>\n<\/div>\n<div readability=\"9\">\n<p class=\"lee-article-text\">Klein told the Omaha World-Herald this week in reaction to the suit, \u201cThe allegations in my opinion are unfounded.\u201d<\/p>\n<\/div>\n<div readability=\"10.679611650485\">\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
