Mo Brooks in a lawsuit alleging that he conspired to incite the riots that occurred at the U.S. Capitol Jan. 6, according to a Tuesday court filing.<\/p>\n<p>Brooks, who is one of several Republicans targeted by Democratic Rep. Eric Swalwell\u2019s <a href=\"https:\/\/dailycaller.com\/2021\/03\/05\/eric-swalwell-sues-trump-responsible-capitol-riot\/\">lawsuit<\/a>, had argued that the Westfall Act would compel the department to protect federal elected officials in issues pertaining to their work, according to the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.228356\/gov.uscourts.dcd.228356.33.0.pdf\">filing<\/a>.<\/p>\n<p>\u201cMembers of Congress are subject to a host of restrictions that carefully distinguish between their official functions, on the one hand, and campaign functions, on the other,\u201d the department wrote in response to Brooks.<\/p>\n<p>\u201cInciting or conspiring to foment a violent attack on the United States Congress is not within the scope of employment of a Representative \u2013 or any federal employee \u2013 and thus is not the sort of conduct for which the United States is properly substituted as a defendant under the Westfall Act,\u201d it said.<\/p>\n<p>Swalwell retweeted some who commented positively on the news about the department\u2019s decision to not support Brooks.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"4.7457627118644\">\n<p dir=\"ltr\" lang=\"en\">I am very very VERY happy for <a href=\"https:\/\/twitter.com\/RepSwalwell?ref_src=twsrc%5Etfw\">@RepSwalwell<\/a>!! <a href=\"https:\/\/t.co\/vnlw1bsW56\">https:\/\/t.co\/vnlw1bsW56<\/a><\/p>\n<p>\u2014 E.
