Josh Hawley of Missouri, Mike Lee of Utah, and Ted Cruz of Texas <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1392\/184947\/20210726160225898_2021-07-26%20Hawley%20Amicus%20Brief%20FINAL%20-%20PDFA.pdf\">filed the brief<\/a> in Dobbs v. Jackson Women\u2019s Health Organization, which the court is scheduled to hear beginning in October, calling on the court to&nbsp;revisit its rulings in Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey.<\/p>\n<p>The senators pushed the Court to return questions of abortion legislation to the states and challenged the Supreme Court\u2019s abortion jurisprudence as unconstitutional. <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/17\/supreme-court-abortion-case-mississippi-roe-wade-dobbs-jackson-womens-health\/\">(RELATED: Supreme Court Takes Up Major Abortion Case Directly Challenging Roe v. Privileged to be joined by my friends and gifted lawyers <a href=\"https:\/\/twitter.com\/tedcruz?ref_src=twsrc%5Etfw\">@tedcruz<\/a> and <a href=\"https:\/\/twitter.com\/SenMikeLee?ref_src=twsrc%5Etfw\">@SenMikeLee<\/a> in our brief for the Dobbs case <a href=\"https:\/\/t.co\/Ks17ehjucl\">https:\/\/t.co\/Ks17ehjucl<\/a><\/p>\n<p>\u2014 Josh Hawley (@HawleyMO) <a href=\"https:\/\/twitter.com\/HawleyMO\/status\/1419752866504454145?ref_src=twsrc%5Etfw\">July 26, 2021<\/a> <\/p>\n<\/blockquote>\n<p>\u201cThis status quo is untenable,\u201d the senators wrote. \u201cWhere a legal doctrine has repeatedly failed to offer clarity\u2014where it has proved unworkable in the past and will likely engender unpredictable consequences in the future\u2014its existence constitutes an open invitation to judges to interpret it according to their own policy preferences, usurping the constitutional prerogatives of the legislature.\u201d<\/p>\n<p>\u201c<em>Roe<\/em>&nbsp;and&nbsp;<em>Casey<\/em>&nbsp;<wbr \/>should be overruled,\u201d they continue, \u201cand the question of abortion legislation should be returned to the states.\u201d<\/p>\n<p>Dobbs will be the first major abortion case in which all three of former President Donald Trump\u2019s Supreme Court justice appointees participate, including Justice Amy Coney Barrett, who gained a seat on the court after a&nbsp;<a href=\"https:\/\/dailycaller.com\/2020\/09\/26\/amy-coney-barrett-supreme-court-attacks-democrats-media\/\">contentious confirmation<\/a>&nbsp;process in October.<\/p>\n<p>At issue is the question of whether all pre-viability bans on abortions are unconstitutional. <strong><a href=\"https:\/\/dailycaller.com\/2020\/06\/29\/scotus-strikes-down-louisiana-abortion-restrictions\/\">(RELATED: SCOTUS Rules In Favor Of Abortion Advocates In Major Pro-Life Loss)<\/a><\/strong><\/p>\n<p>The case deals with a 2018 Mississippi law banning abortions after 15 weeks, a law&nbsp;<a href=\"https:\/\/reproductiverights.org\/supreme-court-to-hear-abortion-ban-case-challenging-roe-v-wade\/\">challenged<\/a>&nbsp;by the Center for Reproductive Rights, the law firm Paul Weiss, Rifkind, Wharton &amp; Garrison, and the Mississippi Center for Justice on behalf of the last remaining abortion clinic in Mississippi \u2014 Jackson Women\u2019s Health Organization.<\/p>\n<p>After the Fifth Circuit Court of Appeals&nbsp;<a href=\"https:\/\/nam02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Freproductiverights.org%2Fpress-room%2Fappeals-court-strikes-down-mississippi-15-week-abortion-ban&amp;data=04%7C01%7Cnfranco%40reprorights.org%7C302efcc6678349bf5eff08d9193fc687%7Ce5451579057a46829656b9548f94b665%7C0%7C0%7C637568583984413006%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=DKRY4%2FI4UzL%2FN0Fblk7hH7Vd1E4b1zFNcXjdLXyC7jI%3D&amp;reserved=0\">struck down<\/a>&nbsp;the law in December 2019, the state of Mississippi asked the Supreme Court to take up the case.<\/p>\n<p>An unborn baby is&nbsp;<a href=\"https:\/\/www.verywellfamily.com\/premature-birth-and-viability-2371529\">considered viable<\/a>&nbsp;at 24 weeks, though medical intervention and a stay in the NICU are usually required this early.
