Jackson Women\u2019s Health Organization, which the court will hear beginning in October, slamming Roe as \u201cegregiously wrong\u201d and calling on the Supreme Court to uphold Mississippi\u2019s ban on abortions after 15 weeks.<\/strong><\/li>\n<li><strong>At issue is the question of whether all pre-viability bans on abortions are unconstitutional<\/strong><\/li>\n<\/ul>\n<p>Mississippi\u2019s Attorney General Lynn Fitch called on the Supreme Court Thursday to defend the right of states to pass laws protecting \u201clife and women\u2019s health,\u201d urging the court to overturn the landmark abortion case Roe v. Wade.<\/p>\n<p>The attorney general <a href=\"https:\/\/www.documentcloud.org\/documents\/21014766-dobbs-v-jackson-womens-health-organization-brief-for-petitioners-final\">filed a brief<\/a> in Dobbs v. Jackson Women\u2019s Health Organization, which the court will hear beginning in October, slamming Roe as \u201cegregiously wrong\u201d and calling on the Supreme Court to uphold Mississippi\u2019s ban on abortions after 15 weeks.<\/p>\n<p>Dobbs will be the first major abortion case in which all three of former President Donald Trump\u2019s Supreme Court justice appointees participate, including Justice Amy Coney Barrett, who gained a seat on the court after a <a href=\"https:\/\/dailycaller.com\/2020\/09\/26\/amy-coney-barrett-supreme-court-attacks-democrats-media\/\">contentious confirmation<\/a>&nbsp;process in October.<\/p>\n<p>At issue is the question of whether all pre-viability bans on abortions are unconstitutional. <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/17\/supreme-court-abortion-case-mississippi-roe-wade-dobbs-jackson-womens-health\/\">(RELATED: Supreme Court Takes Up Major Abortion Case Directly Challenging Roe v. Wade)<\/a><\/strong><\/p>\n<p>\u201cThere are those who would like to believe that Roe v. Wade settled the issue of abortion once and for all,\u201d Fitch <a href=\"https:\/\/www.ago.state.ms.us\/2021\/07\/22\/attorney-general-lynn-fitch-files-brief-in-dobbs-v-jwho\/\">said in a statement<\/a>. \u201cBut all it did was establish a special-rules regime for abortion jurisprudence that has left these cases out of step with other Court decisions and neutral principles of law applied by the Court.\u201d<\/p>\n<p>\u201cAs a result, state legislatures, and the people they represent, have lacked clarity in passing laws to protect legitimate public interests, and artificial guideposts have stunted important public debate on how we, as a society, care for the dignity of women and their children,\u201d Fitch continued. \u201cIt is time for the Court to set this right and return this political debate to the political branches of government.\u201d<\/p>\n<p>The brief argues that many things have changed in the nearly 50 years since Roe v. Wade, including scientific understanding of when an unborn baby is viable outside the womb. <strong><a href=\"https:\/\/dailycaller.com\/2021\/04\/30\/guttmacher-institute-joe-biden-roe-v-wade\/\">(RELATED: States Introduced Over 500 Pro-Life Bills In 2021 In \u2018Pro-Life Surge\u2019)<\/a><\/strong><\/p>\n<p>An unborn baby is&nbsp;<a href=\"https:\/\/www.verywellfamily.com\/premature-birth-and-viability-2371529\">considered viable<\/a>&nbsp;at 24 weeks, though medical intervention and a stay in the NICU are usually required this early. Babies born before 23 weeks&nbsp;<a href=\"https:\/\/www.acog.org\/clinical\/clinical-guidance\/obstetric-care-consensus\/articles\/2017\/10\/periviable-birth\">have a survival rate<\/a>&nbsp;of about 5% to 6%, and analysis by Charlotte Lozier Institute medical experts found that unborn babies&nbsp;<a href=\"https:\/\/lozierinstitute.org\/new-study-shows-unborn-babies-feel-pain-at-12-weeks\/\">can feel pain as early as 12 weeks<\/a>.<\/p>\n<p>\u201cLegislatures should be able to respond to those advances, which they cannot do in the face of flawed precedents that are anchored to decades-stale views of life and health,\u201d the brief said.<\/p>\n<p>\u201cA lot has changed in five decades,\u201d Fitch said in a statement. \u201cIn 1973, there was little support for women who wanted a full family life and a successful career. Maternity leave was rare. Paternity leave was unheard of. The gold standard for professional success was a 9-to-5 with a corner office. The flexibility of the gig economy was a fairy tale.\u201d<\/p>\n<p>\u201cIn these last fifty years,\u201d she continued, \u201cwomen have carved their own way to achieving a better balance for success in their professional and personal lives. By returning the matter of abortion policy to state legislatures, we allow a stunted debate on how we support women to flourish. It is time for the Court to let go of its hold on this important debate.\u201d<\/p>\n<p>Center for Reproductive Rights president Nancy Northup condemned the move, <a href=\"https:\/\/twitter.com\/RewireNewsGroup\/status\/1418322983056257030\">saying in a statement<\/a> that Fitch\u2019s brief <span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">\u201creveals the extreme and regressive strategy, not just of this law, but of the avalanche of abortion bans and restrictions that are being passed across the country.\u201d&nbsp;<\/span><\/p>\n<p>\u201cThe other side isn\u2019t even hiding their true goal anymore,\u201d <a href=\"https:\/\/twitter.com\/NARAL\/status\/1418317966563700743?s=20\">tweeted<\/a> the National Abortion Rights Action League. \u201cThey want to overturn Roe, and now they\u2019re saying it explicitly.
