Goodwin ruled Wednesday.<\/strong><\/li>\n<li><strong>Lawyers from the ACLU-West Virginia had argued that HB 3293 would unfairly prevent the 11-year-old student, Becky Pepper-Jackson, from participating on a girls cross country team.<\/strong><\/li>\n<li><strong>Goodwin issued a preliminary injunction Wednesday allowing Pepper-Jackson to \u201csign up for and participate in school athletics in the same way as her girl classmates.\u201d <\/strong><\/li>\n<\/ul>\n<p>A biologically male middle school student may run on a girl\u2019s cross country team this fall in spite of West Virginia\u2019s new law banning biological males from women\u2019s sports, U.S. Circuit Judge Joseph R. Goodwin ruled Wednesday.<\/p>\n<p>Lawyers from the ACLU-West Virginia <a href=\"https:\/\/wvmetronews.com\/2021\/07\/21\/judge-rules-transgender-west-virginia-athlete-should-be-allowed-to-run-on-the-girls-team\/\">had argued<\/a> that <a href=\"https:\/\/www.wvlegislature.gov\/legisdocs\/chamber\/2021\/RS\/com_amends\/HB3293%20S%20ED%20AM%20_1%204-1%20adopted.htm\" target=\"_blank\" rel=\"noopener noreferrer\">HB 3293<\/a> would unfairly prevent the 11-year-old student, Becky Pepper-Jackson, from participating on a girls cross country team.<\/p>\n<p>Goodwin issued a preliminary injunction Wednesday allowing Pepper-Jackson to \u201csign up for and participate in school athletics in the same way as her girl classmates.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/louisiana-house-fails-override-trans-bill\/\">(RELATED: Louisiana Republicans Fail To Override Governor\u2019s Veto On Bill Banning Biological Males From Women\u2019s Sports)<\/a><\/strong><\/p>\n<p>\u201cA fear of the unknown and discomfort with the unfamiliar have motivated many of the most malignant harms committed by our country\u2019s governments on their own citizens,\u201d Goodwin said. \u201cOut of fear of those less like them, the powerful have made laws that restricted who could attend what schools, who could work certain jobs, who could marry whom, and even how people can practice their religions.\u201d<\/p>\n<p>\u201cAt this point, I have been provided with scant evidence that this law addresses any problem at all, let alone an important problem,\u201d the judge said of HB 3293. \u201cWhen the government distinguishes between different groups of people, those distinctions must be supported by compelling reasons.\u201d<\/p>\n<p><a title=\"View B. The child was reportedly diagnosed with gender dysphoria in 2019, began puberty-delaying treatment in June 2020, and is now entering sixth grade. <strong><a href=\"https:\/\/dailycaller.com\/2021\/06\/02\/desantis-noem-womens-sports-ncaa\/\">(RELATED: \u2018Woke\u2019 Pressure \u2018Strengthened\u2019 DeSantis Decision To Ban Biological Males From Women\u2019s Sports, Spox Says)<\/a><\/strong><\/p>\n<p>\u201cPlaintiff avers that this treatment, which prevents endogenous puberty and therefore any physiological changes caused by increased testosterone circulation, prevents her from developing any physiological advantage over other girl athletes,\u201d the filing said.<\/p>\n<p>West Virginia\u2019s legislation would not only require students to participate in sports that align with their biological sex, but also mandates students to provide birth certificates to the school in order to indicate gender.<\/p>\n<p>The state joins several others drawing up legislation banning biological males from women\u2019s sports. Republican Arkansas Gov. Asa Hutchinson <a href=\"https:\/\/dailycaller.com\/2021\/03\/25\/arkansas-governor-hutchinson-womens-sports-bill\/\">signed<\/a> Arkansas\u2019s Fairness in Women\u2019s Sports Act into law in late March, but&nbsp;<a href=\"https:\/\/dailycaller.com\/2021\/04\/06\/arkansas-trans-governor-legislature-bans-trans-surgeries-minors\/\">later drew fire<\/a> for vetoing a bill banning transgender surgeries and procedures for minors.<\/p>\n<p>The state legislature&nbsp;<a href=\"https:\/\/dailycaller.com\/2021\/04\/06\/arkansas-trans-governor-legislature-bans-trans-surgeries-minors\/\" target=\"_blank\" rel=\"noopener noreferrer\">overrode<\/a> his veto, making Arkansas the first state to ban the procedures for minors, but a federal judge temporarily blocked the enforcement of the law Wednesday. <strong><a href=\"https:\/\/dailycaller.com\/2021\/03\/30\/noem-south-dakota-bill-explains\/\">(RELATED: Here\u2019s Why Noem Fought South Dakota\u2019s Bill Banning Biological Males From Women\u2019s Sports)<\/a><\/strong><\/p>\n<p>South Dakota\u2019s Fairness in Women\u2019s Sports Act was thrust into the national spotlight when Gov. Kristi Noem <a href=\"https:\/\/dailycaller.com\/2021\/03\/30\/noem-south-dakota-bill-explains\/\">refused to sign<\/a> the legislation without her suggested changes.<\/p>\n<p>Noem said the bill would subject South Dakota to lawsuits the state could not win and said she seeks to \u201cprotect girls\u201d through other measures, including two executive orders: one to \u201c<a href=\"https:\/\/sdsos.gov\/general-information\/executive-actions\/executive-orders\/assets\/2021-05.PDF\">protect fairness in K-12 athletics<\/a>\u201d and another to \u201c<a href=\"https:\/\/sdsos.gov\/general-information\/executive-actions\/executive-orders\/assets\/2021-06.PDF\">do so in college athletics<\/a>.\u201d<\/p>\n<p>She&nbsp;<a href=\"https:\/\/dailycaller.com\/2021\/03\/22\/tucker-noem-south-dakota-bill-womens-sports\/\">has insisted<\/a>&nbsp;that she did not cave to pressure from groups like the NCAA, which later publicly&nbsp;<a href=\"https:\/\/www.ncaa.org\/about\/resources\/media-center\/news\/ncaa-board-governors-statement-transgender-participation\">warned<\/a>&nbsp;in April that it would pull out of states that do not allow transgender students to participate in college sports.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
