But this hard choice doesn\u2019t amount to coercion.\u201d<\/p>\n<p class=\"p1\">He noted that \u201cRecognizing the students\u2019 significant liberty to refuse unwanted medical treatment, the Fourteenth Amendment permits Indiana University to pursue a reasonable and due process of vaccination in the legitimate interest of public health for its students, faculty, and staff.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cToday, on this preliminary record, the university has done so for its campus communities. The students haven\u2019t established a likelihood of success on the merits of their Fourteenth Amendment claim or the many requirements that must precede the extraordinary remedy of a preliminary injunction,\u201d he added.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The university\u2019s <a href=\"https:\/\/www.iu.edu\/covid\/prevention\/covid-19-vaccine.html\"><span class=\"s1\">requirement<\/span><\/a> stated that students, faculty, and staff needed to be fully vaccinated by August 15 or when they come back to campus after August 1, whichever was earlier.<\/p>\n<p class=\"p1\">If anyone chooses not to get vaccinated, the university noted that students would \u201csee their class registration cancelled\u2026access to IU systems (Canvas, email, etc.) terminated, and will not be allowed to participate in any on campus activity.\u201d If faculty and staff don\u2019t get vaccinated, they will be fired. \u201cWorking remotely and not meeting the COVID-19 vaccine requirement is not an option,\u201d the university\u2019s <a href=\"https:\/\/www.iu.edu\/covid\/prevention\/covid-19-vaccine.html\">website<\/a> made clear.<\/p>\n<p class=\"p1\">The university allowed religious, ethical, or \u201c[m]edical exemptions with documentation from your provider of an allergy to the COVID-19 vaccines or their components.\u201d Students who are in an all-online program can also get an exemption.<\/p>\n<p class=\"p1\">The requirement allowed for some medical deferrals, as well, in situations like \u201cActive pregnancy or active breastfeeding,\u201d but \u201conly if the provider is requesting an exemption.\u201d It added, \u201cThe exemption lasts only until you\u2019re no longer actively pregnant or actively breastfeeding. Pregnancy and breastfeeding are not contraindications for vaccination.\u201d<\/p>\n<p class=\"p1\">The lawsuit pointed out, however, that the school still requires anyone who gets an exemption to follow \u201cExtra Requirements\u201d including participation in \u201cmitigation testing twice a week, a mandatory quarantine\u201d if they are around someone who has COVID, \u201cmandatory face masks in public spaces, and a mandatory return to their home address\u201d if there is a serious outbreak on campus.<\/p>\n<p class=\"p1\">The plaintiffs also claimed that if a person with an exemption doesn<span>\u2019t wear a face mask or do the mitigation testing<\/span>, they face \u201cdisciplinary action up to and including dismissal or termination from the university.\u201d<\/p>\n<p class=\"p1\">Purdue University President and former Governor of Indiana Mitch Daniels <a href=\"https:\/\/www.msnbc.com\/stephanie-ruhle\/watch\/purdue-university-president-reacts-to-judge-s-ruling-to-uphold-nearby-indiana-university-s-vaccine-mandate-117007429838\"><span class=\"s1\">responded<\/span><\/a> to the judge\u2019s decision.<\/p>\n<p class=\"p1\">Daniels said, \u201cWe\u2019re with that very large majority of American colleges and universities who are not planning to require the vaccine this fall\u2026I\u2019m not going to be critical of those who choose a different path.\u201d<\/p>\n<p class=\"p1\">Daniels explained Purdue\u2019s own system, stating, \u201c\u2026we have offered a choice model and people can either choose to stay with the system we used all last year where all of us were subject to surveillance testing on a regular basis or they can exempt themselves by getting vaccinated.\u201d<\/p>\n<p class=\"p1\">In a <a href=\"https:\/\/www.washingtonpost.com\/education\/2021\/07\/19\/iu-vaccine-lawsuit-mandate-judge\/\"><span class=\"s1\">statement<\/span><\/a> per The Washington Post, IU said, \u201cA ruling from the federal court has affirmed Indiana University\u2019s COVID-19 vaccination plan designed for the health and well-being of our students, faculty and staff.\u201d<\/p>\n<p class=\"p1\">\u201cWe appreciate the quick and thorough ruling which allows us to focus on a full and safe return. We look forward to welcoming everyone to our campuses for the fall semester,\u201d the university added.<\/p>\n<p class=\"p1\">An IU spokesman <a href=\"https:\/\/www.washingtonpost.com\/education\/2021\/07\/19\/iu-vaccine-lawsuit-mandate-judge\/\"><span class=\"s2\">said<\/span><\/a> that around 80% of students, staff, and faculty have gotten at least one shot of the vaccine.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">James Bopp, Jr., the lawyer who is representing the students, <a href=\"https:\/\/www.washingtonpost.com\/education\/2021\/07\/19\/iu-vaccine-lawsuit-mandate-judge\/\"><span class=\"s2\">said<\/span><\/a> that they plan to appeal the decision.<\/p>\n<div readability=\"9\">\n<div data-qa=\"drop-cap-letter\" readability=\"13\">\n<p class=\"font--body font-copy gray-darkest ma-0 pb-md \" data-el=\"text\">\u201cContinuing our fight against this unconstitutional mandate is necessary to guarantee that IU students receive the fair due process they\u2019re owed by a public university,\u201d Bopp said. \u201cAn admitted IU student\u2019s right to attend IU cannot be conditioned on the student waiving their rights to bodily integrity, bodily autonomy, and consent to medical treatment like IU has done here.\u201d<\/p>\n<\/div>\n<\/div>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
