The judge italicized \u201cpotentially\u201d and \u201cnecessarily.\u201d<\/p>\n<p>Refusing to use preferred transgender pronouns \u201cmay be disrespectful, discourteous, and insulting,\u201d said Judge Duarte, but it allows others \u201cto express an ideological disagreement with another person\u2019s expressed gender identity.\u201d<\/p>\n<p>Taking Offense challenged the law back in December 2017, according to California Family Council. The case was&nbsp;brought by Llewellyn Law Office Attorney David Llewellyn \u201con behalf of several unnamed clients and is challenging the law as \u2018unconstitutionally vague and overbroad,&#8217;\u201d the site noted.<\/p>\n<p>SB 219 sponsor Democratic&nbsp;Senator Scott Wiener (San Francisco) said in a statement that the court\u2019s decision \u201cis disconnected from the reality facing transgender people,\u201d adding that \u201cmisgendering\u201d someone is \u201cstraight-up harassment.\u201d<\/p>\n<p>\u201cThe Court\u2019s decision is disconnected from the reality facing transgender people. Deliberately misgendering a transgender person isn\u2019t just a matter of opinion, and it\u2019s not simply \u2018disrespectful, discourteous, or insulting.\u2019 Rather, it\u2019s straight-up harassment,\u201d the senator said. \u201cAnd, it erases an individual\u2019s fundamental humanity, particularly one as vulnerable as a trans senior in a nursing home.
