Bryan Slaton (R-TX) introduced <\/span><a href=\"https:\/\/capitol.texas.gov\/tlodocs\/871\/billtext\/pdf\/HB00103I.pdf#navpanes=0\"><span>HB 103<\/span><\/a><span> \u2014 the \u201cAbolition of Abortion through Equal Protection for All Unborn Children Act\u201d \u2014 on July 8 to invoke Texan state sovereignty and abolish abortion within the state\u2019s borders.<\/span><\/p>\n<p><span>Quoting the Texas Constitution \u2014 which provides that \u201cTexas is a free and independent State, subject only to the Constitution of the United States\u201d \u2014 the bill acknowledges \u201cthe sanctity of innocent human life created in the image of God, which should be equally protected from fertilization to natural death.\u201d<\/span><\/p>\n<p><span>Accordingly, the legislation would \u201censure the right to life and equal protection of the laws to all unborn children from the moment of fertilization,\u201d \u201cestablish that a living human unborn child, from the moment of fertilization and at every stage of development, is entitled to the same rights, powers, and privileges as are secured or granted by the laws of this state to any other human person,\u201d and \u201crescind all licenses to kill unborn children,\u201d among other provisions.<\/span><\/p>\n<p><span>Slaton\u2019s bill also references Supreme Court Justice Clarence Thomas\u2019 assertion in<\/span><i><span> June Medical Services L.L.C. v. Russo<\/span><\/i><span> that \u201cthe Constitution does not constrain the States\u2019 ability to regulate or even prohibit abortion.\u201d<\/span><\/p>\n<p><span>The legislation entirely abolishes abortion \u2014 except for the case of an ectopic pregnancy \u201cthat seriously threatens the life of the mother when a reasonable alternative to save the lives of both the mother and the unborn child is unavailable.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/freethestates.org\/2021\/07\/state-rep-bryan-slaton-refiles-texas-abolition-bill-in-special-session\/?fbclid=IwAR2aoZ_l0S1y9MtdhGQm4SSdKZgjmLm6HWJu_1T-8MI7qM-0XFAToDFupCo\"><span>Free the States<\/span><\/a><span> \u2014 a group that seeks a \u201cparadigm shift away from incremental, pro-life regulationism\u201d \u2014 explained that Slaton has previously filed similar legislation:<\/span><\/p>\n<blockquote readability=\"10\">\n<p><i><span>Slaton fought valiantly for preborn children in Texas during his freshman session in the House \u2014 introducing HB3326 which would have immediately provided preborn children the equal protection of the law, motioning to amend House rules to force a vote on abolishing abortion before any vote to name bridges or roads, and filing an amendment to a counter-productive pro-life bill to make it immediately abolish abortion.<\/span><\/i><\/p>\n<\/blockquote>\n<p><span>Across the nation, pro-life lobbying groups have <\/span><a href=\"https:\/\/www.dailywire.com\/news\/opinion-republicans-governors-must-use-their-newfound-boldness-to-uphold-sanctity-of-life\"><span>nixed<\/span><\/a><span> similar bills \u2014 such as the Abolition of Abortion in Oklahoma Act \u2014 in legislative committees, under the presumption that states are unable to ignore <\/span><i><span>Roe v. Wade<\/span><\/i><span>. Free the States points to early signs of similar opposition from leading pro-life groups in Texas.<\/span><\/p>\n<p><span>As <\/span><a href=\"https:\/\/www.dailywire.com\/news\/texas-house-directs-law-enforcement-to-arrest-if-necessary-rogue-democratic-lawmakers\"><span>The Daily Wire<\/span><\/a><span> previously reported, the Texas Legislature is currently gridlocked as a result of Democratic House members fleeing the state to kill election reform bills. Gov. Greg Abbott (R-TX) threatened to arrest the lawmakers upon their return to Texas.<\/span><\/p>\n<p><span>\u201cWhat the law is, it\u2019s in the Constitution, and that is the house, the State House of Representatives who were here in the Capitol in Austin right now, they do have the ability to issue a call to have their fellow members who are not showing up to be arrested, but only so long as that arrest is made in the state of Texas,\u201d Abbott said during an appearance on Fox News. \u201cThat\u2019s why they have fled the state.
