Ron DeSantis of Florida, Greg Abbott of Texas, and others have signed bills outlawing critical race theory in public schools, increasing border security, and enacting constitutional carry.<\/span><\/p>\n<p><span>Perhaps for the first time in decades, Republican governors are legislating as if their states\u2019 policies matter far more in protecting their citizens\u2019 rights than any law from the federal government. Because they do.<\/span><\/p>\n<p><span>The spirit behind this trend is best summarized by Abbott\u2019s response to the Biden administration\u2019s rampant failures. In June, the governor <\/span><a href=\"https:\/\/twitter.com\/GregAbbott_TX\/status\/1404836819087380481\"><span>signed<\/span><\/a><span> a resolution \u201casserting Texas sovereignty under the 10th Amendment over all powers not granted to the federal government by the US Constitution.\u201d&nbsp;<\/span><\/p>\n<p><span>Abbott and his fellow Republican governors rightly recognize that stemming unfettered illegal immigration, ensuring that children are not indoctrinated into racism, and removing barriers for self-defense are critical policy moves. However, few governors have taken similarly meaningful steps to end abortion \u2014 by far the nation\u2019s greatest threat to life, liberty, and the pursuit of happiness.<\/span><\/p>\n<p><span>For the past five decades, abortion \u2014 the legalized murder of preborn image-bearers of God \u2014 has claimed at least 61 million American <\/span><a href=\"https:\/\/www.dailywire.com\/news\/5-disturbing-insights-from-planned-parenthoods-annual-report\"><span>lives<\/span><\/a><span>. By far, abortion is the leading cause of death in the United States.<\/span><\/p>\n<p><span>Throughout the last half century, Republican governors have operated under the presumption that <\/span><i><span>Roe v. Wade<\/span><\/i><span> \u2014 the 1973 Supreme Court case alleging that the Due Process Clause permits women to murder their own children \u2014 is gospel truth. In reality, <\/span><i><span>the Court\u2019s opinion is not even law<\/span><\/i><span> \u2014 if it were, the Biden administration would not be trying desperately to <\/span><a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/01\/22\/statement-from-president-biden-and-vice-president-harris-on-the-48th-anniversary-of-roe-v-wade\/\"><span>codify<\/span><\/a><span> it.<\/span><\/p>\n<p><span>The judicial branch was never designed to create statutes. Rather, the executive branch enforces the laws passed by the legislative branch. As Alexander Hamilton wrote in <\/span><a href=\"https:\/\/avalon.law.yale.edu\/18th_century\/fed78.asp\"><span>Federalist #78<\/span><\/a><span>: \u201cThe judiciary\u2026 has no influence over either the sword or the purse; no direction either of the strength or of the wealth of society; and can take no active resolution whatsoever. It may truly be said to have neither FORCE nor WILL, but merely judgment; and must ultimately depend upon the aid of the executive arm even for the efficacy of its judgments.\u201d&nbsp;<\/span><\/p>\n<p><span>At certain points in American history \u2014 for better or for worse \u2014 the executive branch has elected to <\/span><a href=\"https:\/\/www.dailywire.com\/news\/leftist-myths-on-government-policy\"><span>withhold<\/span><\/a><span> such aid from the Court. In 1832, it posited that the state of Georgia could not take Cherokee land without violating federal treaties. President Andrew Jackson replied: \u201cJohn Marshall has made his decision, now let him enforce it.\u201d<\/span><\/p>\n<p><span>In contrast, modern pro-life laws are passed under the assumption that they must comply with <\/span><i><span>Roe v. Wade<\/span><\/i><span>.<\/span><\/p>\n<p><span>After two generations of pro-life activism, there are probably more types of pro-life laws than ways to end a preborn child\u2019s life. In <\/span><a href=\"https:\/\/www.dailywire.com\/news\/abortion-facility-in-ohio-caught-tossing-preborn-babys-remains-into-dumpster-in-violation-of-state-law-report\"><span>Ohio<\/span><\/a><span>, mothers can kill their babies \u2014 as long as the abortion clinic gives them a \u201cproper burial\u201d afterward. In <\/span><a href=\"https:\/\/www.dailywire.com\/news\/tennessee-ban-on-abortions-due-to-down-syndrome-race-sex-partially-upheld-by-appeals-court\"><span>Tennessee<\/span><\/a><span>, mothers can kill their babies \u2014 as long as they don\u2019t have Down Syndrome. And in <\/span><a href=\"https:\/\/www.dailywire.com\/news\/gov-abbott-signs-bill-banning-abortions-if-roe-v-wade-is-overturned\"><span>Texas<\/span><\/a><span>, abortion could one day become illegal \u2014 <\/span><i><span>if <\/span><\/i><span>the Supreme Court overturns <\/span><i><span>Roe v. Wade<\/span><\/i><span>.<\/span><\/p>\n<p><span>Meanwhile, states are willing to defy actual federal law passed by Congress and signed by the President. Several \u2014 such as Doug Ducey\u2019s Arizona and Greg Gianforte\u2019s Montana \u2014 permit their residents to use marijuana recreationally, even though the federal government considers it a <\/span><a href=\"https:\/\/www.dea.gov\/drug-information\/drug-scheduling\"><span>Schedule I<\/span><\/a><span> substance.&nbsp;<\/span><\/p>\n<p><span>Republican state officials may outwardly assent that all babies \u2014 no matter their size, level of development, or chromosome count \u2014 are equally worthy of protection. However, their negligence in equally protecting <\/span><i><span>all <\/span><\/i><span>preborn life laws tells a different story. Indeed, Republican legislators in states like <\/span><a href=\"https:\/\/legiscan.com\/OK\/text\/SB13\/id\/1826987\"><span>Oklahoma<\/span><\/a><span> and <\/span><a href=\"https:\/\/www.billtrack50.com\/BillDetail\/1173250\"><span>Indiana<\/span><\/a><span> have nixed bills in committee that would have truly outlawed abortion by fully ignoring <\/span><i><span>Roe v. Wade<\/span><\/i><span>.<\/span><\/p>\n<p><span>In the present day, what better reason could there be to defy the Supreme Court and the federal government than to protect the inalienable, God-given right to life for preborn babies \u2014 3,000 of whom are injected with poison, chemically burned, and ripped to shreds on a daily basis? State and local governments \u2014 and the Americans who elected them \u2014 are willing to defy the federal government to smoke weed, but not to protect children.
