Lhamon\u2019s answers to several questions should raise civil rights concerns, but because her answers came in response to combatting campus sexual assault, they will be ignored by most media outlets and Democrats.<\/p>\n<p>In May 2020, Lhamon tweeted that then-Education Secretary Betsy DeVos \u201cpresides over taking us back to the bad old days, that predate my birth, when it was permissible to rape and sexually harass students with impunity. Today\u2019s students deserve better, including fair protections consistent with law.\u201d<\/p>\n<p>Lhamon\u2019s tweet was wildly inaccurate, as DeVos\u2019 Department of Education saw the introduction of due process rights for students accused of sexual assault and harassment, something Lhamon worked to dismantle when she worked for the Obama administration. DeVos\u2019 rules did not take \u201cus bad to the bad old days,\u201d they defined sexual assault and harassment and ordered schools to provide accused students an opportunity to defend themselves, contrary to what Lhamon, Democrats, and the media want for students \u2013 which is immediate punishment based solely on an accusation.<\/p>\n<p>Sen. Richard Burr (R-NC) asked Lhamon about this tweet during the hearing. Lhamon defended her tweet. This breaks with another one of Biden\u2019s contentious nominees, Neera Tanden, who, at the very least, tried to distance herself from one of her most inflammatory tweets.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.239361702128\">\n<p dir=\"ltr\" lang=\"en\">Lhamon, extraordinarily, stands by her inflammatory tweet that current regs would allow students to \u201crape\u201d with \u201cimpunity.\u201d Extraordinary.<\/p>\n<p>\u2014 KC Johnson (@kcjohnson9) <a href=\"https:\/\/twitter.com\/kcjohnson9\/status\/1414971303283548161?ref_src=twsrc%5Etfw\">July 13, 2021<\/a><\/p>\n<\/blockquote>\n<p>Upon further questioning from Burr, Lhamon also asserted that she rejects the presumption of innocence for accused students and claimed that federal Title IX regulations don\u2019t require it. Defense attorney Scott Greenfield, however, refuted this claim and linked to the section of the regulations that do require the presumption of innocence. Section 106.45 (b)(1)(iv) of the Education Department\u2019s Title IX rules state:<\/p>\n<blockquote readability=\"5.6756756756757\">\n<p><em>Include a presumption that the&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/definitions\/index.php?width=840&amp;height=800&amp;iframe=true&amp;def_id=6b8378698ed1a77c3870fbcd71e91132&amp;term_occur=999&amp;term_src=Title:34:Subtitle:B:Chapter:I:Part:106:Subpart:D:106.45\">respondent<\/a>&nbsp;is not responsible for the alleged conduct until a determination regarding responsibility is made at the conclusion of the grievance process.<\/em><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" readability=\"11.31654676259\">\n<p dir=\"ltr\" lang=\"en\">Nominee to head DOE Office of Civil Rights, Catherine Lhamon, asserts that she does not support the presumption of innocence and that the regulations do not require it.<\/p>\n<p>They do. Johnson has <a href=\"https:\/\/t.co\/LmsBoL60AK?amp=1\">documented<\/a>, hundreds of students filed lawsuits following the Obama administration\u2019s changes to Title IX regulations, which heavily discouraged due process and the presumption of innocence. Further, dozens of courts across the country, including appellate courts, have upheld students\u2019 right to due process even when accused on college campuses.<\/p>\n<p>Your constitutional rights don\u2019t end when you step foot on a college campus, but that is precisely what Lhamon is advocating.<\/p>\n<p>And she\u2019s always advocated that. The Leadership Conference On Civil and Human Rights tried to claim that, while working for the Obama administration, Lhamon \u201cmade significant progress in realizing our nation\u2019s federal civil rights promises for all students.\u201d The organization added that if confirmed, Lhamon would \u201censure justice for all students,\u201d enforce students\u2019 civil rights,\u201d and \u201cinvestigate systemic discrimination in schools.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.600550964187\">\n<p dir=\"ltr\" lang=\"en\">Catherine Lhamon was unanimously confirmed by the Senate to lead <a href=\"https:\/\/twitter.com\/EDcivilrights?ref_src=twsrc%5Etfw\">@EDCivilRights<\/a> from 2013-2017.<\/p>\n<p>Under her leadership, OCR made significant progress in realizing our nation\u2019s federal civil rights promises for all students. Ensuring justice for all students includes male students and those accused of sexual misconduct, which Lhamon has categorically rejected. Enforcing students\u2019 civil rights includes due process rights, which Lhamon has demonized. She also refused to accept that male students faced systemic discrimination in part thanks to her own policies, which made them campus targets.<\/p>\n<p>As a result of Lhamon\u2019s war on truth and civil rights, more than 700 lawsuits were filed against universities by students claiming they were denied due process. More than 200 favorable court decisions upheld these students claims (many of the remaining lawsuits either settled without court decisions or are still in the legal process).<\/p>\n<p>Obama\u2019s Education Secretary, Arne Duncan, tried to promote Lhamon\u2019s nomination by saying she \u201ctreats colleagues, partners, students, and educators with empathy and respect, even those with whom she disagrees.\u201d This is also false, as Lhamon either ignored those who argued for basic due process rights to misrepresenting them, as she did in her 2020 tweet in which she insisted that such rights amounted to allowing students to \u201crape\u201d with \u201cimpunity.\u201d<\/p>\n<p>As K.C.
