The Hollywood Reporter <a href=\"https:\/\/www.hollywoodreporter.com\/news\/politics-news\/donald-trump-meme-win-1234980939\/\">described<\/a> the video in question:<\/p>\n<blockquote readability=\"15\">\n<p><em>Cook found a video of a white toddler running after a black toddler and stuck a chyron reading \u201cbreaking news\u201d over it. The captions read, \u201cTerrified Todler [sic] Runs From Racist Baby\u201d and \u201cRacist Baby Probably A Trump Voter.\u201d<\/em><\/p>\n<p><em>The video then fades to black, and reads, \u201cWhat actually happened.\u201d The toddlers run at each other and embrace. A new caption: \u201cAMERICA IS NOT THE PROBLEM\u2026FAKE NEWS IS. IF YOU SEE SOMETHING, SAY SOMETHING. ONLY YOU CAN PREVENT FAKE NEWS DUMPSTER FIRES.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Twitter quickly added one of their infamous \u201cmanipulated video\u201d labels to the clearly faux meme. And later, the family of the toddlers in the meme filed a private suit against Trump and Cook alleging \u201cthe exploitation of the childrens\u2019 image had violated New York privacy and publicity rights law (N.Y. Civil Rights Law \u00a7\u00a750 and 51) and was both an intentional and negligent infliction of emotional distress,\u201d The Hollywood Reporter noted.<\/p>\n<p>\u201cInitially, as defendants assert, the video was newsworthy,\u201d Cohen wrote in his decision. \u201cTo promote freedom of expression, the meaning of \u2018newsworthiness\u2019 has been broadly construed and includes \u2018not only descriptions of actual events \u2026 but also articles concerning political happenings, social trends, or any subject of public interest.&#8217;\u201d<\/p>\n<p>\u201cIt is common knowledge that one of the principal tactics of Trump\u2019s presidential campaigns, as well as his presidency, was to incessantly attack the mainstream media as purveyors of \u2018fake news,\u2019 including his claim that the media exaggerates the extent of racial division in this country,\u201d the judge continued. \u201cThus, the video\u2019s references to \u2018fake news\u2019 and its depiction of race relations, however distorted, are clearly newsworthy.\u201d<\/p>\n<p>\u201cSince the video is therefore a satire, albeit one which some may consider to be rather distasteful, this Court is constrained to find that it is not actionable,\u201d he said.<\/p>\n<p>Cohen, though, did not agree with Trump\u2019s request to have his legal fees paid for from the \u201cfrivolous\u201d suit. The plaintiffs had a \u201cgood faith basis\u201d for their case, Cohen said, and \u201cshould not be penalized by the draconian language set forth in\u201d the anti-SLAPP statute, according to The Hollywood Reporter.<\/p>\n<p>Last week, Trump&nbsp;filed class-action lawsuits against Big Tech giants Facebook, Google, and Twitter over the censorship of conservatives, The Daily Wire\u2019s <a href=\"https:\/\/www.dailywire.com\/news\/opinion-is-trumps-big-tech-lawsuit-a-dead-on-arrival-media-stunt\">Ian Haworth<\/a> reported:<\/p>\n<blockquote readability=\"26.65625\">\n<p><em>Speaking at a news conference, Trump said the lawsuits would demand that the court prevent ongoing censorship.<\/em><\/p>\n<p><em>\u201cWe\u2019re demanding an end to the shadow-banning, a stop to the silencing, and a stop to the blacklisting, banishing, and canceling that you know so well,\u201d Trump <a href=\"https:\/\/www.washingtonpost.com\/technology\/2021\/07\/07\/trump-lawsuit-social-media\/\">said<\/a>, calling the lawsuits \u201ca very important game-changer for our country.\u201d<\/em><\/p>\n<p><em>The lawsuits, filed in the Southern District of Florida, argue that Big Tech giants violated Trump\u2019s First Amendment rights when they suspended his social media accounts. In addition, they claim that many such platforms should be considered as \u201cstate actors\u201d who should be limited by \u201cFirst Amendment restrictions on government limitations on free speech.\u201d Finally, the lawsuits look to strike down Section 230 of the Communications Decency Act, as well as <a href=\"https:\/\/www.washingtonpost.com\/technology\/2021\/07\/07\/trump-lawsuit-social-media\/\">seeking<\/a> \u201cunspecified punitive damages.\u201d<\/em><\/p>\n<\/blockquote>\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
