The court ruled that 18-year-olds possess Second Amendment rights, and the federal government failed \u201cto justify its infringement of those rights under the appropriate level of scrutiny.\u201d<\/p>\n<p>\u201cDespite the weighty interest in reducing crime and violence, we refuse to relegate either the Second Amendment or 18- to 20-year-olds to a second-class status,\u201d Judge Julius Richardson wrote in the majority opinion.<\/p>\n<p>The <a href=\"https:\/\/casetext.com\/case\/hirschfeld-v-bureau-of-alcohol\"><u>case<\/u><\/a>, Hirschfield v. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), concerned a federal <a href=\"https:\/\/casetext.com\/statute\/united-states-code\/title-18-crimes-and-criminal-procedure\/part-i-crimes\/chapter-44-firearms\/section-922-unlawful-acts\"><u>law<\/u><\/a> making it illegal for federally licensed firearms dealers to sell handguns to customers under the age of 21. (Photo by Brian Blanco\/Getty Images)<\/p>\n<\/div>\n<p>\u201cTo justify this restriction, Congress used disproportionate crime rates to craft over-inclusive laws that restrict the rights of overwhelmingly law-abiding citizens,\u201d Richardson said. \u201cSo we hold that the challenged federal laws and regulations are unconstitutional under the Second Amendment.\u201d<\/p>\n<p>Judge James Wynn criticized the logic of the ruling in his dissent, arguing the Second Amendment was different from other constitutional rights and its infringement by the law was justified. <strong><a href=\"https:\/\/dailycaller.com\/2021\/06\/22\/colorado-giffords-jared-polis-national-rifle-association\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Gun Rights Imperiled As State Preemption Laws Face Challenges)<\/a><\/strong><\/p>\n<p>\u201cNo, the Second Amendment is exceptional not because it is uniquely oppressed or imperiled, but rather because it is singularly capable of causing harm,\u201d Wynn wrote, calling the decision a victory for the gun lobby.<\/p>\n<p>\u201cHuge win for the Second Amendment,\u201d gun advocacy group National Association for Gun Rights <a href=\"https:\/\/twitter.com\/NatlGunRights\/status\/1415021106340106241\" target=\"_blank\" rel=\"noopener noreferrer\">tweeted<\/a> in response to the decision.<\/p>\n<p>The ATF was joined by gun control organizations <a href=\"https:\/\/giffords.org\/\"><u>Giffords<\/u><\/a>&nbsp;and <a href=\"https:\/\/www.bradyunited.org\/\"><u>Brady<\/u><\/a>&nbsp;in the case.
