The former Maxwell attorney said that the government asked that the court \u201cissue an order pursuant to Local Rule 23.1(h)\u201d directed at Markus. <strong><a href=\"https:\/\/dailycaller.com\/2021\/06\/30\/pennsylvania-supreme-court-conviction-bill-cosby\/\">(RELATED: Pennsylvania Supreme Court Overturns Bill Cosby\u2019s Sexual Assault Conviction)<\/a><\/strong><\/p>\n<p>\u201cThe Pennsylvania Supreme Court did the right thing when it threw out Bill Cosby\u2019s convictions because prosecutors cheated,\u201d <a href=\"https:\/\/www.nydailynews.com\/opinion\/ny-oped-cosby-maxwell-free-20210630-gqlcsn6yczaivp5h7g7x73lfzu-story.html\">Markus wrote in the June 30 op-ed<\/a>.<\/p>\n<p>The former Maxwell attorney argued that prosecutors had promised Cosby they wouldn\u2019t prosecute him if he testified in civil cases against him, but then broke their promise and \u201cused Cosby\u2019s statements in those depositions to win a conviction against him.\u201d<\/p>\n<p class=\" \">The opinion and reasoning in Cosby\u2019s case \u201capplies directly to Ghislaine Maxwell\u2019s case,\u201d Markus said, noting that \u201cJeffrey Epstein pleaded guilty and struck a bargain with the prosecutors in Miami\u201d and \u201cin exchange for pleading guilty in state court, the U.S. attorney\u2019s office agreed that it would not prosecute any of his alleged co-conspirators.\u201d<\/p>\n<p class=\" \">\u201cDespite its promise not to go after Maxwell, federal prosecutors in New York brought a federal case against her after Epstein died, arguing that it does not need to live up to the deal struck by federal prosecutors in Miami,\u201d he wrote. \u201cBut that reasoning makes no sense. We have one federal government, and the agreement says clearly that the United States would not prosecute Maxwell.\u201d<\/p>\n<p>In the Friday court filing, Markus argued that his op-ed did not break any rules. (Photo by Florida Department of Law Enforcement via Getty Images)<\/p>\n<\/div>\n<p>The former Maxwell attorney also argued that Maxwell, her family, and their counsel \u201chave the right to respond to the numerous lawyers, witnesses, and surrogates who are speaking to the press and making it impossible for Ms. Maxwell to receive a fair trial.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/07\/07\/address-book-possible-connections-jeffrey-epstein\/\">(RELATED: Address Book Found On NYC Sidewalk Appears To Show More Connections Of Convicted Pedophile Jeffrey Epstein)<\/a><\/strong><\/p>\n<p>\u201cThe press has been unrelenting and overwhelmingly prejudicial in its coverage of Ms. Maxwell and her family, fueled by statements from involved parties about the matters at issue,\u201d he continued. \u201cIt is not an understatement to say that 99.9% of the press coverage is pro-government and anti-Maxwell.<\/p>\n<p>\u201cThe press has already tried and convicted he,\u201d Markus said. \u201cAnd the Government has done nothing to control its surrogates, which has only made the problem worse.\u201d<\/p>\n<p>He asked: \u201cHow can Ms. Maxwell be expected to receive a fair trial when lawyers for the accusers are holding press conferences, leaking information, and otherwise making wholly inappropriate comments to the press?\u201d<\/p>\n<p>Markus also argued that the government has created a \u201ctotally unlevel playing field\u201d for Maxwell through \u201cblowups, photographs, soundbites, inflammatory language, and strategic pauses to get the most impactful photo opportunity.\u201d These are strategies designed to \u201cstir up the press\u201d and \u201cinflame the passions of the public,\u201d he wrote.<\/p>\n<p>\u201cAnd it worked,\u201d the former Maxwell attorney added.<\/p>\n<p>SDNY did not immediately respond to a request for comment from the Daily Caller News Foundation. <strong><a href=\"https:\/\/dailycaller.com\/2020\/07\/02\/fbi-ghislaine-maxwell-jeffrey-epstein-maria-farmer\/\">(RELATED: FBI Knew Of Allegations Against Ghislaine Maxwell As Early As 1996, Accuser Says. It Took 24 Years To Arrest Her)<\/a><\/strong><\/p>\n<p>Epstein died of apparent suicide in a federal&nbsp;<a href=\"https:\/\/dailycaller.com\/2019\/08\/10\/jeffrey-epstein-dead-suicide\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/dailycaller.com\/2019\/08\/10\/jeffrey-epstein-dead-suicide\/&amp;source=gmail&amp;ust=1593782873958000&amp;usg=AFQjCNFtwmsMIgso_Ibi80FNheWyFgv9Ag\">jail<\/a> in New York City in August 2019. <span class=\"il\"><a href=\"https:\/\/dailycaller.com\/2020\/07\/02\/ghislaine-maxwell-jeffrey-epstein-fbi-arrested\/\">Maxwell<\/a>, who has been accused of involvement in Epstein\u2019s crimes against young women, was arrested by the FBI in July 2020<\/span>.<\/p>\n<p>A grand jury&nbsp;<a href=\"https:\/\/drive.google.com\/file\/d\/1USk2BQEwtLfE_XJ7FnXd-zEldfFdyWhj\/edit\">indicted her on charges<\/a>&nbsp;of conspiracy<span class=\"css-901oao css-16my406 r-1qd0xha r-ad9z0x r-bcqeeo r-qvutc0\"> entice minors to engage in illegal sex acts, conspiracy to transport minors to these illegal sex acts, transportation of a minor to engage in illegal sex acts and perjury.<\/span><\/p>\n<p><span class=\"css-901oao css-16my406 r-1qd0xha r-ad9z0x r-bcqeeo r-qvutc0\">The victims were as young as 14 years old, the indictment said, noting that both Maxwell and Epstein \u201cknew that certain victims were in fact under the age of 18.\u201d<\/span><\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
