Thomas Anderson of the Western District of Tennessee issued a preliminary injunction to stop the Agriculture Department from delivering race-based loan payments under Section 1005 of the $1.9 trillion American Rescue Plan.<\/em><\/p>\n<p><em>\u2026 The ruling in favor of fourth-generation farmer Robert Holman of Union City, Tennessee, came as the latest court defeat for the <a href=\"https:\/\/www.washingtontimes.com\/topics\/usda\/\">USDA<\/a> as it seeks to pay off up to 120% of qualified federal loans for \u201csocially disadvantaged\u201d farmers and ranchers, defined as \u201cBlack, American Indian\/Alaskan Native, Hispanic, or Asian, or Hawaiian\/Pacific Islander.\u201d<\/em><\/p>\n<\/blockquote>\n<p>\u201cThe Court finds that Plaintiff (Holman)&nbsp;has shown a substantial likelihood that he&nbsp;will prevail on his claim that Section 1005 violates his&nbsp;right to equal protection under the law,\u201d the decision said. \u201cAbsent action by the Court, socially disadvantaged farmers will obtain debt relief, while Plaintiff will suffer the irreparable harm of being excluded from that program solely on the basis of his&nbsp;race.\u201d<\/p>\n<p>As highlighted by <a href=\"https:\/\/www.forbes.com\/sites\/elenabotella\/2021\/06\/04\/black-and-minority-farmers-will-receive-4-billion-in-debt-relief-for-some-its-a-lifeline-for-others-too-little-too-late\/?sh=17b0caca1d5d\">Forbes<\/a>, the Biden-signed American Rescue Plan \u201cincludes $4 billion in debt relief payments for farmers categorized as \u2018socially disadvantaged\u201d&nbsp;by the United States Department of Agriculture, primarily farmers who are Black, Hispanic, American Indian, or Asian American.\u201d<\/p>\n<p>Whites, no matter their economic strains, are excluded.<\/p>\n<p>Last month, a&nbsp;federal judge in Florida issued a preliminary injunction against the racist relief program, <a href=\"https:\/\/www.dailywire.com\/news\/judge-halts-biden-4-billion-relief-program-that-excludes-white-farmers-discrimination-based-on-race\">The Daily Wire<\/a> reported:<\/p>\n<blockquote readability=\"13.866156787763\">\n<p><em>U.S. District Judge Marcia Morales Howard halted the package in a ruling that suggested the program was marred in \u201cgovernmentally imposed discrimination based on race.\u201d<\/em><\/p>\n<p><em>\u201cCongress also must heed its obligation to do away with governmentally imposed discrimination based on race,\u201d Howard <a href=\"https:\/\/www.washingtonpost.com\/business\/2021\/06\/23\/black-farmers-debt-relief-preliminary-injunction\/\">wrote<\/a> in her decision, adding that \u201cit appears that in adopting Section 1005\u2019s strict race-based debt relief remedy Congress moved with great speed to address the history of discrimination, but did not move with great care.\u201d<\/em><\/p>\n<\/blockquote>\n<p>As highlighted by The Daily Wire\u2019s <a href=\"https:\/\/www.dailywire.com\/news\/federal-judge-halts-biden-administration-program-that-discriminated-against-white-farmers-saying-lawsuit-could-be-successful\">Ashe Show<\/a>, a federal judge in Wisconsin, too, ordered a temporary halt to the program last month, ruling that the white farmers who filed lawsuits \u201care likely to succeed on the merits of their claim\u201d:<\/p>\n<blockquote readability=\"14\">\n<p><em>Judge William Griesbach ruled that the USDA\u2019s \u201cuse of race-based criteria in the administration of the program violates their right to equal protection under the law.\u201d<\/em><\/p>\n<p><em>Matt Herrick, a spokesman for the USDA, told NBC: \u201cWe respectfully disagree with this temporary order and USDA will continue to forcefully defend our ability to carry out this act of Congress and deliver debt relief to socially disadvantaged borrowers.
