The new justice has so far shown \u201cherself to be committed to upholding the rule of law and the Constitution,\u201d Judicial Crisis Network President Carrie Severino told the Daily Caller News Foundation.<\/p>\n<p>Though Democrats <a href=\"https:\/\/twitter.com\/ewarren\/status\/1309975654016966656?lang=en\">warned<\/a> that Barrett would immediately take aim at Obamacare, the new justice <a href=\"https:\/\/www.newsweek.com\/amy-coney-barrett-votes-uphold-obamacare-despite-democrats-fear-she-would-overturn-it-1601673\">joined<\/a> a 7-2 majority in June rejecting a challenge to the Affordable Care Act. <strong><a href=\"https:\/\/dailycaller.com\/2020\/07\/05\/brett-kavanaugh-liberal-groups-scotus-supreme-court-abortion\/\">(RELATED: Liberal Groups Warned That Kavanaugh Would Push SCOTUS Dramatically To The Right. Their Fears Haven\u2019t Been Met)<\/a><\/strong><\/p>\n<p>\u201cA vote by any senator for Judge Amy Coney Barrett is a vote to strike down the Affordable Care Act and eliminate protections for millions of Americans with preexisting conditions,\u201d then-Senate Minority Leader Chuck Schumer said during her confirmation. \u201cBy nominating Judge Amy Coney Barrett to the Supreme Court, President [Donald] Trump has once again put Americans\u2019 health care in the crosshairs.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.533333333333\">\n<p dir=\"ltr\" lang=\"en\">Amy Coney Barrett will work to gut Roe v. Wade and the ACA, taking away health care coverage from millions of Americans\u2014including those with pre-existing conditions. And make no mistake: Trump is counting on her to swing the Supreme Court in his favor when he loses this election. <a href=\"https:\/\/t.co\/cTpOHgintZ\">pic.twitter.com\/cTpOHgintZ<\/a><\/p>\n<p>\u2014 Elizabeth Warren (@ewarren) <a href=\"https:\/\/twitter.com\/ewarren\/status\/1309975654016966656?ref_src=twsrc%5Etfw\">September 26, 2020<\/a> <\/p>\n<\/blockquote>\n<p>Rather than making huge splashes in her interpretation of hot button cases as many conservatives have called on her to do, the Wall Street Journal <a href=\"https:\/\/www.wsj.com\/articles\/justice-barrett-showed-her-conservative-stripes-but-defied-expectations-11625316673\" target=\"_blank\" rel=\"noopener noreferrer\">reported,<\/a> Barrett has chosen to interpret narrowly and to join with Justices Brett Kavanaugh and John Roberts over the more conservative justices.<\/p>\n<p>\u201cDuring her confirmation hearings, Justice Barrett said that she would be her own justice,\u201d Dallas-based attorney Allyson Ho, who has argued cases before the court, <a href=\"https:\/\/www.reuters.com\/world\/us\/barrett-finds-own-voice-center-conservative-us-supreme-court-2021-07-02\/\">told Reuters<\/a>. \u201cAnd so far, that\u2019s exactly what she\u2019s done.\u201d<\/p>\n<p>The court <a href=\"https:\/\/dailycaller.com\/2021\/06\/17\/supreme-court-catholic-adoption-agency\/\">unanimously sided<\/a> with a Catholic adoption agency in a religious freedom case regarding same sex unions,&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/19-123_g3bi.pdf\">ruling<\/a> 9-0 that the city of Philadelphia\u2019s refusal to contract with Catholic Social Services (CSS) unless CSS agreed to \u2018certify same-sex couples as foster parents\u201d violates CSS\u2019s free exercise of the First Amendment.<\/p>\n<p>Six of the justices, including Barrett, rejected calls to push further and overturn the 1990 case <a href=\"https:\/\/www.scotusblog.com\/2021\/06\/protecting-free-exercise-under-smith-and-after-smith\/\">Employment Division v. Smith<\/a> \u2014 a Supreme Court precedent upholding laws that are generally applicable even if they place a burden on religion. (Photo by Alex Edelman \/ AFP) (Photo by ALEX EDELMAN\/AFP via Getty Images)<\/p>\n<\/div>\n<h3>Media Frenzy Over Future Justice Amy Coney Barrett<\/h3>\n<p>\u201cThroughout her first term on the Court, Justice Barrett has ruled as an independent and thoughtful jurist,\u201d Americans United for Life (AUL) President Catherine Glenn Foster told the DCNF. \u201cShe deserves an apology from many in the media who portrayed her as a political activist rather than as a fair judge who is committed to the United States Constitution.\u201d<\/p>\n<p>During Barrett\u2019s confirmation hearings last fall, Democrats, media outlets and activists fixated on Barrett\u2019s adherence to Catholic principles and her large family, suggesting that she was \u201cextreme\u201d and unfit to serve on the Supreme Court.<\/p>\n<p>Media <a href=\"https:\/\/dailycaller.com\/2020\/09\/22\/media-catholic-people-of-praise-amy-coney-barrett-handmaids-tale\/\">linked Barrett<\/a> to the Catholic group People of Praise, falsely reported that the group was the inspiration for Margaret Atwood\u2019s \u201cThe Handmaid\u2019s Tale,\u201d and even went so far as to <a href=\"https:\/\/twitter.com\/JerryDunleavy\/status\/1309941165215670272\">suggest<\/a> that Barrett adopted her children for nefarious reasons.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"11.123287671233\">\n<p dir=\"ltr\" lang=\"en\">Hi, only Senator to work at Planned Parenthood here.<\/p>\n<p>Barrett\u2019s views on Roe v. Wade are clear. Now she won\u2019t say whether Roe was wrongly decided. Don\u2019t be fooled: Barrett has an agenda to get on the Court to overturn reproductive rights.<\/p>\n<p>\u2014 Elizabeth Warren (@SenWarren) <a href=\"https:\/\/twitter.com\/SenWarren\/status\/1316019730407329798?ref_src=twsrc%5Etfw\">October 13, 2020<\/a> <\/p>\n<\/blockquote>\n<p>The Washington Post\u2019s Ron Charles highlighted Barrett\u2019s comment that the ultimate goal in life is to build \u201cthe Kingdom of God \u201d \u2014 a comment that echoes traditional Catholic teaching on man\u2019s purpose. <strong><a href=\"https:\/\/dailycaller.com\/2020\/09\/22\/media-catholic-people-of-praise-amy-coney-barrett-handmaids-tale\/\">(RELATED: Media Outlets Link Catholic Group Associated With Amy Coney Barrett To \u2018The Handmaid\u2019s Tale\u2019)<\/a><\/strong><\/p>\n<p>\u201cAmy Coney Barrett, the judge at the top of Trump\u2019s list to replace Ruth Bader Ginsburg, has said we should always remember that a \u2018legal career is but a means to an end \u2026 and that end is building the Kingdom of God,\u2019\u201d Charles <a href=\"https:\/\/dailycaller.com\/2020\/09\/26\/amy-coney-barrett-supreme-court-attacks-democrats-media\/\">tweeted<\/a>.<\/p>\n<p>Others <a href=\"https:\/\/twitter.com\/arlenparsa\/status\/1307289967647916033\">called<\/a> Barrett a \u201cCatholic extremist with 7 children\u201d or&nbsp;<a href=\"https:\/\/twitter.com\/laurenthehough\/status\/1307536494828179456\">condemned<\/a> Barrett as a \u201crabid fucking lunatic.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.764705882353\">\n<p dir=\"ltr\" lang=\"en\">Let\u2019s be explicit: anti-abortion extremists made it clear that this was the goal all along. Progressive groups, media and activists alike reacted similarly when Justice Brett Kavanaugh replaced former Supreme Court Justice Anthony Kennedy after a highly contentious confirmation process, arguing that Kavanaugh was the fifth vote needed to overturn Roe v. Wade. <strong><a href=\"https:\/\/dailycaller.com\/2020\/06\/29\/chief-justice-john-roberts-conservatives-turn-scotus-abortion-louisiana\/\">(RELATED: \u2018He\u2019s A Disgrace\u2019: Conservatives Turn On Chief Justice Roberts)<\/a><\/strong><\/p>\n<p>The emotional backlash against Kavanaugh\u2019s confirmation escalated following multiple allegations of sexual assault against the future Supreme Court justice. Christine Blasey Ford\u2019s lawyer <a href=\"https:\/\/dailycaller.com\/2019\/09\/04\/christine-ford-abortion-kavanaugh\/\">would later admit<\/a> that putting an \u201casterisk\u201d next to Kavanaugh\u2019s name before \u201che takes a scalpel\u201d to Roe v. Russo, in which an abortion provider <a href=\"https:\/\/abcnews.go.com\/US\/supreme-court-set-hear-critical-louisiana-abortion-case\/story?id=69256978\" target=\"_blank\" rel=\"noopener noreferrer\">challenged<\/a>&nbsp;a law&nbsp;requiring&nbsp;<a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=2ahUKEwixiKfusP_nAhVIrJ4KHYVcB4AQFjAAegQIBBAB&amp;url=https%3A%2F%2Fdailycaller.com%2F2020%2F03%2F03%2Fwest-virginia-abortion-bill-born-alive%2F&amp;usg=AOvVaw0IVsbfVVkv4ZAl1iwkEFj1\" target=\"_blank\" rel=\"noopener noreferrer\">abortion<\/a> providers to have admitting privileges to a hospital within 30 miles of the facility.<\/p>\n<p>Chief Justice Roberts&nbsp;<a href=\"https:\/\/dailycaller.com\/2020\/06\/29\/scotus-strikes-down-louisiana-abortion-restrictions\/\">sided<\/a> with the liberal justice for a 5-4 ruling that struck down the Louisiana law. The decision was met with heavy criticism from conservatives, particularly because Roberts also voted with the liberal justices on recent DACA and LGBTQ rulings. Tom Cotton <a href=\"https:\/\/dailycaller.com\/2021\/07\/05\/tom-cotton-roe-v-wade-supreme-court-abortion\/\">pointed out to the DCNF<\/a> in a late June interview that much of the backlash and frenzy over former President Donald Trump Supreme Court picks \u2014 Neil Gorsuch, Kavanaugh, and Barrett \u2014 stem from anxiety over protecting Roe v. (Photo by Chip Somodevilla\/Getty Images)<\/p>\n<\/div>\n<p>\u201cThe stakes were a little bit lower the year prior with Neil Gorsuch because he was replacing Justice Scalia,\u201d Cotton told the DCNF, \u201cbut with Brett Kavanaugh replacing Justice Kennedy (who had been a member of the majority in Planned Parenthood v. Casey) the abortion lobby and the abortion industry pulled out all the stops.\u201d<\/p>\n<p>\u201cWhat happened to Brett Kavanaugh was a disgrace,\u201d Cotton added. \u201cHe was attacked and he was smeared without evidence, in fact, contrary to what little evidence there was. So I think you saw just how far they will go, it\u2019s an example of how radical and extreme Democrats have become.\u201d<\/p>\n<h3>What\u2019s Next?<\/h3>\n<div readability=\"49.57647843486\">\n<p>Though Barrett, Kavanaugh, and Roberts have joined with the liberal justices in several important cases this term, experts <a href=\"https:\/\/www.scotusblog.com\/2021\/07\/in-barretts-first-term-conservative-majority-is-dominant-but-divided\/\">predict<\/a> the impending \u201cblockbuster docket next term featuring clashes over abortion and gun rights\u201d could prove to be the \u201creal test.\u201d<\/p>\n<p>Barrett, Kavanaugh, and Roberts were the three justices most often in the majority in rulings during the past term, according to statistics <a href=\"https:\/\/www.scotusblog.com\/2021\/07\/in-barretts-first-term-conservative-majority-is-dominant-but-divided\/\">measured by the SCOTUSblog.<\/a> Despite liberal uproar over his nomination, Kavanaugh was in the majority 97% of the time, while Barrett and Roberts found themselves in the majority 91% of the time.<\/p>\n<p>\u201cOne of the things about deciding the cases on the narrowest possible grounds is that it makes it easier for more people to agree, who have different world views,\u201d ACLU Deputy Legal Director Louise Melling <a href=\"https:\/\/www.youtube.com\/watch?v=03C-u1ZvzQI\">said during a late June discussion<\/a> of the new supermajority. \u201cThat\u2019s ultimately a good thing for the Court.\u201d<\/p>\n<p>\u201cIt\u2019s not a good thing for the Court if they are seen as deciding everything on partisan lines, so I think there will be institutional interests that will continue to drive them to try to decide case narrowly,\u201d he continued. \u201cBut as we\u2019ll talk about at the end of this session, there are some pretty big cases coming up for next year that are going to be very hard to decide in ways that don\u2019t divide along partisan lines. This will be the first major abortion case in which all three Trump justices participate.<\/p>\n<\/p><\/div>\n<div tabindex=\"0\" role=\"button\" readability=\"9.2436974789916\">\n<div class=\"cue-group style-scope ytd-transcript-body-renderer\" readability=\"47.899159663866\">\n<div class=\"cues style-scope ytd-transcript-body-renderer\" readability=\"51.821705426357\">\n<p>The case deals with a 2018 Mississippi law banning abortions after 15 weeks, a law&nbsp;<a href=\"https:\/\/reproductiverights.org\/supreme-court-to-hear-abortion-ban-case-challenging-roe-v-wade\/\">challenged<\/a>&nbsp;by the Center for Reproductive Rights, the law firm Paul Weiss, Rifkind, Wharton &amp; Garrison, and the Mississippi Center for Justice on behalf of the last remaining abortion clinic in Mississippi \u2014 Jackson Women\u2019s Health Organization. After the Fifth Circuit Court of Appeals&nbsp;<a href=\"https:\/\/nam02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Freproductiverights.org%2Fpress-room%2Fappeals-court-strikes-down-mississippi-15-week-abortion-ban&amp;data=04%7C01%7Cnfranco%40reprorights.org%7C302efcc6678349bf5eff08d9193fc687%7Ce5451579057a46829656b9548f94b665%7C0%7C0%7C637568583984413006%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=DKRY4%2FI4UzL%2FN0Fblk7hH7Vd1E4b1zFNcXjdLXyC7jI%3D&amp;reserved=0\">struck down<\/a> the law in December 2019, the state of Mississippi asked the Supreme Court to take up the case.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2020\/06\/29\/scotus-strikes-down-louisiana-abortion-restrictions\/\">(RELATED: SCOTUS Rules In Favor Of Abortion Advocates In Major Pro-Life Loss)<\/a><\/strong><\/p>\n<p>Dobbs vs. Jackson Women\u2019s Health Organization will touch on the landmark Roe v. Wade ruling since the Supreme Court will hear arguments on whether abortion bans prior to fetal viability are constitutional, <a href=\"https:\/\/www.politico.com\/news\/2021\/05\/17\/supreme-court-abortion-case-roe-challenge-488983\">Politico reported<\/a>.<\/p>\n<p>An unborn baby is&nbsp;<a href=\"https:\/\/www.verywellfamily.com\/premature-birth-and-viability-2371529\">considered viable<\/a> at 24 weeks, though medical intervention and a stay in the newborn intensive care unit (NICU)&nbsp;are usually required this early. Babies born before 23 weeks&nbsp;<a href=\"https:\/\/www.acog.org\/clinical\/clinical-guidance\/obstetric-care-consensus\/articles\/2017\/10\/periviable-birth\">have a survival rate<\/a>&nbsp;of about 5% to 6%, and analysis by Charlotte Lozier Institute medical experts found that unborn babies&nbsp;<a href=\"https:\/\/lozierinstitute.org\/new-study-shows-unborn-babies-feel-pain-at-12-weeks\/\">can feel pain as early as 12 weeks<\/a>.<\/p>\n<p>Justice Roberts failed to provide the needed fifth vote in June Medical Services v. Russo during the 2019-2020 term, voting with the liberal members of the court in the close 5-4 ruling. Following days of <a href=\"https:\/\/dailycaller.com\/2020\/06\/29\/scotus-strikes-down-louisiana-abortion-restrictions\/\">emotional protesting<\/a> when the court took up the case in March 2020, the court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/18-1323_c07d.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ruled<\/a> in June 2020 that a pro-life Louisiana law violated the rights of both women and abortion providers in the state.<\/p>\n<\/p><\/div>\n<p>\u201cThe Louisiana law imposes a burden on access to abortion just as severe as that imposed by the Texas law, for the same reasons,\u201d Roberts wrote in his opinion. \u201cTherefore Louisiana\u2019s law cannot stand under our precedents. <strong><a href=\"https:\/\/dailycaller.com\/2020\/03\/04\/schumer-kavanaugh-gorsuch-abortion\/\">(RELATED: Schumer Warns Gorsuch And Kavanaugh: \u2018You Have Released The Whirlwind And You Will Pay The Price\u2019)<\/a><\/strong><\/p>\n<p>His vote may not matter in the upcoming Mississippi case if Barrett joins Kavanaugh, Gorsuch, Alito and Thomas in voting next term.<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
