If a person has a penis, he\u2019s a man. And if he is sent to prison, it ought to be with other men.\u201d<\/p>\n<p>Bartosch started her essay by referencing a ruling by Great Britain\u2019s High Court last week that high-risk male offenders, including rapists, could be situated in female prisons if they claim they are transgender.<\/p>\n<p>She mocked a Ministry of Justice (MoJ) policy, called \u201cThe care and management of individuals who are transgender\u201d for assuming that those with the power to place biological men in women\u2019s prisons had to complete an e-learning module on transgender identity, thus rendering them fir to make the decision. \u201cWhat could possibly go wrong?\u201d she writes.<\/p>\n<p>\u201cThe Ministry of Justice admits that it does not know how many prisoners identify as trans because those with Gender Recognition Certificates (GRCs) are counted as their new \u2018legal gender,\u2019\u201d Bartosch notes, adding, \u201cWhether violence is a product of socialization or hormones, it is clear that male prisoners are far more likely to pose a sexual and\/or violent threat to women prisoners. Indeed, <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/938360\/statistics-on-women-and-the-criminal-justice-system-2019.pdf\">2019 Ministry of Justice figures<\/a> show that 98 percent of those prosecuted for sexual offences, and 84 per cent of those prosecuted for violence against the person, are male. Moreover, it is estimated that around <a href=\"https:\/\/www.thetimes.co.uk\/article\/up-to-half-of-trans-inmates-may-be-sex-offenders-26rz2crhs\">half of male prisoners<\/a> who identify as trans have been convicted of sexual offenses.\u201d<\/p>\n<p>\u201cIs it wise to house men who identify as trans, many of whom may be guilty of sexual or violent offenses, in women\u2019s prisons?\u201d she asks rhetorically. \u201cAfter all, it is perfectly possible to house men who identify as trans in prisons with other men. Indeed, there are currently around 129 males who identify as trans in the male prison estate.\u201d<\/p>\n<p>Bartosch quotes James Barrett, president of the British Association of Gender Identity Specialists in 2016, who <a href=\"https:\/\/www.spiked-online.com\/2021\/07\/06\/trans-women-should-not-be-in-womens-prisons\/amp\/%3Ca%20href=\">told<\/a> the House of Commons women and equalities committee that a \u201cdriving force\u201d in male prisoners claiming to be women \u201cwas a desire to make subsequent sexual offending much easier.\u201d She continues, \u201cThis observation is backed up by <a href=\"https:\/\/www.cambridge.org\/core\/journals\/the-psychiatrist\/article\/gender-reassignment-5-years-of-referrals-in-oxfordshire\/6B5F217162ABD9B3189F2EB82787034E\">2019 research<\/a>, published by Cambridge University Press, which found that some males seek \u2018gender reassignment as a means by which to increase their intimate contact with children, which they viewed to be more socially acceptable in a female role.\u2019\u201d<\/p>\n<p>She referenced the High Court ruling once more: \u201cIn the course of his ruling, Lord Justice Holroyde outlined a need to balance \u2018the subjective concerns of women prisoners\u2019 with the \u2018rights of transgender women in the prison system.\u2019 The framing here is telling. The proven risks to women are demoted to \u2018subjective concerns\u2019 that have to be weighed against the demands of men.
