The Supreme Court ruled 6-3 along partisan lines to strike down a California law that required nonprofits to disclose their donors to the state, something critics said violated the First Amendment and could lead to political targeting.<\/p>\n<p>One such critic was the American Civil Liberties Union\u2019s legal director, David Cole, who slammed the decision as one that would make it \u201charder to prove voter suppression, and easier to hide large donations.\u201d Ten hours later, however, Cole added a follow-up to his tweet, saying it was \u201ctoo hasty.\u201d<\/p>\n<p>\u201c\u2026 [Americans for Prosperity Foundation] AFPF decision protects important association rights, and doesn\u2019t question disclosure requirements in campaign finance,\u201d Cole wrote.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.538461538462\">\n<p dir=\"ltr\" lang=\"en\">Hilarious. Well, it\u2019s anyone\u2019s guess, but it might have something to do with the fact that Cole\u2019s employer filed an amicus brief <em>in support of<\/em> AFP, the plaintiffs in the case. Further, Cole\u2019s name appears on that brief.<\/p>\n<p>The case was brought by AFP and the Thomas More Law Center, who challenged the California law. As Forbes <a href=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2021\/07\/01\/supreme-court-sides-with-conservative-groups-empowers-dark-money-groups-with-ruling-striking-down-california-donor-law\/?sh=7570186f1512\">reported<\/a>, though \u201cdonors are not made public and California collects the donors for private purposes such as law enforcement investigations, information has leaked in the past, leading the organizations to argue the law could potentially put donors at risk if their involvement with partisan organizations becomes public.\u201d<\/p>\n<p>In a state like California, the risk for conservative groups is considerable, but the two groups received support from an amicus brief from not only the ACLU, but also the NAACP, who said the California law \u201crisks undermining the freedom to associate for expressive purposes.\u201d The groups, however, requested a narrow ruling in the court\u2019s decision and suggested any relief not apply to all nonprofits.<\/p>\n<p>Chief Justice Roberts wrote the decision, arguing that the California law amounted to a \u201cblanket demand\u201d for nonprofits to disclose their donors, which he called \u201cfacially unconstitutional.\u201d He added that such an \u201cup-front collection\u201d of donor data \u201cimposes a widespread burden on donors\u2019 associational rights.\u201d<\/p>\n<p>Justice Sonia Sotomayor, in her dissent, claimed the majority\u2019s ruling was supported by \u201cneither precedent nor common sense,\u201d an odd statement given the precedent of <em>Citizens United<\/em> and the fact that donor information has been leaked in the past.<\/p>\n<p>The decision was released on the final day of current Supreme Court term, following numerous decisions that did not break along assumed partisan lines, such as a 9-0 <a href=\"https:\/\/www.dailywire.com\/news\/unanimous-supreme-court-illegal-immigrants-do-not-have-a-right-to-green-cards\">ruling<\/a> that said illegal immigrants don\u2019t have a right to a green card and another unanimous <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rules-9-0-in-favor-of-catholic-foster-care-agency-that-refused-to-work-with-same-sex-couples\">ruling<\/a> that said a Catholic foster agency didn\u2019t have to work with same-sex couples in violation of their faith.<\/p>\n<p>\u201cThe dispute arose because Catholic Social Services \u2014 which was receiving taxpayer funds \u2014 was unwilling to work with LGBTQ couples as foster parents out of religious objections to same sex marriage. The policy was brought to the attention of the city in 2018 after inquiries from a local newspaper, and soon after the government put a freeze on the contract.
